    First, I'm sorry if I'm posting in the wrong section.

    It's IR1 visa category, husband’s case under administrative processing since 15 months. Filed writ of mandamus after 7 months of waiting and the embassy filed motion to dismiss.  The court received both parties responses on April but never ruled the case until now. Does that mean the case is denied or what has to be done?  Attorney says just keep waiting. Anyone has similar experience please share.

  2. Hello, can you answer my questions please.

    The case is an Ir1 visa category, the petitioner is the wife is a USC a women with special needs,  she receives section 8 assistance, the question is does she need to mention that in the NVC stage? If yes and she has not mentioned it and her husband already received his interview appointment what do they have to do now? (they have a joint sponsor).
    2- If the husband gets his visa is he allowed to live with his wife in section 8 housing while paying his rent portion or what he has to do? Because as I mentioned earlier that the wife is a person with a special needs so she can't give up this type of assistance.

    Thanks for your input and for making the March group, it gave me some hope when I knew there are already approved people there.

    Soon I will open a group once I apply and receive our Noa:) hopefully soon.

    As for how quick cases are processed, there does not seem to be any rhyme or reason for how quickly, or slowly cases are processed.

     

    Btw, i see you have created a timeline,  but there is no details/dates listed.   If you put the details of your case, the system here at visajourney can give you an estimate on when your case will be approved.

     

    Thanks for taking the time answering my questions. Yes I saw January's filers too but I mean it's not like k1 filers when you see group for every month.

    And for my timelines, I applied for k1 visa 3 years ago and was denied and now we are preparing our petition to apply for cr-1 visa.

    I wouldn't pay any attention to who has your file and when. I'm sure it's the same officer but USCIS likes to use language that is pretty much white washed so that you are still kept in the dark. I wish I could shed any more light but it's now a matter of waiting.

    Thanks for your valuable input @Greenbaum I thought receiving RFE comes after background check, also when I submitted online inquiry 32 days ago they said my file is being adjudicated and yesterday I sent a follow up email they responded with "your petition is assigned to an officer and under review. While we are unable to predict a specific date by which a decision will be renderedin your case, you will receive further correspondence in due course."

    Do you see any progress between the two responses? I don't know which comes first, in fact I was thinking my petition was already assigned to an officer whom issued RFE!

    I have an attorney, first she said we have to wait 30 days to inquire, after a month USCIS told her to wait 60 days to inquire, after the 60 days I submitted online inquiry and received an email saying my case is being adjudicated and I will hear something within 45 days. Today is 32 days since I submitted online inquiry. I talked to tier 2, first he was questioning me why I wanted to expedite my case (that was back on June) and then he said I will hear something end of December,  I don't believe him because I am already out of processing times so there is no need to wait for the end of December but I can't do anything. 

    Thanks for your words, I know you are trying to support us but sometimes reality is hard and we have to deal with it as it is.

Unless there is something like a visa ban or false information provided to USCIS they will either approve or issue an RFE. This is just a hurry up and wait game right now. Like Greenbaum said, there are many factors that lead to "delayed" approval. The petitioner and beneficiary both go through background checks and sometimes it takes longer for some than others. They are not grabbing cases ahead of you while yours collects dust on the shelf. Background checks can take a while and I'm pretty sure they begin these a month or 2 before your anticipated adjudicated date on your timeline. All that timeline is, is a guesstimate based on other people who have filled out their timelines. Many people on VJ also neglect to update their timelines which can skew the numbers. There are people from May and before that are still waiting on approvals. There are 2 websites now for USCIS and more often than not the "old" site is not updated. This is where casetracker apps pull their information from. When I pull up the old site it says my case was received on May 31 nothing about an approval. I was approved on December 4th and received my NOA2 on December 11th. If you have not registered on the new USCIS website I encourage you to do so. I received an email that my case was updated and on the new site it shows December 6th approval (even though NOA2 says Dec 4th). 

     

    Just be patient and it will come. We all want to be with our loved ones as soon as possible.

    What if I am a Feb filler and it's been 313 days since we filed? They issued rfe and received our response 90 days ago and still nothing.  It's not a matter of background check because they sent out RFE means they are done with background check.  At this time I hope to hear anything even denial better than wasting our life waiting for nothing . By the way,  none of us were married, have a child or any criminal record so .

    so after i called friday and the agent told me the system was down and call back which i did and the tier 2 agent never called me back. so i just called and the agent told me on december 6 my case was approved and a noticed was sent out. i told her i never got a text or email,and the online system still shows case was received she stated could be a lag in the updating system, but i will take good news any way it comes, i hope everyone gets good news soon god bless

    Congratulations! So happy for you,  your NOA2 should be in the mail in the next few days, and hope the rest of the journey would be as quick and successful as possible.

    @zahraa and @amy1411 bless both of you ladies...I know the wait time can be awful and some telling you to calm down is not what you want to hear because we've all been there and some are still going through it..Yes, it gets desperately frustrating and you have every right to feel the way you do..However to ease my mind, I kept myself busy during our wait time by picking up a part time job and making a trip to Lagos while our petition was still in process..It indeed helped a lot...If picking up a part time job or some sort of hobby to ease your mind while going through the USCIS phase, by all means to do so if you can...Our petition was sent out February 2017 and our petition was approved November 2017...I pray that both of your journeys end in praise...
