Thanks for the advice. I guess my hubby needs to stay put until the green card arrives.

Thanks for responding. I got this information from the USCIS site.
If you have been admitted as a nonimmigrant and have applied to extend the period of authorized nonimmigrant stay, or have applied to change to a different nonimmigrant status, you will automatically abandon the application if you leave the United States before USCIS makes a decision on the advance parole application. Receipt of an advance parole document does NOT prevent abandonment of the change of status or extension of stay application. Upon returning to the United States, you are likely to be denied admission if your current status has expired.
For the reasons stated above, it is important that you obtain the proper documentation before leaving the United States. Also, you should keep in mind that admission into the United States is not guaranteed even if the appropriate documents are obtained. In all cases, you are still subject to immigration inspection or examination at a port of entry to determine whether you are admissible into the country and whether you are eligible for the immigration status sought.

My husband's EAD was approved today. Hopefully, he will get the AP/EAD combo. At any rate, he is a Bahamian citizen. Therefore, he does not need a visa to enter the US. The stipulation is that he must enter from Freeport or Nassau, Bahamas (US Customs & Border Patrol) site. Once he receives the Advance Parole card, will he have any trouble reentering the US. Has anyone had any experience in the Bahamas? Should we wait for his green card before planning any travel outside the US?

I don't have any experience with Antigua. However, I think you should call to check the status. Contact The Commissioner of Police Headquarters (268-462-2095).

Today, walk-in biometrics was done successfully at Atlanta ASC- no problems at all! The appt date was scheduled for April 1st. Thanks Kathryn41 & H1983.

Has any one tried to do a walk in biometrics (Atlanta)? Please share your experience. Thanks!

My friend's N-400 is pending. I know that once she becomes a US citizen, her daughter will automatically become one. She has her biometrics scheduled for next week. She has lived in the US for almost 6 years. Citizenship for her child is no issue. Should she pay the N-600 fee of $600 or try to obtain a US passport for her daughter? Please share your experience. Thanks!

You can go the K-1 (fiance) or CR-1 (married) route. I agree with Penguin. It will be very difficult for your significant other (SO) to get a tourist (B-2) visa. The K-1 is the fastest route, but the CR-1 is more convenient. Here is a comparison chart.

Try to weigh your options. In the mean time, please gather your proof of a relationship (e.g. boarding passes, airline/hotel receipts, Moneygram or Western Union receipts, e-mails, phone records, etc).
PLEASE DO NOT HIRE A LAWYER. IT IS A WASTE OF MONEY! THERE ARE KNOWLEDGEABLE VJ MEMBERS WHO CAN HELP (MYSELF INCLUDED). Just PM me if you have additional questions. Good luck.

Don't worry about the expiration date. Unless you withdraw the petition, you are ok. Send VJ Member DarlingNikki a pm. She most recently went through the K-1 process. I hope this helps. If not, please pm me.

Thanks to all the wise soles on this site. We filed in October, used the site to make sure we had everything in order. Less than 5 months later, the process is complete. Not one issue through the entire thing. I am Canadian, was here on a TN.
I'm glad to help with questions.
Congrats!

IRS returns are primarily to base on 3 years of marriage and continuous residency with a US Citizen.
However based on the N-400 instructions Transcripts or a photo copy of returns are fine.

My friend has been a LPR for 5 five years. Her father (US citizen) filed for her. Can she send photocopies of her her last 5 tax returns or does it have to be tax transcripts? Please advise.

I am trying to help a friend. Here is the information. LPR has been married since 2006. She filed for her hubby in 2010. Her case was completed a month ago. She wrote the NVC to ask about an interview date. The NVC's reply was:
Your inquiry has been received at the National Visa Center (NVC).
The applicant's name has been placed on the list of documentarily qualified cases awaiting the availability of visa numbers under the numerical limitations prescribed by statute. The designated representative of this case (applicant, petitioner, or attorney) will be notified of an appointment date as soon as the numbers have been received. The applicant should NOT make any travel arrangements, sell property, or give up employment until the US Embassy or Consulate General has issued a visa.
An immigrant visa is usually valid for six months from the date it is issued. It may be used to apply for admission into the United States any time during its validity.
Case Number: KNG2010XXXXXX
Preference Category: F2A
Your Priority Date: 15Mar2010
Foreign State Chargeability: JAMAICA
Case completed at NVC on 16 Dec 2010
How much longer will she have to wait for an interview (weeks, months, or years)? I understand that the spouses of LPR's are not eligible for an immediate visa. Should she apply for US citizenship to expedite the process? She just became eligible for US citizenship a few months ago. Please advise.

I called the 603-334-0700 to check the status of a friend's IR-1 petition. According to the AVR system, the case was completed yesterday (December 16, 2010). If that is the case, why am I still able to log in. I thought I would have a SIF. Has any one experienced this?

I am not sure I have ever seen the boyfriend post inquiring about the practicalities of his girlfriends husbands immigration.
A new one for me.
Obviously, you did not read the post! I am a female trying to assist my friend (also a female) regarding her husband's case.

My girlfriend is a LPR. She filed for her husband (Jamaican citizen). She received a RFE for not submitting the original marriage and beneficiary's birth certificate. In addition, she did not include proof of ownership (checking/savings account). She shipped the evidence via USPS Express Mail. The NVC received the package on Tuesday, November 30th. The AVR indicated the information was entered on December 8th. She was hoping for her hubby to get a January interview date. How much longer do you think it will take to complete the case? Has any one had a similiar experience?

Kathryn,
Thanks for the information.

My girlfriend (age 36) came to the US five years ago. Her husband is a Jamaican citizen living in Jamaica. Her father a US citizen filed for her. Unfortunately, her Dad passed away this year. She works and has filed taxes since living here. According to the Naturalization Eligibility Worksheet, she does not qualify for naturalization. I know that she is eligible for naturalization, but I can't find the information in writing. All the websites indicate eligibility based on marriage or for applicants under age 18.
In addition to a completed N-400 application, photocopy of green card (front & back), 2 passport photos and $680 fee, what documents does she need? Please advise.

Hello All,
I have a quick question. My husband went to collect his medical report on 11/25/10. The staff member informed him that the information is "confidential" and that she could not discuss the report with him. Of course, the contents were sealed in an envelope to be returned during his next interview. Is this normal or is something WRONG? I am a little nervous. Also she stated that it is "confidential" but to me that is his information that he paid for. Just another step in this process that is annoying. Please let me know your experiences. Thanks,
Hi Empress,
Welcome to VJ. The medical report envelope has to remained sealed. This is to ensure that the contents were not tampered with or altered. It seems weird, but this is standard protocol. If you have an further questions, please PM me. Good luck!

I am confused. I went to the payment portal. I entered the case number & invoice ID. It said paid. Where would I see SIF?
Wayne & Claudia,
I found out that SIF means sign in failed. Duh, I'm a little slow at times.
-
Go with the payment portal and look for a SIF. At that point your case is complete. At that point call the NVC and speak with an operator.

I sent the IV & AOS papers (F2A visa) via USPS Express Mail. NV received the package on November 2nd. I called the (603) #, to track the status. Automated system indicates that information was received on Nov 15th. Will the automated system tell me when the case is complete? Does my friend need to speak with an operator? I just want to make sure that there is no RFE. Please advise.

My husband is here legally. Bahamian citizens can travel with passport and police record (less than 6 months old). His I-94 will expire in a few weeks.
