    Did you send the letter to withdraw the affidavit of support? I didn't only suggest this as a way of finding out of she's been issued a green card. I also suggested it because if she manages to adjust status then that affidavit becomes legally binding on you. You have the right to withdraw it up until the immigration benefit is granted. Withdraw it now.
    The online case status system is notoriously unreliable. Some cases never make it into the system, and many others are never updated. Did you enter the entire number, including the three letter prefix (MSC)?

    Exactly. I think there was a statement made in another thread that K1s aren't even eligible for expedites (or something of that nature) which is just completely false.
    But generally, impending weddings or job offers are not reasons for expediting in any way, shape or form. In other words, planning on your part does not constitute an emergency for USCIS.
    I'm sorry to hear about your fiancee's medical issues.

    That is not true, we were just approved for the expedite of I-129f, got an email on March 29, 2011, and letter came March 30, 2011. We had a compelling medical and financial reason for the expedite to be approved based on US fiancee's condition.

    The VWP is not intended for you to spend more of your time in a year in the US than your home country. You've used it a lot, and for long periods of time. Since you've not used it yet in 2011, you might be ok - or they may feel you're overusing it. No one can tell you if a CBP officer will let you in or not - you'll just have to roll the dice and try, unfortunately. And bring plenty of proof of ties to your home.
    I would also suggest routing your flight through Shannon, Ireland, where you pre-clear the immigration checkpoint. That way if you are turned around, you'd have a shorter flight home.

    I applaud you for pointing this out. As one of the supposed 'Western Feminazis', I haven't even bothered to reply to such drivel because I know I'd just be dismissed out of hand. But what goes on in there from a select few is quite disturbing - esp. since it is going on unchecked.

    I really don't think it's that difficult. The best thing you can do is tour both facilities, decide which you prefer and then talk to your doctor about any concerns you may have about your choice. Sometimes having 'too many cooks in the kitchen' trying to help you decide is more harmful than helpful. ESPECIALLY the internet - horror stories abound!!

    This is a scam - they send them out in hopes someone will bite.
    If you offer to send money directly to the hotel that is holding "hostage" - they will shoot that down.
    Never - ever - send money via Western Union to people you don't know, or you didn't talk to in person (as in family).

    This is correct. BKK is not similar to any other country when it comes to this subject.
    In 3 recent cases the embassy required not only the signature but in 2 cases actually required the father to be present at the embassy for questioning.
    The embassy will provide a sample letter. They dont explain that they require the letter signed in both languages. In the 2 cases I know of they also never said in advance that the father needed to be present. In those case both mothers made some errors in the verbal explanation of the situation which caused the officer to question the intent of the very letter the embassy issued.
    This is a very difficult subject for people from other countries to understand. It involves a long history of Thai culture. It also demonstrates the extent Thai men will go to so they can avoid responsibility. What occured here is common in Thailand.
    He refuses to acknowedge the needs of the child because it is the only thing he can do to maitain some control over another human. Thai men must be seen as having the mind set of a child. Do not mistake their thinking for yours or that it involves a modicum of common sense.
    It may be a mistake to involve a lawyer. In Thailand these things are done by family members. This could turn into a very difficult situation if not approached in the right way. You will have to decide how much you are willing to pay. He will refuse the first offer. Prepare 3 offers & a strategy to make those offers. Use his family against him by makeing the offer thru them. They will want some of the money from him. They will try to force him to accept. He will lose face if he doesnt. This is their chance to make some money & they all know it.
    Keep in mind someone may have to ask him to travel to BKK. He will want the cost of that plus his loss of income & more to do it. You wont know if the embassy will require him to come until its too late. This means additional time & money to be spent. If the embassy refuses the letter someone will have to talk him into coming. If that happens the embassy will allow time & reschedual the interview.
    I know this all sounds impossible to believe but I assure you it isnt going to be easy. I helped with two cases in the recent past. I spent hours on the phone with the Thai to help them get thru what had to be done. There is much more to this than I can express here.
    The other options you speak of are even more difficult. They would be limited to simply leaving the kids in Thailand. A close friend had to leave one of her 3 due to exactly this. It has proven to be extremely difficult for her & the child. She now travels to Thailand often to visit her own kid. This affects her life in the USA, her work & her Thia family a great deal. I would not recommend leaving the kids for a thousand reasons.
    It is my hope that this child will be allowed to realise the same freedom we all have in this great country. To live his life here with both of you.

    If all they ever do is cause you this huge 'disservice', they would never process your petition and never get her over here to the US.

    The article you linked to has nothing to do with USCIS policy. It regards a civil action taken against a sponsor by an immigrant seeking support. It also focused narrowly on 8 CFR 1182 to determine the period of enforceability while ignoring 8 CFR 1205.1, which provides that a person can withdraw any petition by written notice anytime before the immigration benefit has been approved.
    Quoting from the USCIS document you linked to:


    (h) Withdrawal of an affidavit of support or Form I-864A.
    A person who has signed a Form I-864, I-864EZ or I-864A may withdraw the Form. If the person does so, USCIS will adjudicate the application for adjustment of status as if the withdrawn Form I-864, I-864A or I-864EZ had never been filed. In an adjustment of status case, a withdrawal of the Form I-864, I-864EZ or I-864A is not effective unless it is in writing and USCIS actually receives the withdrawal before the final decision on the adjustment application. In an immigrant visa case, once a consular officer has issued an immigrant visa, no Form I-864, I-864EZ or I-864A may be withdrawn unless the visa petitioner also withdraws the visa petition.
    INA 213A requires an affidavit of support from the visa petitioner. He withdrew it, and her AOS was denied as a result. His I-864 cannot be resurrected because he rightfully withdrew it, and the I-134 cannot be used in it's place because it doesn't meet the legal enforceability requirements of INA 213A.
    Could she sue him for support using the I-864 as a basis? Perhaps. Depends on the state she lives in. Some states have strict guidelines the judge is required to follow when determining spousal support, and those guidelines often won't take into account any contracts or agreements made prior to the divorce. She may have a chance in a civil rather than family court. Either way, getting a support order is not going to help her get a green card.

    Be careful of what you 'hear' from others when it comes to immigration.
    Most countries allow you to file directly in the country itself - also known as a direct consular filing. However, that is for married couples (which presumably your friend is not) and generally, the US citizen must be living in the country in question for a certain period of time before they are allowed to file. Depends on the country in question and the rules they have surrounding it.
    What 5 months? You mean the 5 month processing time reported by the service center? All that means is they can put in a formal inquiry if their case goes beyond the standard reporting times. Sometimes it's best to contact a senator or congressman for help at that stage. And no, no one can tell you how long it will take after that for approval.
    For what it's worth, It'd be better if he signed up here and asked his own questions. Things get lost in translation sometimes, and the devil is always in the details as far as immigration is concerned.

    Texas isn't processing your petition. That's where you sent it, but it's since been forwarded to either Vermont (over a 6 month wait) or California (over a 5 month wait). Check your NOA1 to see which one is adjudicating your petition.

    Having a child you can't afford is a selfish act. This is going to sound bad , tough love, but a child is not a tool for personal gratification. The require money, lots of money. There is food and diapers, and medical bills. They outgrow their clothes and require a good education, which in the US means paying for a private school or paying money to live in a good school district. If you are scraping by it adds strain to your relationship, beyond what the normal bottles and diapers and sleepless nights bring. You still have a number of fertile years ahead of you. It isn't the 50's anymore where late in life babies were extremely high risk. Spend a bit of time getting your life set up to welcome the baby and then go ahead.

    If he filed asking for the waiver based on divorce then the ROC cannot be approved until he has submitted a copy of the divorce decree. He'll get an RFE for the divorce decree. You could respond to the RFE with a jointly filed I-751, but it will not be approved if your divorce is still pending. If you want to change the basis of the ROC to jointly filed then you must stop the divorce process.

    Do whatever research you like.
    No one on this community is going to advise you it's OK to intentionally cross a US border with plans to marry and put down permanent roots in the US. Such behavior is in violation of the INA as it is entering the US with clear intent to evade immigration policy.
    When you take certain actions, they are your own responsibility. Do not expect people here to tell you it is ok to intentionally circumvent the law.
