The proof for the doctor will be the first page where they say they are pleased to inform you that the consulate can now begin processing your visa. The checklist and DS-230 need to be sent back, he will also need to do the DS-160 online, and take a copy of the DS-160 application and the confirmation page. The DS-156k is the declaration that everything you have said is true, it goes with the DS-160 and the DS-156, which even though they dont ask for in P3, they do ask for in P4 (silly montreal), he can download it online from the department of state website and fill it out so he has it ready for the interview. The evidence of engagement is just another letter of intent with a date closer to your interview saying you still want to marry him
. For now though, all he has to do is check everything on the list (even if he doesnt have it all in hand yet, doesnt matter as the interviews are a few months behind) and send that with a DS-230 part 1 completed. Hope this helps
that was incredibly helpful! thank you so much!
just to reiterate then. the only things that need to be sent RIGHT NOW are the online ds-160 (which we've already completed), the checklist, the ds-230
i'm just confused because in the only form we got (ds-156k) it asks for birth certificate, criminal record, evidence of engagement and affidavit of support. but all that comes at the interview? i just want to make certain every last thing is correct!
thanks again!

hello all...just a few questions for you about the forms in packet 3.
+as far as i know, my fiancee was given ds-156k.
it says it is to be used with for ds-156- which was NOT included in the packet.
does that sound right? where is ds-156?
+on ds-156k it asks for "evidence of engagement". what sort of evidence are they looking for? a signed statement? something else?
+it also asks for "evidence of support". do they want the affidavit of support? or something else?
+on the front of the checklist is the MTL number. the consulate has made it clear they they want the forms from packet 3 and the checklist immediately, but the doctor doing the medical exam also wants proof that they sent packet 3. will they take a photocopy?
thanks in advance, guys!

Did you email the Consulate? It's possible they may have extended your validity date on their own. I don't know that you would be "denied". They will advise you, but it may be that your case will be considered "abandoned". If that is the case, you'll want to reapply and pursue a CR-1, not a K-3. You'll need to get married for this first, and then with your marriage certificate, make application. He'll be able to visit you in the interim, the same as if he'd been with a K-1, but right now a CR-1 is taking about 8 months I think in Canada, so he couldn't live with you for 8 months before returning for an interview, but could for awhile. Please let us know what you find out from the Consulate!
Wishing you luck!
thank you for your concern and luck!
the consulate wrote to me today and told us to just move our asses with the paperwork (i am taking liberties with their words, of course)! i forgot that we had damage to the first checklist they sent us originally and sent us another in march! so our paperwork was still within the 4 month period BARELY.
i'm sure you can imagine the relief! we were just so close to the end we didn't want to even consider another option. lots of praying from family and friends went on and i know that made all the difference
thank you again for the concern. you cant imagine how it is appreciated!!!

You will have to address/withdraw the K1 petition that you have already filed before filing anything else. Just letting it sit prevents you from submitting any other petition.
As he is in the system assosciated with a K1 the CBP may ask for more proof of ties to home.
None of us want to be apart from our loved ones. Playing the sympathy card won't get you anywhere with USCIS or the CBP.
Before you worry about alternate plans contact the consulate and get some answers from them regarding your K1 petition.
i would never do anything to violate the system. i'm hoping we WONT have to go the k3 route because we were almost home in regards to the k1. we were going to get him the medical on august 17th, and then...
the last time anything got filed was in april when i did the online ds-130. the time just got away from me and i wasnt aware of the 4 month validity. i feel so stupid and so sick about this. i did everything else right. we were so orangized and i'm just so worried about the conversation with the consulate on monday. i hope they see that this case is certainly NOT abandoned...at least on our end. we just had money difficulty and needed more time. had i known, i wouldve absolutely asked for an extension.
i guess now i'm just looking into other options if we are indeed denied (god forbid)
thanks for your answer...
-
there may be a chance that my fiancee and i screwed up and took too long to answer to our noa2 due to monetary problems.
i wont know if our case is closed until monday and i am distraught at the thought that we may be denied for being a few weeks late in getting in touch with the consulate. we had no idea there was a 4 month validity period.
please advise...
if my fiancee were to come here and we got married, could he stay here with me while we file a k3? i could get him on my lease and we have more than enough proof that we have a legitimate relationship. we just don't want to be apart anymore.
thanks in advance.

I'm pretty sure that the NOA2 has a 4 month period of validity...the consulate can and does extend it if needed. But if you have waited this long I don't know what to tell you, better get on the phone or email and find out what they got to say.
Good Luck
i just looked at my forms and i filled out the online ds-130 on april 17! could this mean that things are still all right?!
(thanks again in advance)

can i ask- where in the paperwork does it give the 4 month period of validity?

it's been 5 months since we received our noa2 and we are just now going to get the medical exam because we needed to save up money for the trip and fees!
the ds-130 was sent months ago, but i am freaking out that the delay will mean they threw out our case!
i wrote an email to the consulate, but HELP!
anyone else have delays or know the circumstances under which a case will be closed?!
-
>< I'm sorry, I didnt mean to make you worry! I just wanted to make sure that you had sent in the stuff because your timeline doesnt say you did... I really hope everything is ok.
i've only completed and sent the online ds-130! we needed to save up the money for the trip and the medical, which is why there was such a delay.
not your fault!
i've just emailed the consulate. hopefully everything is fine!!!!! AUGH!
-
Uh, no, the DS-160 was the online one. The DS-230 they send with the checklist (though you can download the form as well) but its a 2 part form, only need part 1, and it has to be sent back in with the checklist to them to put you in line. I would fire off an email to the consulate today just to make sure that everything is ok, they won't get back to you till Monday but I would send it just to make sure
oh my god...i'm going to be freaking out all weekend. i can go through all this over again!

For Canada its based on the consulate getting the information they need (for K1's its the packet 3) not on the medical date. Once the consulate gets the checklist and DS-230 back, they put you in queue, right now about 2-3 months to get an interview at montreal, I think 2 months for vancouver.
the ds-230 was the online form, right?
god i hope our long delay doesn't mean they've thrown our case out or anything!
thanks for the reply!

hi again. it's me. :|
there was an, admittedly, long time between getting our noa2 and scheduling the medical for my fiancee. i hope this does not cause any delays or problems in getting our interview date?
about how long after the medical will it usually take to get the interview date?
thank you!

I had my medical in Toronto back in March. The staff and doctors there are all very friendly, so don't be too nervous! I know I was freaking out. Its all fairly routine, you get a chest x-ray, a breif medical exam where they check your blood pressure and do basic biometrics among a couple other things, then they take some blood to test for HIV. The day I went in Dr. Seiden treated me and he was training a young girl on her first day, so I learned a few things. He told me there is three basic reasons for denial on medical grounds: testing positive for HIV/AIDS, admitting drug use, and having 1 DUI in the last 3 years or two in a lifetime (apparently this means you're an alcoholic). They ask you some questions right before the exam to find these things out.
You should be just fine! good luck!
fantastic! it sounds pretty basic and we are thankful for that!
thank you for your helpful answer!

i'm traveling to toronto with my fiancee to get his medical.
can someone tell me what this will involve and what one might be barred from coming into the country for?
cancer? thyroid problems? or just communicable diseases?
thank you in advance, folks!

If you annoyed me, I would answer once and never come back to the thread. You are mistaking someone insuring you understand the correct answer for someone annoyed. But there is only one way we can give the correct answer. Also, we were probably posting at the same time and our posts crossed, it happens. I read down the thread and answer as I come to them. A flaw in my upbringing, to be sure.
well truly i do appreciate the time and patience you've taken in answering my question.
i'm just so scared of getting something wrong. all this silly bureaucracy is making me nuts.
thanks again.

"No" above means you check "not intend" and write "N/A K-1 visa" below it.
This item on I-134 filed in K-1 support has no meaning whatsoever.
Remember that this form is used for many different purposes, for support in various visa application situations.
i understand where to put this information down.
what i do not understand is why my father wouldn't check "intend" and write how he would support my fiancee if this is the affidavit of support form!
i feel like i'm going crazy here. what am i missing that you all see so clearly? i have a co-sponsor because he can help support my fiancee so he does not become a public charge!
i know that *I* would check "do not intend", but why would my father, the co-sponsor?!
Because it is a K-1 visa and this does not apply. You can ask the question again, And again. Our answer will be the same because we are giving the correct answer. We cannot change the correct answer to an incorrect answer based on the wording of the question.
I have given you the advice of exactly what is on my THREE I-134s presented for THREE K visas (K-1 and 2 K-2s). Leave the "box" blank and write "NA K-1 visa for permanent residency" on BOTH your and your fathers I-134. Do not list any assets, insurance or bank information unless you are using it for qualification, leave it blank. BLANK. Not -0-, not "NA", just BLANK.
That is the correct answer. It worked for me for THREE visas and the advice was given to me a year ago by Pushbrk who has given you the same advice here.
Next question...please
well i DID say thank you in response to your last post.
if the paperwork says one thing and i'm getting other answers i'm going to ask questions. it helps me better understand things when i know the reasons behind the things that need to be done. thanks again.
sorry to annoy you.
If very consistent multiple answers from many members here are not satisfying enough for you, why you don't get an immigration lawyer? I am sure you will get a very straight answer then...
if things don't add up between what the paperwork says and what someone tells me to do- then i'm going to ask a lot of questions and worry because this is the most important thing i've ever done in my entire goddamn life. i just want it straight.
you dont have to read this and you dont have to answer it. thank you. end of.

As pusbrk already said: the answer to question 11 is "No" and "N/A K1 visa" for both the petitioner and co-sponsor.
i feel like we're looking at different paperwork here.
mine says:
11. I (intend) (do not intend to make specific contributions to the support of the person(s) named in item 3.)
if you check "intend", indicate the exact nature and duration of the contributions. For example, if you intend to furnish room and board, state for how long and, if money, state the amount in U.S. dollars and whether it is to be given in a lump sum, weekly or monthly, and for how long.
well my father WILL furnish him with free room and board because my fiancee will be living with me and my father pays for the apartment.
so i'm totally confused now why it'd be "no" and "n/a k1 visa"
The I-134 is used for many visas. This particular question does not apply to K-1 visas regardless of who is providing his room and board. This question applies to immigrant work visas, etc.,where often the worker has a contract including this, for example. It does NOT apply to marriage based visas.
The correct answer is "no" or do not check either box and the explanation is "NA K-1 visa for permanent residency" That is all. You have your correct answer.
thank you.

no. i'm still confused
MY #7 says: N/A (full time student)
#11: i checked "intend" and was going to say that my father would be furnishing free room and board in my apt that he pays for until such time as my fiancee procures a job and can pay for some of the rent himself. and *i* would give him $100 a week until he got a job
O_O long winded, huh?
i guess ill leave the "intend" to my dad.
:| just trying to help out...
so nothing but a bunch of 0s for #7 then, huh? alright *wrings hands*
change of plans :(
