Daphne . reacted to dosoruguitas in Chances of having the interview waived
Thank you for your answer! We'd have to behave ourselves because our main love languages are physical touch and words of affirmation and that would be weird in an interview with a third person...

She also won’t be able to work. You will need to come up with a plan for health insurance, since she won’t be eligible for Medicare or Medicaid.

He doesn’t want you to leave, but does he also know in which position that puts you? Having to (unexpectedly) quit your job, not being able to work and leave the US until you have authorization? That could take a while.
I think that is A LOT to ask from somebody you’ve only been in a relationship with for a short time. Especially if you weren’t even intending to meet up with him during this trip?

That just seems like a long trip to the US without also planning to meet a boyfriend. I wish you good luck on your journey. If you apply to adjust status, remember that you cannot travel outside the US or work in any way inside the US without proper authority (Advance Parole and Employment Authorization Document). That could take 3 to 6 months. Good luck.

@Crazy CatI did not know I was gonna visit him as well... My initial plan was to visit my sister and return home. But we decided to meet when i was there..
would it have been better if i told the POE officer that i was also gonna visit my boyfriend? in that case it would have been better to do AOS? now it is risky and can be seen like i lied about my intention when i entered the country?
We are in a relationship for 7 months.

Daphne . reacted to emily2023 in Friend moving to USA with US citizen DH and US citizen baby on ESTA
My friend has decided to go to the USA with her American husband and baby on an ESTA (they were living abroad for years, baby born abroad), live with family while remote working for her current employer (not a US employer and money paid to overseas bank account), and on day 91 apply to adjust her status to a green card.
based on what i have read online, it is likely to succeed despite the fact that she would be overstaying on esta but it seems to have succeeded for many people as they are married to american citizens and in bona fide relationships and its difficult to establish intent to immigrate from the onset (as people say they are just visiting and then 'changed' their minds).
is this true, I can't quite get my head around this. Why doesn't everyone just do this and they wait 1-1.5 years for consular processing? I understand that by doing it this way, you give up all rights to appeal and if it goes wrong, you would be deported and banned from the USA.

Are you comfortable not being able to work, drive? Is your boyfriend able to support you on his salary alone? Food for thought...

Ties to your home country are a stable job, a family, property, business. Things like that.

Daphne . got a reaction from Sarah1261 in So naive about the CR1 Visa process
We had no joint bank account (still don’t), I was not added to any insurance or utility bill, we had nothing of that sort because I was still living in my home country and everything turned out okay. USCIS understands that couples who live in separate countries don’t have that type of evidence.

People who intentionally do this are not cool people, way too many of those on Reddit…

Time spent together is most important. You aren't expected to have joint things if your spouse lives in another country.

Daphne . reacted to OldUser in RFE: Removal of Conditions, Still Married but separated & Living apart & on good terms
I think your chances of getting this I-751 approved are pretty slim.
It's is very unusual to remain married if you do not live together as a married couple, do not plan living together as a married couple and don't have any romantic connection. I'm sorry if you find this question offending... Why are you still married? This is a question that an officer will have in their head. And most likely the answer in officer's head will be - married for immigration.
If you divorced in 2020 or 2021, you could have removed your conditions on your own. With evidence that you lived together etc it seemed realistic. But now it's much more complex situation.
You'd likely need to divorce and refile I-751 on your own. Your case will look very suspicious to USCIS.
Also, don't forget, since you're still married, you still may be liable for any debts your spouse accumulates. I just do no see a reason to remain married?

Daphne . got a reaction from VisaQuestions0115 in When can I apply for jobs?
I started applying for jobs about a month before I moved, because I knew that I would be able to attend a job interview (I moved pre-covid). Had a job interview 3 days after arriving in the US and started my job 2 weeks later.
