    OMG. My buddy tells me he knows an immigration attorney who knows and really likes his wife and the child. 
    She has the case now.
    She said the double check happens a lot.
    She is across the country - maybe that is why he did not go to her first.
    Or maybe it was financial.
    If he were not such a good friend..........

    They can move together because because the child has a tourist visa.
    Once mom has her immigrant visa (soon) then they can come home.
    The only question is what is the best way to normalize the child's status once her paperwork is resolved.

    The shortest processing time I saw was 3.5 months at California.  Mom will be in the USA by then.
     
    The original I-130 was very fast. Less than two weeks.

    So my buddy's congressman  talked to his contact at USCIS. The processing time for an I-824 is 20 months. That is a long time for an 8 year old. As soon as my buddy gets the receipt, he'll get the number to the congressman who will get it to his contact. The contact will try to expedite it to NVC. The child's mother is DQ'd and her case should arrive at Dublin any day now.  So she will have her immigrant visa soon. If expediting the I-824 fails, then mom has to enter the USA with the girl.   Under these circumstances, is AOS the appropriate way to go for the girl?
     
    My buddy also wants to know if can just do another I-130. He does not mind paying the fee. Any thoughts? TIA

    I am not sure you are actually helping your friend, much better if your friend joins.
     
    You said well implied that the child had attended school in the US, how? Did the child have a Student Visa.
     
    There are some things you have mentioned, intimated, that might cause problems but without the full story I am loathe to say anything else.
     
    The Mother can certainly delay things until the daughters case catches up.
     
    I think as a general comment it is better to file a new I 130 that wait for the I 824.

    That was when I first posted., My buddy submitted a letter notify NVC that the child was in process. But the official query system takes weeks and it still has not arrived at NVC. In the meantime, mom was DQ'd and sent to Dublin. I imagine that mom will have immigration visa in hand before the "official" request to match the cases up makes it to NVC. In the meantime, while the original I-130 only took two weeks to be approved, it apparently takes months to correct a simple error in the form.

    As an aside.  This is another caution to those who insist everybody should do this themselves.  Only those with the aptitude and motivation to carefully study forms and instructions, are able to do this on their own.  That's lots of folks, but not everybody.

    Digging through the files, there is a 2018 Ukrainian court order that states the child's residence shall be determined by the mother.

    If your friend is a USC then yes he needs to file for the child ASAP. 
    AOS is not and option is this case. 
    Once your friend gets the receipt number for the child he can call and ask them to match the child's case to the mothers. This is not seen quite the same as an expedite so they do sometimes grant this. Hold on to mom's case at NVC to do progress until the child's reaches NVC. This way they can interview and move together.

    I'm clueless. I thought it was a separate card. My image is suggestive that you are correct but inconclusive. However Jenny has internet on the bus from Lviv and reports that YES, it is glued into her passport. Mike - you are another Visa Journey hero.

    Jenny is still in transit. When she gets to her mom, she will send a picture of her passport stamps. I suspect she has neither her visa along her green card with her.
    Based on Mike E's comments, she will have the picture of her green card and me waiting at the airport with the green card. PDX MAY be relaxed about these things. It is recovering from a terrible reputation, years ago for international travelers, lost its CBP presence and worked hard to to get it back.  When I returned to the area, I was pleasantly surprised by the number of international connections.
     
    Some have commented that shipping to a war zone is risky. I agree. My thought was to ship to a hotel at the airport in Warsaw - not a war zone. But I will go with Mike E's suggestion: relax and pay the fee if it is assessed. Not a huge deal. 
     
    To Sam Burns - yes, you are reading to much into this. I adore my young wife.

    Thanks for the comments. I think I will UPS it to her at a hotel near the airport. About $225.
    I recommended that she staple it into her passport (like I did my COVID docs) - she declined. Is that a good or bad idea?

    The embassy issued her immigration visa on a card separate from her passport?
     
    I have never heard of such a thing.
