    Nice, congrats! I had a very similar family emergency (grandfather passed away) but my expedite request was unfortunately denied.

    It really sux (I could say more, but wont) that they make you jump so many hoops - even when it's so obvious that the situation is an emergency.

    Thank you for your kind words. And I checked my original post about the expedite experience I don't know why I typed "wedding" when I meant "funeral" (and VJ doesn't let me edit anymore), I guess it's because on marriage based AOS threads we talk about our SO and weddings all the time lol. So anyways if anyone read that and was wondering, here's the clarification.

     

    Honestly I'm not sure which part of my effort worked, calling relentlessly for weeks, or contacting the congressman. I'm also fully aware that just because I got my biometrics appointment doesn't mean there's guarantee the USCIS will expedite my case. At this point I'm just glad it's moving forward.

    Does this mean, on the Processing Times page, when you select I-485 then field office, that 24-36 or however many months only starts counting once your case is transferred from NBC to the field office?

    So the total processing time from submission to GC approval = NBC processing time + Field Office processing time?

     

    Edit: I found answer to my own question, on uscis website it says:

    "This time range is how long it is taking USCIS to process your case from the date we received it. We generally process cases in the order we receive them, and we will update this page each month. The estimated time range displayed is based on data captured approximately two months prior to updating the page."

    I'm waiting for my bio appt and USCIS just telling me to wait 90 days from ASC opening before I call again.  🤭

    • Uscis processing time says it should take 28 to 37 month to process EAD. What is this timelines?? If I recall it was like 5 to 7 months about a month ago.

     

    You can check which service center is processing your case by looking at your receipt notice.

    Also if your receipt number starts with "MSC" then it's at National Benefit Center (NBC).

    Congratulations! I saw your timeline says you expedited your combo card, do you mind sharing the experience? I tried to expedite too but they said my situation is not emergent enough or something and denied it.

    I am in NorCal Sac and filed June 18. I did get an RFE so that may delay the letter but I am also pretty sure that the Biometrics letter is sent by the local ASC. Sacramento is usually a busy area when it comes to immigration so it may take a bit for me to get one. Also, SoCal is pretty busy when it comes to immigration too. 

    Actually my friend who already got biometrics appointment letter says the letter was mailed from NBC (MO), so I'm not sure exactly how they do it but apparently NBC coordinate all marriage based AOS appointment date?

    Honestly all we can do is to speculate at this point. My (very optimistic) speculations are:

    • They want to focus their resource on GC process so they want to issue us GC before EAD or AP
    • They put these ridiculous time frame during times of uncertainty so you technically won't be outside of processing times and can't be eligible for a case inquiry
    • It's a typo

    Yep, I came here to post the same. From what I understand, most of us on this threat (AOS within the US, applying for EAD based on a pending I-485) are processed at National Benefit Center. What kind of craziness is this? 28.5 - 37 months?? That's 3 years. What kind of furlough can cause 3 years backlog? I don't know what to think of this piece of information... I'm hoping it's a typo but unlikely...

     

  11. Just wanna share the experience of my attempt to expedite my EAD and AP:

     

    My grandpa passed away, I wanted to go back to my home country for his wedding, so I called the Tier 1 agent and explained my situation. On top of that my partner is injured and it hinders his ability to work, so I prepared my grandpa's death certificate, documents that prove my relationship to him, my husband's doctor letter and medical bill. I wanted to be as prepared as I could so they won't have any reason to deny my request.

     

    I saw it on this forum that someone else experienced a similar situation and they were given a fax number so they could digitally send in the evidence and got their combo card approved in a week. I didn't get any fax number so I called back asking to be connected with a Tier 2 agent. They called me back, he said I needed to be more patient and just wait for the email response.

     

    So I did, a few hours after I talked to the Tier 2 agent, my request was denied. on "check case status" page it says I "didn't provide enough evidence to make an extreme emergent case", and in the email reply they said they didn't have my biometrics info on file so they couldn't process my expedite request.

     

    Here's the thing, I got all the documents prepared, they never asked me to present the evidence. And the whole "we don't have your biometrics so there's nothing we can do" response sounded pretty lame to me -- if you really wanna help me, schedule me one.

     

    So now it looks like I'm gonna have to choose between staying in the US with my husband, and being home for my family when they need me the most.

    Is this all the tests that you guys did? Don't we need Hep A&B, Meningococcal tests etc?

     

    How much did/does it cost you?

    I had to get all of the vaccines coz I lost all my vaccine records. It costed me about $500 for the check up, vaccine and lab work. SC.

    Did you try to expedite your EAD? Do you need anything other than a job offer?

    They sent a generic RFIE for joint sponsor proof of income. I am not even sure which step they want because our lawyer sent everything that was needed for proof.


    We called our lawyer today and he will review the package that he sent to see what else need to be sent. I went through the package and everything look good so im not even sure where to go from here except wait for our lawyer to review it. It's frustrating when there is a delay in the process when it is already taking so long.. :(

    Joint sponsor's pay stub, w2, tax return/tax transcript, bank statement, employment letter from their employer...Not saying you need ALL of these, but when they say they want to see proof of income these are the things they meant.

    Not sure if this question belongs here but I'm gonna ask anyways...I tried to apply for jobs and one of the first questions they ask is if I'm legally allowed to work in the US. Technically we are not (yet), so I'm just wondering how you got around this hurdle and got the job offer?

    The problem with the fax number is that they tell you you must include your Referral ID and the email they send you. So I feel like if you send your documentation without those, it will be ignored. I would suggest calling back and requesting specifically that you need the AP to be expedited urgently and that you have evidence to prove why.. that you would like to send via fax. I hope you'll get a more helpful agent.

    I swear I had checked my packet more times than Santa Claus checks his naughty or nice list but still missed that. 

    I wouldn't be surprised if you actually mailed everything but they missed it. In my case I filed I-130 and AOS separately, I included *a copy* of the I-130 just as an FYI, I even included an APPROVED notice for my I-130, i thought I was being thorough and smart and I stressed over and over about what I'm filing, but as a result nobody at the lockbox read my cover letter and they rejected my whole packaged because they said the check amount was wrong 🙃 when I called them they said they must have assumed I was filing for another I-130 (now why on earth would I wanna do that when I already have one that's been approved?) Anyway I'm sorry to hear you need to refile something you believe it's already included.

We did everything on the phone and submitted the evidence through fax. (After the first phone call, they emailed me that they needed the evidence in order to make a decision. So that's where they provided me with the fax information.) And btw, all the documentation I had was digital, no originals because of the distance situation. That was enough for them. However, I do think that sometimes they do require the in-person meeting. Maybe it depends on the urgency of each situation?

    Thank you for your reply. This is really weird... I have a family member recently deceased and I want to go back to my home country to attend the funeral. A Tier 2 officer scheduled me an in-person meeting two weeks from now. I mean I understand each person's situation is different, but how is waiting for weeks a solution to an "emergent" AP? I was wondering if you can share their fax number so maybe I can try and send in my supporting documents too?

    Sure! I called to expedite it on a Monday and then I got a case status update on Friday saying the card was picked up by USPS.. the next day it was in my mailbox. So I guess that was 5 days total. (I couldn’t believe this was possible tbh). 

    Please forgive me if someone already asked this question, but did you have an in-person meeting with someone from the USCIS? Or did you just submit your evidence (letter from doctor etc.) digitally? Thank you!

    Yep, I keep getting the same answer, biometrics appointment within 90 days after the ASC opens will be considered normal timeframe, which is really ridiculous in my opinion...
