    Hi All,

Does anyone know if its possible to add the beneficiary's email address to NVC file so the fiance also gets email notifications. Once NVC sends the case to the embassy does anyone know who gets notified from the embassy is it the petitioner, beneficiary or both and how do they notify that person by email or mail? The reason why I am asking is because I only recall them asking for the petitioners email address on Form I-129F and am curious to know how the beenficiary gets notified by the embassy when they receive the  case from NVC.

    Thanks

In the same boat. Would like to know how the beneficiary gets the email notifications for like visa interviews once NVC sends the case to the beneficiary's embassy?

Thanks , I made chat with askEmma , they told me that USCIS sent my petition on Nov/29

but I don't know when NVC received my case from USCIS

I think that 11/29 date is when NVC received your case from USCIS since it was 3 weeks after your NOA2 on 11/8.

My NOA was Nov 22 and I found out NVC received my case on December 14 which was basically 3 weeks too.

I'm thinking I'll get my NVC case number by Feb 6 then going off your numbers. I'll probably send an enquiry a few days before.

He got it around the same time that I got the I-797C (which was about a week after approval). It's possible they forgot to send it or maybe it got lost in the mail. Ask your lawyer if you need the official notice. I think he can request another one from USCIS since he didn't receive it!

@Optimist19 Wow. It has been 18 days since I got the approval and my lawyer hasn't gotten it yet. Kind of making me panic now. I know we need that form for AOS and if anything goes funky with the NVC process we need to show them the I-797 form right?

Did you happen to file with an immigration attorney? We filed with a lawyer, and the lawyer got the official notice (I-797) and I received the copy (I-797C). They basically have the same information.

Hi @Optimist19 thanks for replying back. I do have an immigration attorney. I contacted him yesterday and he said he hasn't gotten it yet. How long did it take for your lawyer to get the official notice (I-797) after NOA2?

  5. Hello everyone,

    NOA1: 9/17/2021

    NOA2: 11/22/2022

I received the I-797C form a few days after NOA2 stating that our case has been approved by USCIS, that it is being sent to the NVC and that this I-797C form is not the true receipt notice.

On my NOA2 approval online, it says I should receive the true approval notice(I-797 form) by Dec 7 but I still have not gotten it yet. I have only received the I-797C.

Does anyone know how long it takes to get the true approval notice of NOA2 (I-797 form)?

You apply for marriage license online in Utah county, Utah.  You get an appointment to have a Utah county officiant perform your wedding over zoom.  Provided you and your wife are physically next to each other when you both say “I do” or at least before you file I-130, USCIS and the rest of the USA will recognize your marriage.

You get a digital marriage certificate in email right after the ceremony. You get a paper certificate in the mail.

And since is a a bonafide Utah state marriage most of the world recognizes it just like a normal bricks and mortar Utah marriage.

People reacted similarly to pretty much every technological innovation in the past.

Interesting. I didn't know that Utah can do that. Thanks for suggesting this option. I will discuss these options with my gf and decide on what would be the best for us. Much appreciated!

The Utah Zoom Marriage makes marriage laws in foreign countries irrelevant.  You can get married in Brazil and not involve the Brazilian authorities.

In the future I think most people (Americans or not) in the world, whether they are immigrating or visiting the USA or not  will be doing the Utah zoom marriage.  Utah will be able to repeal its income, sales, and property taxes.

Hi Mike. Sorry I don't really understand this Utah zoom marriage? It sounds like what it is by the name... you host a wedding through zoom? To be honest.. I'd like to avoid that unless if you can elaborate more.

It will be 10 months or so from arrival before she can return to the US if she leaves, or work.   AOS/green card is taking well over a year for most.

You should start researching the AOS process ASAP.

Understood. I've done some research. I forgot to mention I'm working with a lawyer/attorney for this. He's told me that along with the service/signed contract he will help us with her status change/green card. The lawyer mentioned it would be best if we get "engaged" to further provide more evidence to our visa submission. That is probably true and I understand his concern but I'm just wondering if submitting evidence of being "engaged" crucial or needed. We will provide other evidence of being free to and willing to marry each other within 90 days.  Like the signed statement from both parties, her family and mine, our relationship rings(Brazilian culture) etc.

"Engaged" is not a legal status.

You both have to show evidence of being free to and willing to marry each other within 90 days.  Usually this is accomplished via a signed statement from both.

Btw, if Covid has taught us anything in the world of US immigration, it is that spousal visas are far superior than fiance visas.  Which makes sense, in light of 'fiance' not being a legal relationship like 'spouse.'

Not needed.  USCIS does not care.

Hi @Jorgedig appreciate the comment! So my future wife and I actually looked at the spousal visa but we didn't want to be "married" and then be in long distance marriage. Long distance and wanting to be married is hard enough. XD

Lets check the Instructions.   Instructions say to have met at least once face to face within previous two years.  Says nothing about engaged.

@payxibka thanks for the reply! How confident are you in this? I've heard from people that said you need to be "engaged". But what is the definition in being engaged? I found out that you don't to show proof of a ring. https://www.avvo.com/legal-answers/do-you-have-to-be-engaged-to-be-eligible-for-a-k1--2413346.html (I'm planning to get the ring in a few months). My only concern is that do they ask for pictures etc. of engagement? Or providing documentation stating we will get married, documentation on when I asked her parents for her hand will be enough?

  11. So long story short. My girlfriend and I want to get married. I am a USA citizen and she is from Brazil. We heard that because of COVID the process to get a visa takes a lot longer than usual. Due to this, my gf and I want to start and submit our K1 visa as soon as we can. Our question is... do we have to be "engaged" to file the K1 visa? The reason why we ask this is because my gf and I want to get engaged/propose in person so I have booked my flights to Brazil at the end of the year.

The question is.... am I still able to file/submit the K1 visa now(in like 2 weeks) without us being "engaged/proposed"?

More information for you guys to know:

    • I've asked her father/parents for her hand. Her and my family know we are planning to get married next year. My future wife and I have decided on where we are going to live and what months we want to get married(this part still depends on when we can get the visa)
    • We've been dating for over a  year and a half. I've been to Brazil three times in the last year and a half and am making a fourth trip at the end of this year(want to propose at that time).
    • I can provide my travel itineraries and bank statements of all my transactions that have happened in Brazil
    • We have hundreds of pictures together and have almost 1 GB worth of photos/messaged saved/backed up

Again...we want to know if it is possible to file/submit the K1visa(in like 2 weeks) without us being "engaged/proposed"? We want that special (engagement/proposal) moment to happen in person and that is why we want to wait on getting "engaged" until we see each other again in person. If that doesn't work..... we might have to get engaged online.

Any knowledge/facts would be appreciated! Thank you!
