Can you please guide me the procedure of after 1 year ban? Like what will happen to my case? Like they will close my case or they will hold my case for 1 year and after that they will reschedule my interview etc ?  please answer Thanks in advance for taking you precious time.

I really don't what will happen with your case if they ban you. Normally when somebody is banned they need to apply again. Start from 0.

I find this information and maybe help you (in the end says maybe the CO can ask for more evidence.

Try to be calm, talk with your wife and be prepared for your interview.

    A. Drug Abuse or Drug Addiction

Applicants who are found to be drug abusers or addicts are inadmissible. [1] Drug abuse and drug addiction are current substance-use disorders or substance-induced disorders of a controlled substance listed in Section 202 of the Controlled Substances Act, as defined in the Diagnostic and Statistical Manual of Mental Disorders (DSM) published by the American Psychiatric Association or by another authoritative source as determined by the Director. [2]

In 2010, the Centers for Disease Control and Prevention (CDC) changed the Technical Instructions on how a civil surgeon determines whether an applicant is a drug abuser or drug addict. [3] The civil surgeon must now make this determination according to the DSM as specified in the Technical Instructions. [4]

If the applicant is classified as a drug abuser or addict, the applicant can apply again for an immigration benefit if his or her drug abuse or addiction is in remission. Remission is now defined by DSM criteria, and no longer by a set timeframe as it was under previous Technical Instructions. [5] In order for an applicant’s drug abuse or addiction to be classified as in remission, the applicant must return to a civil surgeon for a new assessment.

If the officer has reason to question the completeness or accuracy of the medical examination report, the officer should ask CDC to review the medical report before sending a Request for Evidence (RFE).

Most applicants who are found to be drug abusers or addicts are ineligible for a waiver; the availability depends, however, on the immigration benefit the applicant seeks. [6]

  2. Mmm I don't know if you understand how a Embassy works but is not like you put in the second option.

You can not tell them to pause your case and wait you for 6 months.

If you don't appear in your interview probably they will send you a message and close your case.

Just a question, in the DS-260 what was your answer for this question:

"Are you or have you ever been a drug abuser or addict?'."

Sorry I’m just wondering if I need to take my marriage certificate to a consulate or something here before I head back to the US, basically just trying to figure out how I get my marriage recognized in America

You need a official translation and in some countries they ask for some stamps for the local Government.

If you will file for the CR1 visa don't forget to leave the Marriage certificate with your spouse. It will be necessary for the interview.

By the way, Congrats for the wedding!!

    Hello guys,

I’m the beneficiary waiting in Mexico and my husband is thinking on coming live with me while we wait on our I-130 approval but he would be still working on the US. our PD is Aug 30 2019 in Nebraska, the question is now what? Would this affect our case? When we move together how do we have to let them know that we are now living together in Mexico, Do you all think we will have problems for the NVC stage and interview? Thank you in advance for your help.

Hi there. This is not a problem. My husband was living with me in Argentina.

Is important he have a domicile address on the US and you guys need to communicate your address in Mexico.

Will help if you have a joint account in Mexico and more stuff who helps  to prove bonafide marriage.

    Good luck.

Hi Talo. Don't freak it out! Everything will be ok.

My lawyer made thousands of mistakes in my forms too. I ask her to make me a documents where she explains is her fault.

In my interview I waited to see if the CO would ask me about the mistakes before I present it the paper. He didn't!

My case was approved and I'm here in the US right now.

    Be calm and confident!!.

    Good luck

  7. I don't know why he didn't have his birth certificate with him but is a super necessary documents.

Getting a birth certificate from Argentina is a real NIGHTMARE. My husband was born in a different province from where we lived and they said processing times would be 2 months. By then, we had to leave the country.

Mmm I don't know who tell you that but to get ANY documents in Argentina is pretty easy.

Which province is he from? Buenos Aires or?

"Father recognition" is not Partida de Nacimento.

And I really don't know for the K1 visa but for my CR1 they ask me to Apostillar my documents too.

Tell me his Province and I can help you.
