Did you make below the income guidance for current and last year or very close to the line?
No, i make above the income guidance currently/last year. It was just an issue on the whether to follow the new ruling or old rules

Sorry to hear about the delay. Good that they kept the pasport. Do you know if they also hold off on issuing visa to others inside the Tokyo embassy the same day too?
No i don't, I'm sorry i don't have an answer for you. It may be possible that you will get a different outcome than us

you guys received a 221g, did they require you to submit certain documents after? maybe they need for you to submit a joint sponsor if your income didn’t pass poverty guidelines.
Public charge rule is currently on hold tho’
The embassy had me upload a copy of my passport a few days before the interview, i also had her print out a copy of my passport just in case to take to the embassy. They did not mention needing an joint sponsor when she was taking her interview at the embassy

Thank you for updating us with this information.
What "guidance issue" are they referring to?
I'm referring to the recent court ruling concerning the public charge rules

I have read about a couple of denials concerning the new ruling. Well, good thing they kept your passport. Seems they will issue you a visa once this gets settled out. Did they mention anything on how soon might they adjudicate the visa?
No they did not give any timeline on that, just that they have no idea when this problem will be solved, and they hope it gets solved soon.

Wait what? They are denying all spousal visas now?
Possible with how the embassy doesn't know which guidance to follow by.

Here are some notes from our interview earlier today, She arrived at the embassy; did the standard procedures at the embassy. She arrived at the reception and the receptionist asked for her passport to file, then she went and got her number card (Number 007), and to be ready with her documents. She got called up three times to hand in documents, take finger prints and to take her interview. Total time at the embassy was ~1:30. After she was finished, she received an letter containing below, I'm entirely sure if our visa is ineligible due to the recent public charge ruling or just because of the pandemic. Her passport was not given back to her after the interview, it is giving me some hopefully it gets approved soon but I'm not holding my breath on it.
The questions she was asked:
1. Husband's name2. How we met
3. How do we see each other
4. How did i think when she sees me
5. Last time we met, where and when
6. Origin's of my last name
She also got explained to that her visa would not be approved due to new guidance isn't approved, and the interviewer had said that he hopes this problem is solved sooner rather than later, and our visa isn't approved because of this new guidance issue. Once there is an update, we will be contacted by the embassy but since there are also many pending visas, there might be a delay. (Couldn't edit original post)

Recieved an email on an update to our case, login to see what updated. Saw that NVC wants me to reupload a document because there was pages missing even though there blank (I thought i did not have to upload all pages even though they're blank. My supporting documents, now says accepted, it did not say that before. Should I re upload it and delay our case for another two months, or don't submit it because our status changed to "accepted"
-
Yeah hopefully they do accept the new i864

Does it say “rejected” on it or does it say “accepted”? I think the joint sponsor thing is usually a recommendation if they think your income is too low but I think that they should still accept the document so long as it’s filled out correctly? Especially if your income is over the guideline
It did say rejected, and they told me to resubmit I-864, I submitted I-864 EZ before
-
Has anyone's i864 been not accepted due to not meeting the minimum income requirements, when you definitely do meet them? NVC had messaged me that I may need a joint sponsor. My i864 was not accepted to this issue a couple of weeks ago, and had to resubmit a different i864. I'm also wondering if the NVC counts other household members in the household not counted on the i864.

Hi, was your last submission on 10/28?
No it wasn't, it was Nov 27th. (Fixed it on timeline)
6 minutes ago, wifidolly said:Yay. When did you submit your documents?
I had to submit my documents at separate times, the aos documents on 10/25 and the iv package by 11/27
18 minutes ago, Juliet57 said:I agree this thread has been very helpful but it's also making a lot of us to be really stressed
Let's all relax and wait, keep busy these days!
Sorry about that, I remember someone else in these NVC filers threads was also requested i864 even though they qualified for EZ.
I thought it was odd, hopefully it doesn't take too long for the resubmission

Finally, almost all documents accepted except for i864. NVC were saying I did not qualify for the EZ version, and having to resubmit the regular i864
