  1. Hello one (and soon to be all 😜), 

     

    I filed AOS for both parents from B1/B2 Visas: (Submitted I-485, I-864W, I-131, I-693)

     

     12 July: Mailed both AOS packets via FedEx 

     15 July: Delivered later than I paid for but, packets arrived to and signed for at Chicago

     19 July: Received four text notifications “USCIS: Your case was received.” 

     20 July: Both Money Orders cashed

     22 July: Received four I-797c IOE Receipt Notices in the mail (two I-485s / two I-131s for both parents). Processing Center is National Benefits Center (at least according to the envelope). 

     Priority Date: 10 June 2021. It took me a whole month to find the motivation to compile and assemble both packets after submitting my I-130 Petitions online. I’m a Millenial. I prefer to submit these packets ONLINE. 😂 But, I am forever grateful to the existence of this VJ site and the panel of experts, who took the time to answer my questions whenever I started overthinking the verbiage on these forms. Shoutout to @Chancy and @arken for inadvertently always coming through when I needed it, and who evidently takes the time to help a lot of us hapless folks on here, along with the other experts and experienced folks.You’re the real MVP! 

     

    …and now we wait. 🤞🏼

    About Me:

    • Immediate Relative of a USC
    • Spouse filed I-130 online on June 23, 2021. Receipt was immediate with a PD of June 23, 2021. Received the official I-797 in the mail June 30, 2021
    • AOS from B-2

    Congrats! Our timelines look similar in all aspects. Nice! 
     

    So uhhh, I just realized that this is the K1/married peeps forum, so ummm, my bad?!?! 😂😂 This is what happens when I also couldn’t find a July post for the Tourist/Work folks and only stumbled across this one without seeing the rest of the main page. Oh well!

    Maybe they can download their statements or benefits information and just print them out for the I-864W.  No need for you to submit I-864 for them when they are eligible for exemption.

    Thank you SOOOOOOOO MUCH! I didn't realize they could create SSA accounts online. I just tried it (created my own account) and saw that it has exactly what I need to submit with the I-864W, instead of the mailed-in form to request statements that I stumbled upon a few weeks ago. I was definitely dreading sending in these I-864s but you saved the day...again!

    Online account number is not assigned to you and you will get one if you file your application online .

    As the petitioner, I filed two I-130 forms online for both of my parents. However, the profile page have the USCIS online number associated with my name. Am I able to use the same USCIS online account number for both of my parents I-485 and other forms where it asks for "USCIS Online Account Number," since the USCIS account is set up under my name from when I filed their I-130s online and I plan on adding "paper-filed" forms to track under this same account, which would be mine? Or...is the USCIS Online Account Number specific to the individual, and thus, leave that field blank on the I-485 et al, and manually add the paper files upon receipt under my account? 

     

    The I-485s I'm preparing for them currently have the USCIS online account number associated with my account. It just made sense to me at the time, since...why would a USC have a random USCIS online account number? However, now I'm thinking it is incorrect and need clarification please. (Sorry for hijacking this thread or resurfacing such an old topic.)

  7. Hello all, 

     

    I've researched this topic across the forums and still don't have the warm and fuzzy about what to do. Most of what I came across in regards to the I-864W exemption pertains to the under-18 year old crowd. I am almost positive that both of my parents (or maybe just one? *shrugs*) qualifies to submit for an I-864W exemption. Filing the exemption will mostly help *ME* as the petitioner out, as I am a broke college student and just trying to avoid filing an I-864, just in case it brings any unnecessary attention to their AOS applications in regards to financial support, when everyone makes more money than me. :D

     

    Background:

    1. Both parents can be credited with 40 eligible quarters under the Social Security Act (SSA). 

    2. Both parents are currently eligible for SSA benefits. However, only one parent is currently receiving SSA, while the other parent opted to wait until full retirement age. Parent receiving SSA is also retired and receives retirement pay. 

    3. We do not have their SSA statements as that gets mailed to their mailing address outside the U.S., which no one can access at the moment. 

     

    Questions:

    1. Will they still be able to file separate I-864Ws in lieu of me submitting an I-864 with their separate AOS packets, without the SSA statements? (Yes. I do understand I have to attach the SSA statements with the I-864W, but time is not something I have in my corner right now, and SSA response time is four to six weeks, according to the SSA Statement form. Or...can that be submitted later...gamble that they send me an RFE perhaps? Gives me time to request them?!?) 

    2. Is the parent currently not collecting SSA benefits eligible to submit I-864W?

    3. If I do need to submit an I-864 for one or both parents, in lieu of a joint sponsor, can the parent that IS retired and receiving SSA, file an I-864A to supplement my income? If not, can my sibling,  (also same household and also makes more than me), file an I-864A to supplement my income? 

    4. Am I just better off just submitting an I-864 for both parents and have my sibling supplement my income with an I-864A instead of gambling with the I-864Ws for each parent? 

     

    Hopefully this makes sense to someone out there. I'd really appreciate any and all feedback/response to this request. Thank you in advance.

    Thank you for the reply. I couldn’t figure out another work-around that problem so I attached a clarifying memorandum to my petitions, just in case it creates an inadvertent problem. I did contact USCIS technical support as well prior to filing and she had no idea how to fix it either. The memo seemed like a logical solution and hopefully, goes through. 
     

    Quick question. I did receive a Receipt Notice immediately after. However, nothing on the receipt notice says I-797. Is this the same receipt that my beneficiary can enclose with their I-485 or do I have to wait for the official I-797? Thanks in advance.

Because we are working on a short time frame with a last minute decision to file for GC's instead of visa extensions due to border closures, and I am currently out of the country and won't make it to where my parents are until next month, which is right before their B2 visa's expire and should be flying back, but unfortunately, flights are still grounded. So, figured this was the easiest thing to do-- I file the petition online and they can mail off the I-485 and everything else once I get the receipt, which from reading the forums et al, doesn't seem like it takes that long to get.

     

    Just finished spending a frustrating few minutes asking Emma about system technical difficulties and no matter how i worded the problem, she assumed I was referring to her being a technical difficulty and apologized way too much for something that is not her fault. LOL. 

     

    I was hoping others were seeing the same problem and it wasn't just me. Otherwise, would have to write a bunch of "additional information" explanations for the technical difficulties that I can't get rid of. 

  10. Hello again all, 

     

    So, I have not been able to submit my I-130 forms online and after searching the forums (and Google), doesn't seem like anyone else have stumbled across this problem I've been having. While reviewing the snapshot pdf of the online I-130s , I noticed some of the country fields show up as "unknown" on the pdf, but is shown as a blank field in the online form and the "review" section also just shows a "-" (dash), shown as empty as well. I wouldn't be worrying too much about the auto-filled "unknown" entries were they applicable to that particular question, however, an "unknown" entry in, for instance, "Place of Current Marriage" (when I'm not married) would just open up a can of unnecessary problems with USCIS when I submit these I-130s. 

     

    Does anyone have a solution/suggestions to fix this please? This issue only shows up on the pdfs and only for the "Country" fields. 

     

    As always, would definitely appreciate any help/feedback to my problems. Thank you in advance.

    No.  If your father is listed as Retired in item 51a, leave blank all other fields for Items 51 & 52, or write N/A.

     

     

    Even if it's not nearby, there should be a USCIS field office that has jurisdiction over the beneficiary's residential area.  Take the US zip code listed under "Beneficiary's Physical Address" and enter it in the search field at the bottom of this page -- https://www.uscis.gov/about-us/find-a-uscis-office/field-offices

     

    Wherever their field office is, note that your parents' forms should still be sent to the USCIS Chicago lockbox.

    Yes. As long as you and your children are command sponsored and are listed on your spouse's orders, those days count as physical presence in the U.S. as the overseas duty assignment is considered U.S. Just make sure to add your spouse's military orders to your N600k packet, that lists you and your children as dependents and command sponsored for overseas assignment.

    I am petitioning for both parents, who are both currently in the U.S. for their annual visits with the kids/grandkids on B2 visas. I have completed the I-130 forms online and am currently reviewing the snapshot of both forms for errors, but I have now successfully confused myself (most likely overthinking it) with the following on the I-130 forms, the longer I stare at them:

     

    pg. 3. Information About Your Parents section. 

           #27/33: Country of Birth: I filled in their Country of birth

           #28/34: City/Town/Village of Residence: *confused* Do I put in the city they left (where they still have a home) or do I put in the current city they are visiting/living in while in the U.S? 

           #29/35: Country of Residence: *confused*Do I put in the country they left and are expected to return to, or does it need to be the country they are in currently in (USA of course)? 

     

    pg 7. Beneficiary's Employment Information

           #51. My father is Retired so I put "Retired" in #51a as his "Current Employer" in lieu of "Unemployed." Is this okay?

           #51b-h: Since he technically does not work anymore, but still collects a pension from his old employer, *confusion* do I need to fill out subsections b-i with information from his previous employer? 

           #52. Date Employment Began: I entered his official retirement date. Is this okay?

     

    pg 8. Part 4. Information About Beneficiary

           #61. The beneficiary is in the U.S. and will apply for adjustment of status at USCIS office in: .Do I put the city where they are currently in or do I put the lockbox location where I am supposed to submit my I-130 with concurrent filing? Not entirely sure if there's a USCIS office in my area. 

     

    pg 8. Part 5. Other Information

          #6. If you are also submitting separate petitions for other relatives, provide the names of and YOUR relationship to each relative...

          #6a, b, c. Name: Self-Explanatory, since it's the other parent

          #7. Relationship: *thoroughly confused* Is it...Child? or Parent? (After selecting "Parent" and seeing "Parent" a few times on discussion boards and the I-130 where it was clearly understood, I have confused myself with this particular entry, if it's supposed to say "child" [me] or "parent" [them] to specify the relationship. 

     

    I apologize if these have been answered elsewhere, but most of the posts I came across are spouse-specific and does not give me the warm and fuzzy. 

     

    I appreciate any help provided. Thank you in advance.

    Thank you so much for the quick response! Seeing other posts regarding photo uploads set off the panic alarm and made me wonder why I haven’t seen this section. I can calm down again and send packet as is. Thanks again.

    Sorry to ask, but where in the evidence section of your online I-130 does it ask to upload photos? I have been trying to find this section on my online I-130 form as I know I'm supposed to submit them but the photograph section just refuses to show up anywhere in my online I-130 form. Thanks in advance. 

  16. I (Petitioner) am filing two I-130s online for each of my parents and will mail in I-485s for concurrent filing. From the checklists and browsing through the forums, I see I am required to submit two passport style photographs with each I-130 and I have seen posts referencing the passport photos some users have uploaded (mostly from spouse beneficiaries), however, I am not able to find this section in my online petition or perhaps my eyes just either refuse to see it or they blink profusely over this section every time and miss it. LOL. Additionally, I know I also need to submit both parents birth certificates with each of their I-130s, however, I am also unsure of the applicable section to upload their birth certificates. Should I drop them in the "Secondary Evidence" Section, perhaps under Religious Records (although these are government provided records?) Or are the birth certificates only applicable to the I-485 when mailed in with all supporting evidence? 

     

    In the "Evidence" section of my online I-130 forms, the required evidence to upload on my forms are: 

    1. Proof of U.S. Citizenship: uploaded my citizenship certificate

    2. Petitioner's Birth Certificate: uploaded mine

    3. Proof of legal name change: uploaded Parent's marriage certificate (not sure if this is correct; I am not married so still have the same name)

     

    and then "Next" screen asks for secondary evidence, which covers 1. Religious Records (uploaded beneficiaries birth certificate) 2. School Records 3. Census Records 4.Affidavits/Written Statements, and do not plan on uploading secondary evidence in to the other sections as I don't deem them necessary since I have the birth certificates. Am I correct to assume this? 

     

    After the evidence section, online form is reviewed and mine came back "Green" with no alerts (doesn't mean much), then I reviewed a snapshot of the online I-130, and again, it still hasn't asked to upload the passport style photographs to the online forms, and then on to where I sign the online form. Now, I have not gone past this page, as I don't want to sign (yet) when I have not found where I'm supposed to upload these passport photos and additional supporting evidence. I have looked through the forums but most of the questions and help provided pertain to spouse support for I-130s, not much for parents. Please help! What am I missing here?
