You abandoned that petition when you filed an I-360, your ex never withdrew it, it just hung around in the system, it came across someone's desk, they looked at the stuff in it, and approved it.

You do not have to do anything with it. If you absolutely want to you can send a letter to USCIS that you filed an I-360, divorced your ex (if applicable), are already an LPR, and it was ultimately approved in error.

    Thank  you 🤗

Yes it is the old I-130 that was sent either to the old attorney ( and returned because he moved) or possibly the copy sent to your old address.
    You can do the following:

    1. Write a short letter “ Re: I-130 case xxx. Beneficiary : Your Name A# . Please update the record to show I have adjusted status and will not be pursuing above referenced I-130.”
    2. Or you can try calling USCIS, and say the same thing.

My lawyer called and hour ago, said to ignore it as the basis of my I-485 was the approved I360. I-130 is of no consequence. Makes sense.

  3. Family,

I got this today. I already have my Green card, What gives?

When me and spouse did initial filing, we had a lawyer. When I filed 360, I terminated that relationship on lawyers request as there was a conflict of interest on his part as he explained.

Is it that the 130 approval notice was sent to the old lawyer who did not accept (Also, he has since moved) ??

thanks!!! I asked my lawyer about that - she said it's better to do some follow-up with USCIS before reaching out to congress people. It's been over a month she put in a status request - nothing yet. I did get I-693 deficiency notice, so does that mean case is transferred for sure?

Just ask the congressman for assistance, it won’t hurt

only way to know for sure is to ask, lawyer or better yet, congressman

    Hi

My VAWA case (I-360) was approved on 02/18/22, EAD c31 was delivered on 01/10/22

What us the next step? Should I wait for interview? Will I see updates on USCIS Case status online?

    Thank you,

    Hi guys,

I received my EAD C31 last week.
    what should I expect now?

    Any idea regarding timeline?
    Thank you!!

    Congratulations you two 🎉🎉

Your VAWA has been approved!! Now wait for the C31 cards, then the approval notices.

assuming your had already filed 485,

    A) in about next 1-2 months, your file will be transferred to your local offices. Not everyone gets an update on that. SUGGESTION: contact your congressman/women in 2.5 months, ask them to check the location of the I485.

    1. if 485 is not yet at local office, let your lawyer (if you have one) know and also ask congressman to help from Vermont and ask them to send the file to local office

    2. if 485  is at local office:

    a. see the processing time at you local office and sit tight for USCIS to ask you for Medical/ schedule interview

    b. If you are already or at whatever point  out of processing time and your file is at local, start an ‘out of processing time Inquiry’ and wait for answer and processing

remember , just because your status was not updated on the portal, it means nothing, not everyone and not every action gets an update on there, it’s just strange 🤷🏻‍♀️

and also, hustle, relax, breathe… you are halfway there 🤗

oh and plz do not do drugs, not even marijuana… that will make u inadmissible on the medical. someone here has this issue just a few days ago. Drink soju (responsibly), it’s great, chills you out lol 😂

I know marijuana is legal in some states but it is still illegal at federal level!!

Hi fam! Does everyone gets prima facia? Considering I’m in NJ, will I have use of it to take health insurance or any housing assistance if I get it? Good news is my check got cashed so I’m now waiting for the receipts.

    Not everyone gets the PF

I did not get it, was approved

did you already file a 485 before 360? If so do you have your SSN and work permit? If you do, you can use that to apply for government assistance and get medical insurance.

Hi @Demise and others who have been through the green card process, question about I-693 medicals. I am waiting on I-485 processing, VAWA was approved in November 2021. I submitted a congressional inquiry recently, the senator's office responded to me last week that my I485 file has already reached the Saint Louis field office. I did not submit the medicals at the time of filing I-485, and I am debating now if I should get my medicals done and send these to USCIS Saint Louis field office, before I get an I693 deficiency notice or an RFE for medicals. What do you think? The hope is that this helps get my I485 adjudicated faster.

Secondly, is there any benefit to filing an "out of normal processing time" request for the I485? My I485 is technically out of the normal processing time for the St. Louis office, I filed I485 in Feb 2020. Any ideas would be greatly appreciated.

DO- Start the out of processing inquiry, I got approved a week after I did the inquiry and was told to wait for them to schedule interview

DONT- get the medical done yet. Wait for them to ask for it in mail or to bring to interview. Presence or absence of I693 has little to no consequence for interview or approval expedition/speed

    hi everyone,

I am a September 2018 filer (I-360 and I-485). My I-360 is still pending and going through background checks.

Today I received an online update on my I-360 case saying "Expedite Request Denied". I am confused because I didn't request them to expedite my case. Every 2-3 months my congressman is sending them inquiries and the most recent one was sent on Feb 22nd.

Has anyone else experienced such thing? What could that be?

    Thank you!

Perhaps stop sending that many inquiries. 🤷🏻‍♀️ Seems like someone got irritated.

you are still within processing time so there is no point of congressman inquiry every 3 months. I know waiting sucks but patience

I do have lawyer she didn’t know about this email last time. As I said last time I got this email week before they scheduled my interview…so weird…

I did wait actually…go an email like 4 hours ago

Wait a bit more I suppose.

forward this to your lawyer, let them do their job.

I tell my lawyer EVERYTHING, forward all e-mails from USCIS to him and the paralegal.

This is a strange looking e-mail, I never got anything like this. Have you received this kind of a e-mail from USCIS before?

It’s not about the disease, it’s about being able to have DNA samples of every immigrant. Able to solve crimes relying on the samples on file.

They don’t keep that lol. You samples are sent to a lab by a uscis certified doctor. Lab uses what they need and discard the rest. What conspiracy theories are you listening to?! 🤣🤣🤣🤣

they do have the iris scan and fingerprints though but if you are in healthcare or deal with kids, everyone gives fingerprints there.

It maybe be possible. Truly speaking I don’t understand the need of USCIS asking for medicals if someone is living in the country for years. If the person has a contagious disease, it means the person has already spread that disease to many, so what the need of medicals in this case?. But I understand USCIS asking for medicals to someone who just recently came in here because they wanna protect that person to spread the disease.

Exactly what I think and found. I went to school here, same state NJ,  so obviously I am upto date with vaccinations. Plus your point about communicable diseases

    Hi Family!

After weeks of collecting whatever evidence I could of my bonafide marriage and abuse, I finally sent in my I-360, I-485, I-765, and I-131 last week to VSC along with a check with filing fee for I-485. it was very traumatic to write the whole personal statement. I hope I had pen down by emotions for the officer to understand. I also attached the police clearance and good moral certificates.

May I ask how much time it takes for check to be cashed? Because my check has not been cashed yet. I'm getting really anxious as to why. My previous EAD is still valid so I'm hoping new EAD comes soon in atleast 6-7 months if possible but I'm curious as to when will I receive the receipts of the above applications?

    Can somoone guide? Thank you!

dont stress, they are running very slow over this past year. Patience is going to be key from now, make it your mantra.

While you wait, Go back to thread #10 and start reading, there is so much information here. take notes and screen shots! This forum helped me get a grip and gave me a lot of info and ideas but you have to put in the work.

Question for @SJLN and others who got their green cards already: Did you receive an online case update when interview notice / medicals RFE was issued for your I485? Or did they just send a paper notice without any online update? My lawyer's office is my listed address for USCIS and I dont want to miss I485 interview / medicals RFE if they send a paper notice and its misplaced by the lawyers office staff.

Get the paralegal on your side! I keep in monthly to once in twice a month contact with my paralegal via e-mail. Care to ask her how she has been. I took her a small cookie packet or a pastry when I go pick up my EAD or something. Little things matter to show appreciation and they remember you personally rather than just a case.
