As mentioned above, I already AM a US citizen.

Ok....no timeline, so it was a bit confusing...at least.

But again, the fact that you are a naturalized citizen, unfortunately has no impact on the 10 year ban that happened because he overstayed his visa🤷‍♀️ those are the rules and they get enforced. Sorry for the situation, it's really unfortunate 😕

Please help us to understand your status correctly as that means we can give more accurate replies..

Updating your timeline would clarify things- your previous posts only mentioned you're a LPR🤷‍♀️but anyways, even as a citizen, you won't be able to shorten the ban for your dad who overstayed and due to that got a 10 year ban, unfortunately.

    Hi,

I have a question. My father exceeded his stay in the United States on his tourist visa. He now has a banned entry into the United States until 2027 (10 year ban). I recently became an American citizen and thought that this can help him get rid of this ban. I talked to an immigration lawyer and they told me that there is no way to shorten it. Is this true? There are no waivers that can help him? Or anything else that can help him expedite the process?

You are far away from being a citizen- you are a lawful permanent resident/ greencard holder

I haven't filed yet, we need to in September.. I'm just following out of curiosity, but I read on the USCIS Website that because of the back log with the removal of condition cases they automatically extended the 2 year green card 48 months once your papers are received and you get your NOA1 from them. Unless I am misunderstanding this.. Feel free to correct me. Here is the website I found: USCIS Extends green card validity . It's from January 2023. Hope this helps!

    Yes, you'll get a 48 month extension.

Arrived 15 mins before interview time - completed my security check - checked in with front desk and waited for my turn to be called.

In 10 mins, the USCIS immig officer opened the door and called my name, and took me back to her office. She was very kind and understanding, I did not feel stressed at all.

She requested my state ID and greencard. and started to explain how the process is going to be.

After verifying my name - she began with Civics questions:

    1. Two departments of govt

    2. Speaker of the house

    3. Right of anyone living in US

    4. Name of US president

    5. Statue of Liberty in?

    6. What do we call the first ten amendments to the Constitution?

    7. In what month do we vote for President? 8)What is one responsibility that is only for United States citizens?

    8. What do we show loyalty to when we say the Pledge of Allegiance?

    9. What is the capital of the United States?

    Got 9/10.

Reading - where is the white house located?

writing - The White house is located in Washington DC

After the interview- Got the response - decision can’t be made. (Some get approved right after the interview- mine wasn’t- I got a paper that said decision can’t be made now- and they will contact in the coming days with the decision. I was approved in 32 days.- I believe it was because my immigration officer needed supervisor approval)

    Timeline —————

    Office- ABQ, NM

    Applied- Jan 11,2023

    Biometrics - Feb 2,2023

    Interview - April 11, 2023

Zero sense to anyone because no one knows the reason yet.

It was just a plan for the travel dates and for when I file the application, I can file when the 90 days window starts. That's why I'm asking at the very first place to hear anyone options and opinions 🙂

Just file I-751 the day your 90 day window opens- you'll get the NOA / extension within a couple of weeks and are safe.

Wow! Cam back to the forum because it has exactly been 1 year since there was a change in my status.. 😔

So I was thinking of moving forward with the n400. Did you add more evidence to it?

I did add joint credit card account statement, proof of adding my wife to benefits ( life insurance, vision, FSA) in addition to the stuff they got already for the I-751.

    Thanks for your feedback!
IR5 - Parents: On average 10 thousand parents are getting their Green cards per month for the last few months. How many can afford to pay for private insurance? Medicare in many states are being used by them, in addition to emergency services.
IR1 - Spouses: Multiple immigration attorneys claim that the Spouse green card process takes 9 to 12 mths. So it is a shortcut, compared to 8 - 20 years for some other categories. And well, they don't have to sign a contract, and that's the point. Typically people become so frustrated from either (1) not getting sponsorship from their employers, or (2) waiting for too long in one of the other categories, that they are left with no other choice but to go for IR1/CR1.
FX - Exempt spouses for LPR's: They can apply jointly with their main applicant spouses, or they can apply under F2A. Can someone really explain the reason behind keeping two categories  (F2A and FX) for Spouses of LPR's?

Just curious: you're on a f1/ student visa, right? Are you considering to stay in the US?

Thanks, really appreciate the feedback. I tried utility bills but I seem to only be listed as having permissions on the account and don't actually show up on bills or official docs. Tried calling but utility companies where I live have notoriously bad customer service so I'm feeling like focusing on other stuff

It's fine if you're listed as having permission.  You said, no joint bank accounts- just highlight on the bankstatement the utilities- coming either from your or your partners acc.they should show same adress so that's good proof, too.

Hi, I received a Jury Summons letter in the mail.

I am a LPR living in California.

AFAIK Jury Duty is only applicable to US Citizens.

What should I do in this case? Call the number and state I am not eligible because I am not a US citizen?

    Thank you

I got one a while ago, too - also California.  Go on the webpage that's on the notice- and give answer the question about being a citizen with NO and therefore not eligible. They use dmv data, they don't know about your citizenship.

Basically title, my fiancé and I are waiting for the US embassy to process my K1 visa and we're looking at flight prices.
One way tickets to the US are around $1600 were as round trip tickets are $950 or less. Is it gonna be an issue if I buy a round way trip and only use one part of it?

I don't really care if the airline sanctions me but more concerned about the customs officer seeing my round way trip and getting funny ideas.

I booked a round trip , exactly cause of the price difference- I just didn't board the flight back or even requested a refund. No issues at all.

I'm finishing up with printing my tax transcripts, and am going to start to breathe again soon.  LOL.  We have got so many stacks of paper for them in our basement filing cabinet...sometimes I ask Travis if he's still convinced I was worth all the time/effort/money this took (he always laughs and says I was. :) )

Of course it was worth it! All the best for your interview!😃👍🍀

    Hi VJ-community,

I entered the US in the middle of May on IR-1 visa, I’m still waiting for my SSN since DHS seemed to have „lost“ the application, whatever that means and the local SSN office wouldn’t let me apply for a new number until 3 weeks after I entered.

Without a SSN, I also cannot get a Kansas drivers license or state ID yet.

Today I went into a vape shop, which had a 21+ sign in the window. I am almost 30 years old and had my German ID and even my passport with me.
I was asked for an ID, and then asked to leave, because they couldn’t „verify my age“ with my German ID or passport…… I guess they need to scan the ID and foreign IDs cannot be scanned by their computer program.
That very much felt like discrimination.
    Is that legal?

I know it will only take a few weeks to get a SSN now, and this isn’t really a life threatening problem or anything, but it still didn’t feel good to be asked to leave.

has anyone else had similar experiences?

Yeah sucks, I'm german too, but when I moved to California I was able to get driver's license immediately- they have a provision for that. But every state is different unfortunately 😕

Here's a report on our combo I-751/N-400 interview this morning at the Atlanta USCIS field office.

The interview was scheduled for 8:50 am.  We arrived at 8 am so we used the extra 30 minutes to review all of our documents, well-organized in labeled file folders, and the N-400 application one more time.  We entered the building at 8:30 am, showed the two interview notices (I-751 and N-400), and went through security, then checked in at the reception window where an employee took my husband's photo and fingerprint to confirm his identity.  Then we went up to the 3rd floor waiting area.  About 45 minutes later, an officer came up to my husband and confirmed our names, then said he would be back in five minutes.  When he returned he asked both of us to follow him to his office.  Once seated, he asked for our driver's licenses, also for my husband's passport and expired green card.  I noticed an open file on his desk, with all 500+ pages of the I-751 submission we sent two years ago.  He then had us stand up and do an oath to tell the truth.  Then he said he would first consider the pending I-751 and ask questions that either of us could answer, and some questions directed to one of us to answer.  The first question was how we met (online initially, three months later in person).  He asked a series of questions about why I proposed so quickly (on my second trip to Brazil, only five weeks after our first in-person meeting), and why my husband was willing to commit so quickly to marriage and potentially move to the US.  I got the impression that the officer was skeptical about our relationship (we have a 27 year age gap, big income and education differences).  We explained that we fell in love immediately when we first met in person, and wanted to be together, so we got married seven months after we first met.  He then asked for additional documents to support our relationship, new information from the last two years while the I-751 has been pending.  We gave him two years' of quarterly joint bank and credit card account statements, also five years of IRS tax return transcripts, married filing jointly.  He looked at these additional documents, kept them, and then said "I am a big photo person, do you have any photos?"  My husband handed him a file folder with about twelve pages of photos, 2 per page, from marriage to now, each with a brief description and date.  As he flipped through the photos, his countenance changed.  The look of doubt from before left his face, and he glanced up and said he was approving the I-751, then asked me to leave.  I went to the waiting area while he continued the N-400 interview with only my husband.  The officer did not ask to see any of the civil documents we had brought with us, but did ask or review most of the questions on the N-400 application.  Then he asked six of the 100 history/government questions, and my husband answered all of them correctly.  After that the officer did the reading and writing tests.  Following this, he gave my husband a form N-652, Naturalization Interview Results, with two marks checked: "you passed the tests of English and U.S. History and government," and "Congratulations! Your application is recommended for approval."  The oath ceremony letter will be sent via regular mail.  We were all done by 10 am and drove home very happy and relieved that things went so smoothly.

Based on my prior research, Atlanta USCIS schedules oath ceremonies for 4-6 weeks after the interview.  Once that happens and he has his naturalization certificate, his US immigration journey will be over, five years after it began when I filed an I-130 petition for him back in July, 2018, a month after we got married in Brazil.  I would like to thank all the regular contributors here on VisaJourney for your very helpful advice during this long process, as it has been invaluable to benefit from your experience and sense of community.  Good luck to everyone!

    🥳🥳🥳congratulations 😃

Relax and save your ink & paper.

I can tell you first hand from my several FOIA requests, that both front & back is scanned if it is double sided, and they have double sided scanners.

If I had obeyed that guidance my last submission would have been a really ridiculous nearer 8000 pages instead of an already ridiculous 4000 double sided.

I submitted double sided copies too, with every application- was never an issue

    Good for you.

I’ve started the legwork but wanted some clarification from the actual great people on this forum who want to help.

Not everyone is completely comfortable to just rely on their own legwork and ask for advise in this forum- that's what it is for. And fortunately there are lots of people able and willing to help , not to judge. So I think, that's exactly what you're doing- asking for clarification, advise. And you will get that- just don't react to criticism.

    Hi everyone!

I recently got married to my husband (USC) in New York City. It was a spontaneous decision but we didn’t want to be apart any longer and tried long distance for a while beforehand.

We want to get the ball rolling on adjusting my status from a tourist to permanent resident. However we are unsure of the exact forms we need to submit and how we go about doing them. It seems some forms are submitted online and some by post.

    1) What forms do I / we need to submit? I understand we should submit  the I-130 and I-485 together but how and where should we do this? I also want to apply for a EAD and travel authorisation to leave the country- what are the names of those forms? Should both of us have a USCIS account online?

I’m also confused about what form I need to submit for the medical exam.

Some clarity on all of the above would be great!

    Thanks in advance

I-693 is the form for the medical.you need to look up for the area you live, which civil surgeon is approved to do those exams for uscis- on uscis webpage is a search option for that. You might need several appointments, if you need several vaccination for example. I submitted all forms I-130.485 and I-765 work authorization and medical together by mail including all the required evidence/ documents.
