  1. Hi. We live in Maryland too! Unfortunately there was no way around it. My husband just waited until he got his work permit(ead) and then got his license. My husband got here June 2021 and his ead in May 2022. Ppl  He got his license in Sept 2022 and the expiration is his birthday 2031.

You can submit your passport to get a itin to have a non federally compliant maryland driver’s license but it wasnt worth it for us cause then he’d be without any ID and we need it for bars, lounges etc

According to your timeline you had a pretty fast processing time from start to finish, especially during the height of covid. I think most of us still in the process would consider 315 days start to finish almost an expedited process. Congratulations!

    Processing
    Estimates/Stats :
Your I-129f was approved in 238 days from your NOA1 date.

Your interview took 315 days from your I-129F NOA1 date.

I had to pay $2000 to join the Milligan round 3 plaintiffs to get it finished quickly. I was lucky to have NOA2 right before they announced round 3. My husband had 2 friends who started k1 process in Guangzhou in May 2019 and one in Dec 2019 and he got his visa before all of them only because of the lawsuit.

Thank you everyone for your input. I'm happy to hear they will contact me about further steps rather than physical email to my fiancé.

I spoke to a USCIS representative today and we're trying to escalate the case due to "humanitarian issues". I explained how China (a communist country) does arbitrary lockdowns/covid punishments and frankly how I'm worried about potential war over this whole US-Taiwan-China controversy.  I just want to get her out of China as quickly as possible.

That wont work. I applied for my now husband’s k1 visa in may 2020. My husband was living in Guangzhou,China as a student for over 5 years. My husband is african and experienced racism and mandatory quarantines, denied to enter restaurants to buy food simply for being black and this was broadcasted all over international news. African students were being kicked out of their apartments because Chinese people accused them of being the cause of covid. I had evidence of them forcing students into hotels for quarantine with the police outside the hotels and they were only giving them 1 gallon of water to share for the day. The ambassadors from many african countries had to intervene. I sent all of this to USCIS and they said it was not a cause to expedite. I just had to wait and pray he was safe.

  4. Hello. We are in the same situation as you. My husband came on k1 visa in june. We married august and submit all documents in september. We didnt hear anything from anyone after biometrics in november. Ive tried to update with emma twice and she was useless saying its still pending. I tried to go through senator then they started asking questions if I fit the requirements for expediting so I just let it go and stopped checking the tracker app everyday to only check every 3 days. When I checked again last week, it said card was produced. He received his combo card on Saturday. It was very unexpected. Its weird how they are doing things. A friend in another state(ohio) applied after us in october and got greencard in april where as another friend in neighboring state applied before all of us in august has nothing yet. 🤦🏾‍♀️

    EAD question:

I see online that "Card was delivered" was updated on my parent's account but the envelope only contained I797 with no card inside it. It has been two weeks since I got that letter but still no trace of ead card itself. Did anyone face this type of situation?

I receive i797 and ead card on the same day. The tracking number uscis gave was tracking the actual card. My mail

man delivered i797 and forgot to give the card. He came back after 1 hour and told me he forgot it. He scanned it and then gave it me. Now the website said delivered

My fiancé had so much stress with Turkish airline. Due to bad weather, his first flight from USA got delayed and he just missed the leg flight in Turkey (Turkish airline gate closed less than 10 min before he arrived, and they said they couldn’t reopen, although the plane was still parked). Lady that works there said it’s not their fault and that he needs a new ticket, so he purchased new from Turkish airline. She  made a mistake and booked him a flight that was already full. After almost a full day, when he tried to checkin they apologized and said plane is full and that he needs a new ticket. He lost it then, started yelling and finally got to talk to a manager. Manager apologized for inconvenience, arranged to book him a new flight for free and refund previously purchased ticket. He got refund after 1 year and 100 dollar discount if he flies with them again, within 1 year.. 😓. Do not give up, you just need to get hold of right person, they did you wrong and because of that you lost precious time with loved one, so demand your refund, compensation and apology.

😳 I cant believe they did that to him. Did he call to talk to a manager? Im def the more aggressive one in the relationship. I was screaming when he called me to get the manager and they brought one but he kept saying no. He needs to change his flight to quarantine for 2 weeks. And pay for a transit visa in turkey despite only spending 3 hours there🤦🏾‍♀️
I couldnt even get in contact with Turkish Airlines customer service in America, the line was busy. I had to make an international call using a different country customer service. Just useless. I was able to rebook him with China Southern and he is on the plane now! His friends have now changed their flights away from Turkish. Thank you for your advice. I want to email them back and tell them you said he couldnt fly to US but hes on his way to LAX now! Where is my money!?

  8. They were crazy! It was Turkish Airlines. Their customer service was useless. I already disputed with my bank because they were insistent that its his fault he missed his flight. I dont know why they are being so stubborn.

Argue that one.  He was wrongfully denied boarding due to the airlines negligence.  The airline failed to uphold their contract of service.  They owe him compensation for the trouble they caused him by their mistake.  I can imagine arguing that in China may be more difficult but an airline ticket is a contract even in China, and they failed to uphold their end of the deal.  Demand compensation from them.  What airline is it?

Is the NIE wording on the visa?

    National_Interest_Exception_Waiver-1024x

If so, the airport/airline should read the info on Timatic which clearly says "passengers with documents issued by the U.S. Department of Homeland Security, U.S. Customs and Border Protection, or U.S. Department of State indicating that the passenger is exempt from the restriction;" https://www.iatatravelcentre.com/world.php

They havent been printing the NIE statement on the K1 visa because the proclamation for blanket NIE for K1 was issued in April 8. K1 is exempt from quarantine rules

  10. Hi everyone. My fiance is living in China but has a Sierra Leone passport. He received his K1 visa last week and was scheduled to travel today to me in Washington, DC(transit through Turkey for 4 hours). When he arrived to the airport, they denied him boarding the plane because he needs to quarantine in Turkey for 14 days prior to entering the United States. My fiance showed the publications on Department of State website but they still insisted that he has to get a visa for Turkey to quarantine and he cannot come straight here.

I rebooked him on another flight which will leave tomorrow with a different airline altogether. What further information can I provide at the airport to prevent this issue from re-occuring?

    Thanks in advance

The website never resolved for me, but we received an email about picking up her passport, so it's no longer a problem for us personally.  Still not clear what is up with the website.  Before we received the email, I called the helpline on the usvisa website and they wouldn't confirm anything (they are a separate group from CEAC).

Congrats! Thank you for your update! I read online that it switches from immigrant visa to nonimmigrant visa right before issue. I was able to track it through that so I expect to hear from them too! Thanks again and congrats once again!

    Hi,

Here is the latest K1 Visa Processing Update I have read on the DoS website,

    https://travel.state.gov/content/travel/en/News/visas-news/k-visa-processing-update.html

Could anyone help let me know what it means by "the applicant is eligible for a National Interests Exception."? What is the National Interests Exception? What will fall into the scope of National Interests Exception? Or how the applicant could be qualified as a National Interests Exception?

What could we do or is there any suggestion for the k1 applicants who are currently not in the plaintiffs in Milligan v. Pompeo and who are physically present in a country covered by COVID-related geographic proclamations? Join the plaintiffs? (understand the 3rd round deadline to join was Feb. 15th, 2021, don't know what will be the best premises to join, we have got our NOA2 last month and waiting for the welcome letter case # and such from NVC right now?) Or just wait (We haven't seen each other for more than 13 months now)  ... or anything else we could do about it or expediate our case?  Don't understand why mainland China is still banned ... we only have around 10 confirmed cases every day in the mainland China and majority of these 10 cases are imported ones ... I haven't seen any local report on variants either. Appreciate any suggestions or sharings from your end. Thank you.

Hi. I am in the same situation as you. My fiance lives in China. His friends are also in the same situation. They received their NOA2 before covid started but Guangzhou consul is not scheduling interviews. I received Noa2 in Jan. I still dont have a case number but I joined Milligan v Pompeo round 3 because that is the only way I can get him here. The lawyers said you do not need a case number from NVC. Maybe you can try to apply still. It took me about 10-15 mins to submit everything honestly. Im glad I took this decision.

  13. My fiance is a student in china. If he leaves china, he cant re-enter. I cant enter china. So we cant meet anywhere and I havent seen him since Dec 2019. We originally planned for CR1 Jan 2021 before covid. Then covid came, we just submitted k1. I hate it but we have no options. We are NVC now and with milligan v pompeo so thats more hopeful than guessing when I can see him again. Im 26, my ovaries are screaming for him! Lol

  14. I received my NOA2 in Jan and my fiance lives in China. Ive been waiting for them to announce new applicants. I was so happy to email the Siskind and to get an email hours later Round 3 was open. I sent everything without hesitation. With the progress Ive seen from the other plaintiffs, Im sure he’ll be here soon!
Im desperate and will try anything. I just turned 26. My dad died from covid. Im still in nursing school. I have to manage his businesses he left behind. I would do anything to bring him here sooner so I wont be alone.
