Hello all, I come with bad news. My wife has found the green card more important than the marriage itself and I am now faced with getting a divorse. If anyone can help me with the following questions it would be greatly appreciated.
Please note my wife is now in the U.S and has not ived with me since her arrival.
1. I married my wife in her country (E. Europe) I am not sure how or where to file the divorse papers. Looking at the papers they state to file in the same county as the marriage however the marriage was never in the U.S
2. I have neve registered the marriage in the U.S what type of record do they have of the marriage?
3. My wife is stating that I am not her sponsor, however I was upon her coming to the U.S (she is here on a K-3) I was under the assumption that sponsorship was non-transferable?? (I have never signed any papers authorizing anything of the sort)
4. My wife is trying to also prove neglect on my part so that she can stay in the country. She has already filed and been granted a restraining order against me for a year??? Is it that easy to do? I have never done anything against her in any way and this again, is nothing more than an abvious attempt to dis-credit me as a person to show neglect so she can stay in the U.S
5. Any solid advice would be appreciated. I am not financially in the position to hire an immigration attorney so I thank you all for anything you can provide me with regarding information partaining to my situation.

I think your wife is playing mind games. If she is here on a K-3, then YES, you are her sponsor. Why did you two not live together? How could she file a restraining order against you? Did you threaten her? I'm sure that a VJ member can give you answers, but you must disclose all details. This just isn't adding up.
One thing that is for sure is that the K-3 visa will expire thirty days after your divorce is final. The only exception is if your wife can prove that she has been neglected. Please read the information below-
The USCIS only admits K-3 spouses for a two-year period. The USCIS may grant extensions of K-3 visas in two-year increments if the marriage-based I-130 visa petition, the adjustment of status application, or the immigrant visa petition is still awaiting adjudication.
A K-3 visa holder's authorized stay will expire thirty days after any of the following events:
a. The USCIS denies the I-130 visa petition filed by the United States citizen petitioner on the K-3 visa holder's behalf;
b. The USCIS denies an adjustment of status application filed by the K visa holder; or
c. If for some reason, the K-3 visa holder decides to apply for an immigrant visa at the appropriate United States consulate abroad, the consulate denies the immigrant visa application.
d. Termination also will automatically occur 30 days after the divorce of the K-3 spouse from the United States citizen petitioner.

K-1 Financee is here stateside as of july 26, 2008 and wedding is September 14, 2008 and she would like to go back to colombia for her daughter's wedding on December 15, 2008, What add'l paperwork would be needed to apply for this visit back to her country?

Unfortunately, the K-1 visa is for one entry only. After you get married, she can not travel until she has AP (Advance Parole). Use Form (I-131). The other way she can travel with a green card. However, the AOS (Adjustment of Status) may take a few months to a year. Check other time lines. December is cutting it close though.

I haven't posted in awhile. Interview date was changed to September 2, 2008, long stroy. Anyway, I'm a bit worried because there is a Tropical Storm/hurricane in Jamaica right now, and I'm thinking interview may be moved to another date
. I'm also worried because I would love to be at the interview, but I just left Jamaica 8/23/08, ticket had been purchased prior to me knowing the date of the interview. I can't get anymore time off from work nor do I have the finances to return again real soon (a ticket from CA costs anywere between $500 & $700). I hope this doesn't make the interviewer look at my fiance unfavorably. I put together a very nice organized binder of all documents needed for him before I left, so at this point all I can do is pray
. This has been such a long process, and I feeling very anxios to start our life together!

Would anyone happen to have a "cheat sheet" for a cover letter that is required for the AOS???
We should have filed this a LONG time ago,
but due to various situations here (health, deaths, etc..) we were unable to until now.
I am trying to get this in and submitted prior to his 1 year anniversary of his medical examination so we do not have to do that again. Any other suggestions would be great! (He entered the US the end of November 2007 --Medical was in October of '07--we were wed in Feb. of '08). Am hoping all I have to do is just submit all the proper paperwork and fees.

My husband has a K-3 Visa. He has another year before he has to apply for AOS. At any rate, here is a cheat sheet. I found it on VJ, and made a few changes. Your cover sheet may be a little different if you are applying for AP. Also, please verify that address of where to mail the AOS documents. I hope information helps.

Keep the faith. The entire K-3 process took one year. It is hard to be away from a loved one. Take this time to organize your immigration files (e.g. tax returns, W-2, pictures, etc). The interview will come when you least suspect it.

Thanks for all this info. I have already compiled some of this info, and will continue to do so. If I do decide to start working on the K1, I plan on doing so in about March of '09. At this point I will have spent about 10 weeks in Thailand with her, with about 1.5-2 hours of conversation on the phone every day (when I am not in Thailand). If I decide to apply for the K1, I will update my timeline once the process starts. One other thing, I have read mixed opinions about getting a lawyer to help out. While I do plan on using this site as an aid, I simply can't imagine doing this without some sort of a lawyer as well. Maybe it's just because I'm a worrier, but I don't want to seal my fate due to one error or omission on my part. Of course I will spend a great deal of time researching lawyers in hopes that I find the right one. I welcome comments/advice on this too.
Please do not waste your time & money on a lawyer. I did. VJ has tons of members willing to help. Use the attorney fees for your travel expenses instead.

Hello, When I visit my girlfriend in Thailand, I stay with her - we do not get a hotel. So, I do not have any hotel receipts to show/present when/if I finally file for a K1 visa. Is this going to be a problem? How else can I prove that I have spent time with her in Thailand? Will they accept this explanation?

That's fine that you don't have hotel receipts. From this point forward, take lots of pictures (different scenery), keep telephone bills, e-mails, electronic plane tickets, boarding passes, etc. The burden of proof lies with you. The Embassy needs proof of a real relationship. Please update your time line. It helps others in the process.

So no one got any dates yet huh???...i read this post from sunnyja who got an email from the embassy stating that they are fully booked until October....can you believe that...i hope that included some of the April peeps on here...i feel like bawling right now...
Don't bawl yet! K-1 & K-3 interviews are scheduled by the Embassy (Kingston). On the other hand, the NVC handles CR-1/IR-1 interviews. Once 1 Yardie gets a date, more dates will start coming. Just hang in there. Your day soon come.
I remember calling the Department of State in the morning only to hear the same thing (no interview). I tried back that afternoon. Lo & behold- we had a date. It is the most refreshing feeling.

You can inquire but most likely the consulate has already done this
My husband's interview occurred after the NOA 2 expired. Don't worry about the date, I'm sure the Embassy is aware of the lapse.

Hey I have a question:
On Dwayne's I-94 and in his visa he has an EAC number. The one on the back of the I-94 is handwritten with some other scribble can't read. Is this just his number for immigration purposes or does this have to do with employment authorization?

They made a copy of it at the social security office. They also asked for it when we went to the MVA. I'm not sure how it is in ATL, but here in MD they wanted to take his Jamaican license so, we tell them he don't have one. He's been driving since he got here.
So he got his drivers license already? I told Dwayne we would have to wait until he has his ssn back. That is great news

In order to get a GA driver's license, Dwayne has to have a social security number. DMV does not ask to see it, but the number is verified. Have Dwayne study the learner's permit manual. Kevin surrendered his Jamaican license. He still had to take the written and road tests. Dwayne also has to prove that he is a Georgia resident. I added Kevin's name to the gas bill months before he arrived in the U.S.

I going bananas!!! I m trying to get ahold of Kingston's embassy all a.m. I have emailed these ppl like 4 times asking for a time for my boo to drop off his ds230. Ty-the saga continues. Anyways, why don't these ppl answer the phone? And then when some broad answered she had me on hold for 10 mins! I had to hang up. OMG, any other tips on how to get this dang on appt. scheduled? Why do they need an appt anyway? There just dropping it off.................................
Are you putting 2nd request and your KNG # on the line? And each e-mail you send after that put 3rd request, 4th. I have only had to get to the 3rd and they would answer. It took SunnyJa some time before they gave her an appointment as well.
Your other option is to mail it to the embassy - just use some kind of tracking like Fedex, DHL, etc.
Ditto in regards to sending the form by courier. Try DHL, Fed Ex or UPS. I sent my DS-230 via DHL. Those folks in Kingston are nasty! On the day before the medical, I faxed the letter from my Congressman & e-mail from the Embassy confirming the appointment to Dr. Banbury's office. When my husband had his medical appointment, Dr. Banbury's receptionist demanded that he have a copy of Packet 4. I called the Embassy only to be told that they don't accept telephone calls. I'm a counselor. I had to use every technique in the book to get the B#@^% to leave the interview letter with security.
My husband had to leave the doctor's office, go to the Embassy & return the same day for the medical. He was pissed and so was I! The rep had the audacity to ask how I was aware of the interview date. This process will build character or give you hypertension and/or a stroke. When we picked up the Packet 3, I saw several people get turned away because they did not have appointments. One lady asked "Why do I need an appointment to drop off a birth certificate?" The security officers actually have a list (attached to a clipboard) to verify appointments.
Then, it takes the Embasy 2-3 weeks to enter the DS-230 in to the system. #######!!!! I'm sorry for rambling, but I got a flashback!

Hi Shirley, Steve, and Tommy im a 35 year old manager of a company and im having issues with my relationship. My girlfriend has been complaining about my sexual performance and earlier last year on my 35th birthday (9/22) i came home early from work to see my girlfriend having sex with another man..However, i was not suprized because around June i overherd my girlfriend and her friends joking about my sexual length, width, and performance. I had thoughts of leaving her sometimes. I only think she stays with me for my money. She has an 8 year old son whom i get along with great she often tells me im a waste of a good looking brother. Since December we both agreed i cannot satisfy her and I?ve been paying the man she has been cheating on me with 300 dollars a week to sleep with her and keep her satisfied. I give an extra 100 dollars if she wants him to spend the night. I?m going out of my mind right now while she is sleeping with another man. As I write this, I?m in her sons room playing video games with him while she?s with this man. More than once I have found myself sleeping in his room. . . he sleeps at the foot of the bed while i sleep at the head of the bed. I often cry myself to sleep and recently she has been talking to me with attitudes and disrespecting me and telling her friends. Her friends now call me Norbit and think its funny....i hate my life. I am a 35 year old man sleeping in a small bed with an 8 year old with super hero bedsheets. Is there anyway my relationship could get any worse than this? ps. I had an INFOPass appt for tomorrow, but the lady (not the smart A$$ one) was kind enough to call me back and give me the information I needed and said not to bother to come in. Since I filed AOS on Friday 8/1 (of course nothing is in their system). They can't do anything until USCIS has our file in their system and only God knows how long that's going to take. Then'll they expedite the AP (travel document). She also said that if I had filed for a week or so ago it may have been in the system and I would have had the AP by Thursday. They can't do anything until AOS is in the system. USCIS will then note in their system that he has permission along with the AP to re-enter the U.S.
My only other option is to have him leave and file a petition for a family visa and ya'll know how long that would take.

Georgia Senator Isakson's office is awesome. His staff called and wrote me to follow-up. My question was "Why does it take forever to get a visa interview?" Since your AOS is already on file, I'm sure that you can receive assistance. If you are unsure of your representative, go to your state's Board of Elections website or check out this link-

My Aunt Died yesterday morning. Great Aunt, I should say. My Grandmother, who died a year ago, her last remaining sister. I think she turned 90 last Tuesday. Family drama involving a funeral. Since my aunt and uncle won't come back from their vacation time share early, we have to wait till Saturday to accomodate them. God, I hate drama at a time like this.
What scares me is this now makes my father the oldest in the family. Not liking that thought one bit.
Wow! Funerals really bring out the nasty side of folks. I truly hope that your relatives will PEACEFULLY return home for the funeral. The drama is so unnecessary. Why can't they all just get along?

I'm sitting here trying 2 decide on what 2 do for our 1st anniversary. I talked to my husband 2day and he doesn't care what we do as long as it doesn't involve us being bothered by friends and family. Although I'm not all that crazy about Mobay I was thinking of just hiding out there for a few days. I was looking at some of the hotels there. Any suggestions? I was considering El Greco, but I don't know anything about it. The only other place we've stayed in is Toby's, but we can't cook there, and I'm looking for a place that less touristy where we can cook...God willing we will be spending our next annivesary stateside
My husband and I have stayed at El Greco many times. It is not upscale, but all rooms have kitchens. The hotel is adjacent to a tunnel that connects to the Hip Strip. All guests get free breakfast (Jamaican or American) as well as passes to Doctor's Cave Beach. If you decide to stay there, have your husband make the reservation in his name. As long as he has Jamaican ID, the hotel will give him a local rate. Otherwise, tourists are charged more. El Greco also has a small pool if you don't feel like leaving the compound. Let me know if you have any more questions.
Mrs. Scott...if he reserves the hotel in his name, does he have to have the money upfront? He doesn't have a credit card to hold it. Also, is there a grocery store nearby? I've been into the actual town only once, so I'm not sure how far away grocery shopping is. Thanks for your help.
Your husband does not need a credit card to make a reservation. To book the room, have him call El Greco directly (940-6116). There is a small grocery store right by the tunnel leading to the Hip Strip. From the Hip Strip, you can take a taxi downtown. The fare is $50 JMD each way. The convenience stores on the Strip are pricey. If you want a personal driver, PM me. I have two good taxi driver brethrens.
