I just called the NVC to check on our case since we resubmitted on April 8th our "proof of domicile" per their request (everything else is already accepted) and was told that our case is pending review. The rep was really nice and confirmed that they received the "proof of domicile" document on April 8th and now is in queue to be review. She said the usual, that it takes up to 3 weeks to review.

     

    Fingers crossed!

    I will for sure update as soon as I hear back from them. This part of the process sucks but we are getting closer to the end!

I’m just wondering if the review according to the date we submitted or according to embassies where we will have interviews? Because if you resubmitted April 8, how come the April 15th got reviewed first? Not sure. 

    I know it’s crazy!

     

    My understanding the one that submitted on April 15th got his case expedited, so that’s the reason it got reviewed so fast, I think.

I read someone in here who initially submitted April 15th and got CC April 22. That’s only 7days for her. As for me, still waiting to be reviewed again since April 17th. 🙏🏽

     

    Haven’t heard from them yet. Hoping to hear back this week! It seems like the average is 2 to 3 weeks for them to review.  🙏🏽🤞🏽

    Shes got her interview scheduled with the Sydney consulate and its in 2 and a half weeks. She has just gotten an email from the consulate that says that they no longer accept a 1040 with the application. It says that they are required to submit a tax transcript.

     

    Do we need to get the transcript for the interview? We've already submitted the 1040s and they've been accepted by NVC so would we need to get the transcripts as well? 

    Yes, she will need to submit the actual transcripts. I was told by an NVC rep that the consulates no longer accept 1040s. 

     

    She can get the transcripts via fax by the IRS. She just needs to call them and they will fax it to her anywhere. They fax my 2017 transcripts to me here in Brazil (the trick is finding a fax machine lol). Or she can get them online. I was not able to get it online as I kept getting an error.     Here is the USCIS  law under "Use of Affidavit of Support", "Determination of Domicile"  paragraph "B": 

     

    "In the case of a sponsor who comes to the United States intending to establish his or her principal residence in the United States at the same time

    as the principal intending immigrant's arrival and application for admission at a port-of-entry, the sponsor shall be deemed

    to have established a domicile in the United States for purposes of this paragraph, unless the sponsor is also a permanent

    resident alien and the sponsor's own application for admission is denied and the sponsor leaves the United States under a

    removal order or as a result of the sponsor's withdrawal of the application for admission."

     

    As mentioned, our lawyers had me sing an affidavit explaining why we don't have a US address and then she loaded the entire USCIS law about "Use of Affidavit of Support" which included the paragraph above. 

     

    Keeping our fingers crossed that they will finally approve this last document! Good luck to you too!

They said my husband didn't earn enough, even though according to their guidelines, he does. So just waiting for his Dad to send through his form and documents so we can upload them.

     

    Then had to try and organize something to prove domicile as my husband is here in Australia with me, so it is difficult for us to prove it without him physically being in the USA. Managed to find a bank that allows you to open an account online, so we have done that and are including quotes for shipping containers and pet transport (we are taking our dog with us). Here's hoping thats enough!

     

    My sister in law and father in law are also doing the same visa application too. SIL didn't get any queries and got straight through to Case Complete and has just received her interview date at the Sydney Consulate for 7 May (took about 2 and a half weeks from CC to Interview date). FIL got asked for more proof of domicile so he has just re-submitted everything too.

     

    So we are on track but its been more than a year and counting!! I am so ready to move!

    We had the same issue with proof of domicile. As I currently live with my husband in Brazil I don’t yet have a US address. Our US lawyers told us not to worry about it and they completed an affidavit for me to sign explaining the situation, that we will secure a US address as soon as my husband immigrant visa is approved, etc (kinda hard to secure an apt lease not knowing when the immigrant visa is approve).

     

    The lawyers also attached the immigration law that explains that if the intending immigrant is arriving together and entering the US at the same time with the  petitioner then a proof of domicile is not needed. Our lawyers said that they have used this before with other clients and got approval.

     

    We resubmitted the “proof of domicile” affidavit with the immigration law stated above on April 8th and now waiting for them to review and hope we get CC (they already accepted all the other documents). 🙏🏽🤞🏽

    But didn’t you saved all the scanned documents somewhere before uploading them in the CEAC website? You should just be able to check them wherever you saved them before you uploaded them into the system.

     

    They should not change once you load them in the CEAC website.....

    Did you asked for it to be escalate it? When my case was under "administrative processing" I called after 3 weeks of being submitted and spoke with a supervisor and she was able to have it escalate it for review. A day later all of our documents were accepted and with a message to reload our "proof of domicile", which we did this past Monday April 8th.  Now waiting for that to get accepted so hopefully we finally get "case complete" soon!

    I hv submit documents of my  cousin uncle and aunt  as joint sponsor.

    Both are separatly.like first join Sponcer is my uncle n second is my aunt.. who are not living with us. 

    After reviewing my case ceac said add aunt's documents as household of uncle.. We did it (864A,other documents of her) 

     

    In next review they removed all the documents of my aunt ..

    And told us that add as household member n than submit.. 

     

     

     

    Now we don't want more complication. b.cz I already have add my mother's documents as my household member.. 

    So wanna remove my aunt 

    My uncle's documents are accepted... 

    My mother's documents also accepted 

     

     

    How can I remove it?????? 

    Wts the process????? 

     

    So sorry about the confusion. I recommend for you to call them and ask to talk to a supervisor and explain the situation. See what they recommend for you to do. But again, speak with a supervisor, most of the NVC reps are not too helpful.

    I first resubmitted on March 15th (tax transcript) and got a response yesterday April 8th with everything approved but now they asked for “proof of domicile”.

     

    Since my spouse and I live together in Brazil, our lawyers submitted yesterday April 8th a signed affidavit from me stating that we will have an address in the US before we move to the US. Our lawyers said that they have used this type of affidavit before on other clients to prove domicile and got approvals.

     

    BTW before we got a response from NVC yesterday I called them last Friday as it was 3 weeks since we resubmitted and I was told that our case was in “administrative processing”. I asked to speak with a supervisor, which I did and she went ahead and escalated our case. I believe it worked speaking to a supervisor as we got a response yesterday 🙂

His company is transferring us to Miami and will set up temporary housing until we find a permanent place (my husband's company will provide us the temporary housing address so we can submit it during our interview, we don't have that address yet). Our lawyers sent us an affidavit for me to sign stating that we will secure an address before we move to the US and also to explain the situation. She said that it would be sufficient to proof domicile (she has provided that before to other clients with no problem).

    3 weeks so may be I got approved within this time????? 

    From others that have received the same email like us and have been under “administrative processing” they have gotten responses from the NVC within 3 to 5 weeks.

     

    hope we get a response/approval soon!

    No update on my case yet. I called yesterday and spoke to a supervisor. I was told that my case is under “administrative processing” and that I just have to wait. That there is not a time frame when it will get approve.

     

    At this point I am just frustrated and trying to be positive but it’s so hard as I keep thinking about it.

    So I called the NVC this morning and I was told that the reason of the delay is because the NVC needs to remove the I-864A from our application as is not needed. The rep said that as soon as they remove it then they will review the other documents that were resubmitted (tax transcript, etc). 

     

    The rep said that she was going to put a note on our case and was going to escalate it to a supervisor. She tried to transfer me to one but they were all busy.

    I have. I resubmitted my tax transcript on March 15th and on March 27th I received an email saying there is an update on my CEAC but when I log in there are no messages and everything still shows "submitted". Today is exactly 3 weeks since we resubmitted.

     

    Hope to get an update today!
