As with prior court orders, this one may also only last a few days before the Supreme Court steps in. But we'll see! It's a different procedural posture.

Public Charge Rule has been vacated by a Federal Court in Illinois a few moments ago!
According to Federal Judge Gary Feinerman of the US District Court for the Northern District of Illinois, the rule violates the Administrative Procedure Act (APA) and requires to be set aside. The government has 30 days to decide whether they want to appeal or not.
The Department of Homeland Security argued that the rule should only be vacated in Illinois, but the court said that under the APA when an agency violates the statute’s terms the rule “shall” be set aside. Vacating a rule “is simply what courts do when they determine that an agency action violates the APA,” it said.
The court also seeks a permanent injunction enjoining DHS from ever implementing or enforcing the rule, it said.

No I haven’t sent any I693 at the initial AOS. I am employment based. So they asked I693 and I944 at the RFE. I am not sure if they are planning for an interview waiver. Who really knows!

Not to get too Political in here but if Biden wins he's been saying he's going to get rid of or reverse Trumps public charge rule, does anyone know the movement of that? Like would it take months and months for Biden to actually get that reversed?

That is completely normal. The “Firgerprint fee was received” status, usually shows up about a month after priority date. The wait time for your biometrics appointment letter varies according to your location, since some ASC (Application Support Centers) are busier than others in these times after COVID (they are prioritizing people with canceled appointments during the pandemic). The status online does not change after the letter is mailed out or the appointment is scheduled.
What you can do is to ask about your biometrics appointment through Emma on uscis.gov. They can give you info before the bio letter arrives in the mail:
Ask to chat with a live representative, then pick
“Case status” and “Connect to a live agent”. When connected to a live agent, give them your A-number. Now you want to type : "I would like to know if my biometrics is scheduled and/or if there is a letter on its way regarding that”. And they will give you the available info.

Thank you. I called this morning and the representative told me that no appointment had been made and I should call back in a week if no appointment has been set as that will make ninety days since my ASC reopened. Apparently a request can be submitted after ninety days after branch reopened.

Fingers crossed! I feel like RFIE and biometrics are being organised fairly independently of each other. I've seen people on here getting one without the other in recent weeks. We'll see! I was California, but we just moved to Texas. I imagine that will have delayed things slightly for me. Hopefully some more movement for August filers soon!
I hope everyone is keeping well and staying sane! If anyone is interested, I just registered to volunteer with the Red Cross - they will do international background checks for people without US IDs. There's a thin line with volunteering, but as long as you can guarantee no compensation (monetary or otherwise) it's a good way to continue to live life and pass the time!

Looks like i'm getting the physical notices today (according to Informed Delivery anyway) so I'll be sending out the updated I-765 tomorrow morning. I'll wait until then so I can double check it multiple times tonight so it doesn't get rejected again, lol.

In my opinion, I think everyone should make use of this long stretch of time it will take between receiving the NOAs and receiving the I-944 RFE, and fill out the current version of the I-944 and just have it ready. It is not a difficult form and can be filled out quickly. You’ll have all of the time between completing it and receiving the RFE to correct any mistakes you may have made on the form as they come to your mind/as you read things on here, and if the version does not change between now and then, which it most likely will not, you’ll be ready to ship the requested documents out the same day/the day after you receive the RFE. And if the version DOES change, you can reference the old form I-944 you already filled out to make filling out the new version of the form much easier. At the very least, it’s extremely useful to familiarize yourself with the questions on the form. This is exactly what I have done. I am currently in the process of receiving supporting documents and nitpicking the answers on the form. I haven’t printed it yet, but the form itself is filled out. And plus, it’s a load off of my mind to not anticipate and procrastinate filling it out.

You're good. 12/26/19 edition sent before August 25.
I would say 90% chance that no, you will not need to resubmit. The thing stopping that from being a 100% chance is because you used FedEx, and not USPS. The rule USCIS states is
"If you send the 12/26/19 edition (which is the old edition):
We will not accept this edition if it is postmarked on or after Aug. 25, 2020." Only the USPS can give a piece of mail a postmark -- couriers like FedEx, UPS, DHL, etc. cannot.
USCIS stated policy with couriers for their fee changes is to go by the "receipt date" which is the date that the courier declares the package received (not the date it's ultimately delivered), which is usually the day you dropped it off or the day after. So your packet should be within the window, despite the package arriving on the 25th. If the employee who received your package was in a really bad mood they may reject, in which case you'll need to refile. But I think you said NOAs were coming in the mail for you, right? You'll know soon enough!

This form has not yet published and is available in preview mode only, so you have an opportunity to see what it looks like. We will not accept this edition if it is postmarked before Oct. 2, 2020. This edition will be the only acceptable edition for forms postmarked on or after Oct. 2, 2020. -
