    Hello All,
     
    I hope you all are doing great. I've been so busy at work these past few months due to staffing shortages and sometimes have to work straight 4 day shifts, juggle children's activities, but I'm so grateful to God Almighty for the opportunity.
    After 3 long years, my I485 has been approved!!! What a beautiful New Year's present!! My attorney's office sent me the I693 first week in December on a Friday immediately they received it, I got my medicals done the very next Monday, received the results back on a Thursday and that same Thursday dropped it off at my attorney's office. Barely 11 days later, which was 2 days ago, I received the notification "card in production" and yesterday "your case has been approved". I normally read where people say it takes 2 months to get the notification for card production, so I was pleasantly surprised and overjoyed that it came so quickly. Being the daughter of The Most High God SURELY has its perks, it grants me VIP status wherever I go, thank you Jesus!! My Father in heaven, the creator of heaven and earth, I am SO PROUD to be your daughter 🥳 🙏🙌.
    I just got home from work, so if I don't respond to messages immediately please bear with me as I'm probably passed out on my couch :-), but I will respond as soon as I can.

    Timeline:
    I360, I485 AND I765 submitted Sep 2018
    I360 approval April 2020, no RFE
    Received 2 year EAD renewal July 2021
    Received request for medicals and GC approval December 2021

    this is a 2/3 years of exreme anxiety of depression.
    eversince i got my card im feeling an internally healing in me.

    2years ago i was in a nightmare.. this thread gave me hope. God bless everyone helping people here.. esp Sandra and the rest.

    I will try my best to always come back to answers questions as best as i can.
     
    I know someone here is wishing to be like me right now.  i want to encourage you that your time will come. believe me i never thought i would see this day...  2yrs ago i couldnt even visualize it but God made it possible becuase He hads broken the gate of brass.

    If your personal statement is too long, can it affect your case? I read on several sites, the shorter the better, but I have like 27 pages, telling my whole life story

    Hello everyone,
    I had my interview today. The office said he needed to review some information and get  a new background check and told me to wait a few weeks. I Checked my case status online a later today and it says new card is being produced. That’s it mean I’m approved?

    Hello Family,
     
    Finally after a long wait since i received the notice "Your Case has be transferred to another office on March 2nd". i received this notification.
     
    Thanks for all your support and to my lawyer as well she has been very supportive every time also many times didn't even charged fees.
    She kept a very strict fallow up on my case as well. May god bless her and all of you here.

    I first came on here sometime in July 2019 when I thought my world was coming to an end . I was going through divorce with the woman I loved . But I can say it’s all in the past and am better than I was yesterday . And two years ago . 
    My vawa was approved May this year, no evidence was asked . Two weeks ago, I was asked to submit my medicals and I-864W and I sent everything last week and couple of minutes ago MY I-485 was approved . NO INTERVIEW, NO lawyer from day one . My God who brought me to America has been my lawyer . Finally the journey since 2017 is finally OVER . I can see my family or travel after 8 years . 
     
    I love everyone here, thank you Sandra, thank you to whoever created this beautiful thread . Thank you to Fedaniela and Gabriela .

    I had my interview today and... THE OFFICER SAID RIGHT AWAY THAT MY CASE HAS BEEN APPROVED! I SHOULD RECEIVE THE GREEN CARD WITHING 2 WEEKS!!!
    The nightmare is over guys!
    It is a week before my birthday and I couldn't wish for anything else .... thank you for your good wishes, prayers and support! 
    Do NOT BE SCARED! Just be patient! 😘❤️

    Good luck honey! You are gonna kill it!   I did my Med Exam on Wednesday, November 17th and It was ready on Saturday, it takes only few days

    My timeline, might help:
     
    November 22, 2021 Case Was Approved October 23, 2021 The Post Office delivered your new card to the address you gave us. October 21, 2021 The Post Office picked up mail containing your new card. October 20, 2021 We mailed your new card your Form I-360, Petition for Amerasian, Widow(er), or Special Immigrant, directly to the address you gave us. October 18, 2021 We ordered your new card. September 27, 2021 We received your response for Form I-360, Petition for Amerasian, Widow(er), or Special Immigrant. June 28, 2021 We sent a request for additional evidence for your Form I-360, Petition for Amerasian, Widow(er), or Special Immigrant. October 1, 2019 We received your case and waived the filing fee for your Form I-360, Petition for Amerasian, Widow(er), or Special Immigrant.

    Yeah, fighting against governmental incompetency is an uphill battle.
     
    In regards to sponsoring another spouse, VAWA technically falls under "gained lawful permanent resident through a prior marriage to a USC or LPR". The requirements in this case are basically:
    1. You've been an LPR for at least 5 years, or;
    2. You've naturalized, or;
    3. The prior marriage terminated due to death of your spouse, or;
    4. You can establish by clear and convincing evidence (75% confidence, vs 51% confidence that US immigration benefits generally operate under) that you did not enter the prior marriage to evade any immigration laws.
     
    So basically, either you wait until you naturalize, or you gather up any and all evidence that the prior marriage was legit and send that with the I-130 for the new spouse.
     
    I don't think this question falls outside of scope of VAWA since this thread is basically a catch all for anything VAWA related and adjacent. I've answered questions related to the National Firearms Act here previously.

    3 year naturalization under VAWA is governed by INA 319(a). I don't see anything in the law that would preclude one who got their LPR status via VAWA from naturalizing after 3 years due to a remarriage.
     
    I went digging into the policy manual (which for the lack of a better term is a f-ing mess), and Volume 12, Part G, Chapter 3, F governs that and similarly I see nothing which would prohibit someone who got their LPR status via VAWA (I-360 or COR) or got the VAWA waiver on I-751 from naturalizing after 3 years after a re-marriage.
     
    So in this case I will just say that the agent handing the naturalization is an idiot and if someone up the stack doesn't catch this error then only real recourse is either to sue USCIS or file N-336 to appeal.
     
    Generally when you have multiple ways to do something in immigration law, it's your call which option you go via. E.g. if you're an LPR for 5+ years, and married to a USC for 3+ years, and you're in the military, it's your call which box to tick as your reason for naturalization. I don't see any justifiable reason for a re-marriage to override eligibility based upon prior VAWA.

    i received my I-360 approval notice today .. and there is priority date on it May 17 , 2017 and 
    What is this date for ? 
    i originally filled vawa and I- 485  On February 2018 , 
    but i had an old 485 application on May , 2017 
    iam confused !

    how long does it take for 485 to transfer to NBC, once Vawa is approved (on average)? Mine has finally been approved after “new card being produced” status.

    You can get prims facie because your case is also approvable as you have done nothing wrong until you failed to satisfy the officer. No offense yet. Be positive and address all what you have to do and zero your mind. Good luck.

    Hi folks, today I received this notification and it seems my I360 has been approved. Here you will see my timeline. I was devastated when my marriage finished but now I see a light after all this process. I never received a prima facia during these two years and my I485 was transferred from my marriage process. 

    btw, my i765 -C09 renewal is still pending since september 2020.

    Hi everyone, so after USCIS messed up the address of where my gc is supposed to be delivered, I finally  received my green card!!! After x times of calling: 
     
    USPS and telling me to call local USPS-Kew Gardens wherein I ended up being ignored, and staff told me “ I can’t stand here all day and keep scanning”, I got ignored too when I told them that the suite number that USCIS used for the address was wrong (old) and that it has been corrected by my lawyer at USCIS and USPS. I was told “ I don’t know where your package is”
     
    USCIS- I asked them to resend my card and that I have asked for an e-request too online. For form I-90 even if I have checked the box that my gc was lost, before submitting it online it still required me to pay $500plus dollars unless if I’ll file for waiver but then with waiver I can only apply via snail mail.  I have even asked for info pass appointment. It was frustrating. Lots of pointing fingers and calls. 
     
    Lawyer- I begged  if he could go to post office since it was address to his name and office, he said “line was too long, couldn’t wait”. I don’t think he went anyway. 
     
    I’ve reached out to Senators Gillibrand and AOC, couldn’t believe the quick response that I got compared before maybe bec election is coming? LOL. I told them about the job I lost in the hospital. So from AOC, a representative from her office asked my tracking number yesterday via email and I replied last night and viola! Mail delivered. Thank God. To all my fellow VAWA filers, don’t give up and use all the resources that you can get. Thank you for this forum. God bless us all!

    I went for my interview today… went in 30 mins prior. My lawyer supposed to come with me but she came late. So I went in without her. The IO asked if I want to wait for her but I told her there is no need. She asked my date of birth, parents name, if I have kids, I had two, the second one just one month ago. She asked for their birth certificates, then my divorce decree, yes or no question and that was it. She later gave me a paper that after background check, they will make a decision. 
    After 10 mins, I got update that my card is being produced. I’m so happy this is the end of the journey since 2016 I got married to my abuser . Filed Vawa 2018.

    Hi folks! I’m so grateful for my journey. I filed my I-360 + I-485 on August 2019 and today I got my green card on hands. No RFE and no interview. Before filing my case I gathered all evidence that I could a year before and I read everything about Vawa. I prepared my case and was very pro active but I was also so lucky to have my attorney with me. She was patient and very understanding about domestic violence. Please folks never pay to much for Vawa case. It’s a humanitarian matter and if your attorney doesn’t care about it honestly he won’t care about you and your case. I did my case with Catholic legal Services and they were awesome ( I have payed $500 + immigration fees). My case was complicated and I explained every detail on my affidavit. I was worried mostly because he lived most part of the time out of state. He also would give us ( our daughter and me ) a very high end lifestyle and explain the dynamic of domestic violence in this context is very complicated. I still live in a toxic relationship with my abuser and I’m struggling to get out. Right now I’m in process of getting a job and I  hope very soon make my path to my freedom. I also would like you guys know that is SO IMPORTANT develop a relationship with God. Actually I would say it’s necessary to not go crazy. Thank you Lord for holding my hand in every step. Thank You for don’t give up on me even when I did not believe on You. I would be nothing without You.
