    The same with the Morocco U.S. consulate, we can only send emails. The way I knew they received my documents is by calling the NVC customer service number. I asked them if they received my documents (name all your documents). And they said yes. The person who will answer the customer service line will not be able to see your documents but ask then if they can transfer you to someone who can see more information on your case. That’s what I always do. Hope this helps.

    Thanks for sharing. I have hired Jim as well he’s so instrumental in our journey and I am so happy I decided to go with him as well. He’s the best out there. My husband been in AP for one year and five months and due to our current pandemic I decided to go with Jim we now in the waiting phase June 20 will be out 60 days to hear back unless our time gets extended.     Hello everyone! After waiting over a year in AP, my husband has finally received his visa! Hamdullah! James Hacking at Hacking Law Practice has been incredible. If you guys have been waiting over a year in AP, I highly recommend filing a lawsuit. This has been one of the best decisions I’ve ever made. If you guys are interested, I suggest setting up a phone/Skype meeting first and then see if you want to proceed with the lawsuit. My total for the lawsuit for my case was $3100 flat fee. They also do payment plans. I am relieved and so happy to say that this nightmare has finally come to an end. Thank you VJ and friends for all your help! ❤️❤️❤️ If you guys have any questions, I still get notifications on my email from VJ. I’m happy to help as much as I can.

    October 31st, 2019- filed WOM lawsuit 

    November 25th, 2019- Husband scheduled to retake oath/fingerprints and was asked to redo medical, update police records 
     
    December 13th, 2019- Husband’s second “interview” but all he did was turn in updated documents and took his oath. After 15 mins of being in the consulate, the officer gave him a piece of paper confirming his visa approval.
     
    December 18th- Case status changed to “ISSUED”. 
     
    January 8th- Visa on hand! Husband could’ve gotten it earlier but the consulate said he didn’t pick up his passport at the location selected so they sent it back to the consulate. Truth is, they never reached out through text or phone like they said they would to tell him that his passport was at the drop off location.

    Alhumdelilah! Congratulations to you both. I am so happy to hear of your success and another success in the books for Jim dealing with the Casa Consulate.  There is hope and we should not give up.

    Congratulations!! How long did you wait before filing? And how long until after you filed the lawsuit, did you guys get approved for the Visa? 
     
    I also hired James Hacking recently and I’m hoping that everything works out.

    Just want to share that we got our visa only after applying for writ of mandamus. so if anyone is waiting for more than 6 months, file for it. There were people waiting as long as 22 months and we had waited 14 months before applying, but someone also applied as soon as 5 months and got the visa.

    Hi everyone I would like to share my husband's visa story.
    My husband was interviewed in Sept 2018 for his visa. The interview went great, CO was nice. She said she needs more time to process the case and give him 221g slip with administrative processing. Then the next day he got an email with questionnaire 
     
    6 months went by with no progess on the case. I talked with different lawyers that had experience in WOMs. I finally decided to go for a WOM after 6 months. I even payed the lawyer 50 percent of the fees to start the procedure. In between the time period I had sent a 2nd congressional inquiry in which I had not received a response for a week( isb embassy responds pretty fast to congress inquiries). So I got even more worried that they didnt even reply to the congresswoman. But literally one day after I paid the lawyer for a WOM, I got a respond from the congresswoman that the embassy replied and they are requesting for a medical. It was so weird. And btw I only paid the lawyer the WOM fees he didnt do anything on my case yet nor did he make any communication with the embassy. The embassy just decided to move my husband's case on its own. I was in shock and couldn't believe it. Exactly 2 weeks of submitting medical, my husband's visa was "issued". 
     
    So everyone, keep sending congress or senator inquiries. It helps. And for those who have been waiting for a really long time, just do a WOM. There is ntg to be afraid of if you have a valid case. Keeping you all in my prayers. Those 6 months felt like forever. I completely understand your pain.

    Whewww 😅 okay. Thank you so much! This makes me feel better. I already make enough to sponsor my husband and when I first signed the affidavit of support it already said that the applicant couldn’t receive government assistance. So I knew he wouldn’t qualify for public support. But I thought for some reason it meant that if the petitioner was also getting some public support, that they would deny the applicants visa. This is what scared me. But thank you for giving me a peace of mind. I will be talking with my lawyer soon about this so I can definitely ask him and post about it later for others who have questions. Thank you!!!

    There are different parts to this, Visa, AOS and citizenship there is so much to read about this on line and a mega thread here on VJ.  
     
    For the VISA you need to prove that you can financially support the beneficiary.  You have to show that your income is sufficient and if not it may be accepted to supply a joint sponsor.   There are cases on here recently that have faced denials  for public charge at the embassy.  
     
    Your insurance will not have any affect on the visa.  The benefit part comes into play once the beneficiary is here and they accept any public assistance.   Check on the type of benefit and state most programs for low cost/free insurance do not fall under this rule.  I don't completely understand all of the rules and regulations as I haven't been reading much on this topic.

    This is stated on USCIS's site last updated 10/02 that states only public benefits recieved directly or indirectly by the applicant are subjected to public charge. So if you have medicaid, as long as your the only one that recieves it and not your husband than you should be good to go. This is all just from what I gathered from my research, hope it helps.

    I just saw this on the news. I think it's for those who have immigrated here already and plan on obtaining a green card. If they are on government support of any kind and attempt to get a green card they could get deported unless they apply after becoming a U.S citizen. Also I dont think it effects the person getting the visa if their spouse who applied for them is on public support so as long as that person is a U.S citizen themselves. This is what I got from my research on this. I hope lawyers fighting against this bill win, it's just another ridiculous attempt to stop any sort of immigration, be it legal or illegal.

    Our ds260 was filled out in 2017 and it still has never reopened for us to update.   Even after a second interview they only requested the ds5535.   Our ds260 has still been untouched.

    It's hard for them to understand. Everyone who goes through AP for an extended time thinks they are being targeted. Just keep telling him since the changes of immigration that took place about 2 years ago, EVERYONE is in AP for some time.
    Majority of those who aren't are usually from a country that is allies with the US. With all the immigrant visas that are being requested, it has really backlogged the back ground and security checks. Also, being an Islamic country, there are lengthy name checks. My husband was in AP for a year then we got an email requesting a 2nd interview with me in attendance. Luckily, I had a trip planned to see him within a few months of the email so I was able to get an appointment for us. It was brutal. Most definitely a Stokes Interview. They separated us and tried to make me feel like he was using me for fraud. While one was doing that to me, another CO was trying to say I was using him too!!!! I left out of there ready to rip someone's head off and spit down their neck. 3 months later I still haven't heard any news with the embassy so I ended up getting my congressman's liason involved. Sure enough, we get an email requesting him to redo his medical exam, get new passport photos and resubmit the DS-260. He made a new appointment and turned in everything along with his passport. He will be arriving on October 10th. Its been a long and grueling 3 years, but finally he will be here AND he will have his 10 year greencard!!!!

    Quick update for giving hope.. My son got his visa issued Alhamdulillah
    Category F3
    Interview Feb 7, 2018
    Given 221g ticked with administrative process and DS5535 to my elder son who was doing software engineering at that time.. Didn't know exactly the red flags.. 
    We three members got visas after 9 months. 
    After this no update on my son, a case only when inquired.
    First update 10th July 2019second 15th and then got redo medical email at 17th 
    Medical submitted on July 23,
    Case updated on ceas on August 31
    Second update September  12
    Third update on September 18 with email for oath and fingerprints
    On September 19, done with second interview, VO said your case is completed and you will get visa in a week or two. 
    Status showed ISSUED on September 20, 2019..
    Passport collected on September 25.
    Will be traveling this Saturday Alhamdulillah.. 
    So guys keep praying and don't lose hope.. Wish you all get your visas soon.. Aameen
