    Was she in full custody of her father living in the US at the time he naturalized? Then yes, you can put his date of naturalization.

    She renewed her passport recently and there were no obstacles. Yes, she was living with her father and dependent on him. So I guess i can use his date of naturalization?

    I am stuck filling out the N400 online (under the 3 rear rule) on the question - [ Date your current spouse became a U.S. citizen? ]. My wife became a US Citizen through the naturalization of both her parents (Under the age of 18) and she doesn't know the date she became a USC.

     

    Her parents did not file N600 for her as they were probably unaware of that process! And applied for her passport based on her father's naturalization certificate. I red a few posts regarding this on VJ, but didn't get clarity on this. My confusion is what date should I put, and what evidence should I provide?

     

    1) Date of her Passport?

    2) Date of her father's Naturalization certificate?

     

    Thanks in advance for any help regarding this!

    3. I believe you would be fine if you apply February 21, because the majority of your days in the previous 3 months would be in your state of residence. Assuming you stay inside your state continuously from Jan 1 to Feb 21.

     

    4. For each trip, the form asks for the date you departed the U.S. and date you returned to the U.S. If you are not in the U.S. on the day you file, I do not understand what day you will enter for the day of return. So, no. At least not without perjury.

     

    Thanks!. One thing i am a still a bit confused on. Why would i only need to wait will Feb 24 ?. Don't i have to wait for full 3 months ? I.e from Jan to April ?

    I would be eligible based on (90 Day period) on Dec 1st, 2023 to apply for N400 (3 year Marriage eligibility). We have been staying in US for entire 3 year period. We will be traveling out of USA on vacation (visiting multiple counties ) from Nov 1st week and coming back on 1st week of Jan 2024. I have below questions and any help on those would mean a lot!.

    1) Would I be able to apply right after we are back in US (Jan 1st week)?

    2) Do I still qualify for 3 Months Residency period rule, as we will be out for 2 months right before applying  \(We have been staying in same address for more then 4 years)?

    3) If not, do i need to wait 3 months from Jan to apply for N400 ?

    4) If the form is only and i am eligible in Dec, Could i still apply online when i am on vacation from out of USA ?

     

    Appreciate any feedback on these, thanks !

    They might not ask for it. We took a ton of documentation and they only looked at our passports and the deed to our house. I would probably go ahead and get your parents to order and send it, just in CASE you get an RFE.
    But it will probably be fine. 

    In our case, the interviewing officer was quite reasonable and the interview was straightforward and not something to stress about. Good luck!

    Thank you , But in case when the officer asks for the Original , is it okay to provide secondary proof like School Leaving Certificate ?

  7. I was collecting the originals for the interview and couldn't find the original Birth Certificate of mine. I was under impression that I had it and didn't bother to look for it well before (Very dumb of me). I have the Scanned copy for it. I talked with my parents and they can get the new copy of the original from my country next week and send me overnight. But my interview is on Monday . Do officer ask for the original birth certificate in the interview (We have for my wife - She is the petitioner) and if they ask for mine what should I tell them ?. Any response is appreciated. Thanks 

  8. Interview in March 1st week for AOS (Marriage). Got an online status update today stating I-130 was approved. Couple of questions

     

    1) What does this mean when there is still an interview pending and then awaiting approval after that?.

    2) How does this effect interview ?

    3) Does this i-130 approval make interview easy to approve for officer ?

    4) Is this normal in adjustment of status application ?

    Finally after what feels like a 100 years the tier 1 agent told me that my biometrics for just I-485 has been scheduled for Feb 16th. There was no mention of I-131/ I-765 and she said the ASC might schedule another bio appointment for those when they have availability. Does anyone have any experience with this? Do they use the same set of prints for everything? Kinda worried that I would be asked to wait again.

    Bio: Feb 16, 2021 (have not received appointment letter yet)

    So my appointment was for code 2 but officer told me that the system auto changed it to code 3. I would say wouldn't hurt to request that if system doesn't auto covert. I have seen people do that. Good Luck !

    My EAD also got approved today morning and status changed to card being produced!
