  2. That's the right and legal way to do it. Coming to the US on ESTA with intention to adjust is fraud.
  3. Got it, this makes sense for your circumstances. It's not the most secure and optimal route immigration wise, but you need to do what you need to do. This may mean reduced flexibility for work and international travel while adjusting status. Good luck!

I think OP wants to skip naturalization step altogether for child so they're born US citizen (btw why not "citisen" in British English 😅) But they can't have it both ways: - Child born on US soil as US citizen - Child's mother is in valid status As you correctly mentioned, child's path to citizenship through mother's naturalization is the most legal and straightforward path. Yes, it does mean OP has to go to foreign country etc.

  10. Agreed, the risk of her being denied boarding on the plane or entry to the US is super high. I hope you realize US government officials such as CBP don't want that to happen and will likely deny entry? They're not silly. They'll ask why a pregnant lady close to her labor is travelling (I presume alone)? And who is she visiting and why. I give 80-90% chance she won't make it to the US, either because she will be denied boarding or because CBP will deny her entry and cancel ESTA. Even when filling forms for ESTA, I'm sure she'll be asked whether she knows anybody in the US. She can't lie. Once she puts husband, most likely it will be denied.

  13. Why K-1 and not spousal visa? Yes, you can use their address, but you need to establish US domicile when case is with NVC.

Out of curiosity, could you please share the reason? - Typically US citizen can marry the immigrant overseas, in their country - If not possible, US citizen and immigrant can marry in third neutral country (not USA and not immigrant's country) - If this is also not possible, they can marry online (Utah marriage), then meet either in immigrant's country or third neutral country - If US citizen cannot fly due to health reasons, immigrant can come to Mexico to meet and US citizen can drive there - If immigrant cannot go anywhere due to health reasons, how are they going to move to the US and live together? After marrying, the spousal visa process is similar, but simpler than fiance case. File I-130, wait for approval, schedule interview, go to interview, get visa in passport and come to the US. After coming to the US, no lengthy and expensive adjustment is needed. If the money is the issue, then K-1 is also a unfortunate choice, as it is more expensive compared to CR-1 / IR-1. The only scenario when K-1 makes more sense is when there are minor kids on immigrant side who also want to come to the US. It's more expensive to file I-130s for all of them VS include them in I-129F and AOS packet.

  19. Yes, some got approved. But sorry, again, the moment consular officer sees your wife is pregnant or has a little child with husband in the US, the chances of approval will go down drastically. Plus, she cannot come to the US on tourist visa with plan to adjust, that would be fraud.
  20. She won't be allowed on the plane at some point for medical reasons. Or she won't be allowed to board / enter the US on non-immigrant visa based on suspicion she's coming to give birth in the US. It's likely you'd have to plan visiting her overseas. And plan on petitioning your future child.
  21. MyProgess showed 3 weeks until decision for N-400 on day of my oath. Originally, it's showed 7 months, but case took 3.5 months. I have a collection of users on VJ reporting MyProgress showing wrong estimate. Do you want me to post them here?
