I'm not sure if this is the right forum and I haven't been able to find a concrete answer elsewhere. So I know people file the N400 while their I751 is pending, however my wife's GC doesn't expire until 06/2024, meaning we couldn't file the I751 until 03/2024. However, She came on a K1 visa on 09/16/2020 and we got married on 09/17/2020. Wouldn't that mean she could file for the N400 after her 3 years of being here, since our 3 years would be 09/17/2023, and you could apply 90 days earlier (which would be in a few days from now)? If so, is it allowed to file for the N400 before filing the I751?

No, there is no way to speed it up. Hypothetically your parents in law could also file for her older sister eventually but because she is married, they will have to be citizens first, so above 2-3 years + 5 years to naturalize+ the wait time for F3 category, which (same doc as above) is actually even longer than F4. So that’s not cutting any corners. For the younger sister parents could file for under 21 child once they are LPRs, that’s F2A in the doc and the current wait is 3 years - so that is a faster option for the younger sister, but not in any way “fast”. There is no way the younger sister can come with them at first either, so would she stay with the older sister?
If her sister or sister’s spouse have good degree/experience they could get a sponsored work visa, but at only 20 years old I’m guessing it’s too soon to be thinking about that for the older one much less the younger one. Maybe a future option if they are on good career paths.Thank you for the reply! Also, I actually found out that my wife’s sister is unmarried but it doesn’t look like the really speeds up the process at all since she turns 21 this year. So it looks like her best option is just a tourist visa for now right? Even then she still has to go back to Mexico after her visits correct? Just sucks because i did want, as well she, for her kids to have the chance at a US education over Mexico’s.

So my wife is eligible to take her USC test next year so naturally we started thinking about starting the process of moving her family (Mexico) over to the US as well. I have a very close relationship with her family and would love for them to come to the US. Her family is as such:
Dad (42)
Mom (42)
Sister (20 married w/ 2 children)
Brother (11 but was born in the U.S.)
Sister (10)
Being that her brother was born in the US I know she won’t have to petition for him. Is it true the wait time for her sisters to be able to come over as a LPR would be 22 years right now? Is there any options for them to be in the US faster permanently? How long would it take for her parents to be LPRs?
Also, in case you are wondering about her USC brother, her and her family was in the US unlawfully from 1999-2011 in which her father was deported and the rest of the family voluntarily left back to Mexico with only her father incurring a 10 year ban.

Hey guys! After a long wait my wife finally received her GC after adjusting from a K1 visa and we are very excited! However, we noticed her permanent residency card still has her maiden name even though we have been married for almost 2 years now. Is this normal or is this a mistake? I saw that I would have to file an I90 to change it which would take months. Which would obviously suck because after 2 years of waiting we just got it today and it would be a real buzzkill to wait months again.

Hi guys! I still have a question! So I am finally ready to submit my wife's AOS package but I am hung up on this situation. Do I need to submit any paperwork on her medical exam at all? Because it appears that my wife lost her DS-3025. If not, then I would just wait until we get an appointment scheduled for her. Which then, I would get an I-693 from a local civil surgeon, but I just wanna make sure I have everything I need for her initial AOS submission.

I am trying to finish up the I-944 and it has a list of pubic benefits and asks if ever received them, which includes the following:
- Any Federal, State, local, or tribal cash assistance for income maintenance;
- Supplemental Security Income (SSI);
- Temporary Assistance for Needy Families (TANF);
- Federal, State or local cash benefit programs for income maintenance (often called “General Assistance” in the State context, but which may exist under other names);
- Supplemental Nutrition Assistance Program (SNAP, or formerly called “Food Stamps”);
- Section 8 Housing Assistance under the Housing Choice Voucher Program;
- Section 8 Project-Based Rental Assistance (including Moderate Rehabilitation);
- Public Housing under the Housing Act of 1937, 42 U.S.C. 1437 et seq.; and
- Federally funded Medicaid
I am wondering, as an Active Duty military member, do I receive any of these benefits? Because I see on question 19 it has the option to check off that my wife (beneficiary) is a spouse of an active duty person (Me/petitioner).
Mainly asking my current active duty military and veteran folks!

As people are stating above, this process is very doable to do on your own. However, if you felt that way then you wouldn't be asking this question, which I understand because that's exactly how I felt as well. I personally did use an online resource and I did find it really helpful. The website was VisaTutor. I recommend to do as much of the forms on your own as possible, and follow the instruction pages more. However, I still paid for this for the reassurance and pretty much as a second-check for all my paperwork and any questions I had on those funky-worded questions that are confusing. Again, it is still very possible to do this on your own, but if you don't mind spending a little extra for piece of mind, than definitely I recommend VisaTutor. However, do not be afraid to search or ask questions on this forum. We are all here to help and there are very experienced and intelligent people who have definitely helped me on here, through my whole process with my wife more than anyone or anything else, who will gladly help you as well.

Technically there is no deadline to filing the AOS from a K1 marriage. Some people wait for whatever reason. Most folks here will recommend filing within the I94 period but it is not a hard requirement. In a worst case scenario, even if someone was put in removal proceedings, an Immigration Judge would most likely toss the case if the AOS is filed.
I agree with @Lucky Cat, file when you can and try not to worry so much about it.

So I am getting worried because based on countless research I had done, I had the belief that once my fiance got here on a K1 visa, we had 90 days to get married and then we could apply for her adjustment at our earliest convivence. However, upon more research, it does not look like this is the case at all. We got married the same week she arrived in the U.S. but I have not filed her AOS yet. Due to Covid and her pregnancy, its been a bit of a struggle to get the $1225 for the filing and biometrics fee. However, her I-94 expired 12 Dec 2021. I know I can save up enough to file her AOS in Feb, but I just don't want any possibility of her having to return home, especially since she is due within 2 months. Will there be any problem when filing her I-485? -

The police report went smoothly. We just ended up going to a local police station and it took about 30 minutes. The interview also went very smoothly. It was a little bit of a wait for her but once she sat down with the interviewer, it took about 10-15 minutes.

K-1 visa applicants do not complete a DS-260. DS-260s are for immigrant visas only. Sometimes, they send a generic email which doesn't apply.

Yes but they specify in the email that i need to go online through a link they sent me and fill out a DS-260.

Every time I hit ok, it just sends me back to entering in my case and invoice number.

I am trying to file my DS-260 with my case number and invoice number they sent me. However, it just tells me about how all non-immigrant visas needs a DS-160. I need to fill this out before Friday but I keep running into this issue. It cant be to make another DS-160 because my case number is correlated to my DS-160 that I had already filed and paid for.

Ok now im confused. Can we not just get one in Ciudad Juarez before her interview? Is it absolutely necessary to get one from her state? And yes she lives and has lived in the “State of Mexico” and not Mexico City.
