The visa became invalid as soon as your husband entered. Once the I-94 expires, you're correct, the NOA1 for AOS will be proof of authorized/ legal presence.

Though there could be delays, the notification generally arrives around a week after filing.

A couple of things to keep in mind. The K1 visa is a one-way, one-time visa that was invalidated by the CBP officer at your husband''s Port of Entry (POE) into the United States. His electronic Form I-94 is his document of legal presence in the US. If you haven't already, go to CPB website and print out his Form I-94, https://i94.cbp.dhs.gov/I94/#/home . That is why it is important to file for Adjustment of Status/Employment Authorization Document/ Advanced Parole (AOS/EAD/AP, I-485/I-765, I-131) as soon as possible after the alien fiance marries their US Citizen (USC) petitioner. Upon receipt of the AOS NOA1 (document of receipt of AOS petition), the alien spouse enters into another period of legal presence in the US, due to the filing of the AOS petition/awaiting adjudication.

I would encourage you to also concurrently file for AOS/EAD/AP. There are no extra fees associated with filing of EAD/AP apps, if done at the same time. See the "Special Instructions" tab on the USCIS AOS link, https://www.uscis.gov/i-485 . Due to the current  quite prolonged AOS processing times (up to 18 months at some local USCIS offices), the opportunity to work, or travel home (if needed), obtained through filing of the EAD/AP apps can be helpful. EAD/AP processing is currently taking 6-10 months. You should also attempt to obtain a SSN for your husband, a copy of the Marriage Certificate can be useful. Fill out Form SS-5 at the SSA online site, print it out and take it and requested documentation to apply at your local SSA office. Filled out examples of the common immigration forms is easily available on this site, go to the top of the forum page, tap on the Immigration Guides tab, click on the Example Forms tab, find the example form you need. Good luck on your immigration journey.

azuki reacted to DRKALEMAR in DENIED! USCIS never received RFE I-693 [merged threads]
Just wanted to say that we finally received our GREEN CARD and it's valid for 10 years.
BASICALLY, we were falsely denied our case because of an error on the USCIS part.

I found an excellent lawyer who appealed our case, still no respond, then we sent a mandamus basically threatening to file a lawsuit. In the interim, coincidentally I heard back (after a few months) from our congresswoman Caroline Maloney. She sent a letter along with 29 pages of evidence that we did indeed send appropriate documentation on time (early actually) to our house of congress.

Within 2+ weeks, we received an NOA and approval, and by 48 hours, the green card was in our mailbox.
Lesson learned here is to take pictures of everything, never give up and definitely get yourself a lawyer who hand delivers your appeals or paperwork. AND get your politicians involved.

azuki reacted to junkmart in Can I (the US citizen) apply for Medicaid while fiance has AOS?
From what I understand, you may use medicaid for yourself. Its not like cash assistance or housing assistance, from which your husband could derive a benefit. Medicaid applies just to you. Someone please correct me if I am wrong.

IMO, I don't see the risk in being uninsured if you qualify for medicaid.  You can apply for it when/if you need it, instead of applying now, unless you are talking about wanting to get preventative care, etc. If you find yourself in an emergency, you can apply for emergency medicaid. You may find a job that offers you insurance before you would actually even need use medicaid.

Sorry, just scrolled up to see that you had your parents' Affidavit of Support. You also have to have your own, mostly to show that you've filed taxes since you were in Japan. Did you also fill out an Affidavit of Support? Were you missing your tax documents or your mother's? Hopefully it's an easy fix to get, but you may want to make sure you have more than necessary just to cover your bases. I believe the documents said you could need to attach up to 3 years worth, and I did that no matter what out of fear, so they got my last 3 years of taxes in copy form.

    Useful info!  Thanks for sharing.

Here is the relevant part of the memo:

"A signature is valid even if the original signature is later photocopied, scanned, faxed, or similarly reproduced. Regardless of how it is transmitted to USCIS, the copy must be of an original document containing a handwritten, ink signature, unless regulations or the form instructions state otherwise. 3 USCIS will not accept signatures created by a typewriter, word processor, stamp, auto-pen, or similar device."

    A) Submit a copy of your birth certificate and a copy of your US-passport(biographical page only) to proof that you were born in the US.
    B) Fill it out but mention on a separate sheet that the child won't be applying with him right now.
    C) mark "Do not intend" because it is a Fiance visa. USCIS knows that you have to support your non US-fiance.
    D) Provide your W2, your latest tax return (2015 or 2016), a few pay stubs and a letter from your employer saying that your work for his company including your annual income, working hours per week, your job title and if you work part or full-time)
    E) see part 2, number 4 for example: He doesn't have a SSN yet so write down none. N/A means not available. Same goes for part 1, number 8 and 10: You as a US-citizen don't have any of those.
You husband will get his A-number when you receive NOA1 in the mail. Leave part 1, number 11 and 12 blank.

    A) No. The statement "If you are not a U.S. citizen based on your birth in the United States, or a non-citizen U.S. national based on your birth in American Samoa (including Swains Island), answer the following as appropriate:" excludes you from answering all part of 11 and 12,

    B) Name the child and details. This is biographic about your fiancé and not an application for a child's visa.

    C) See this VJ example form http://www.visajourney.com/examples/Form-I-134.pdf. It's a different version, but #11 is the same questions. That response has worked for many from the UK.

    D) Either is fine for London. They don't even require a tax return for an I-134. 100% sure of that. They have approved on an employer letter only. You may want to choose two proofs (2016 tax and letter), but it is not a huge deal at a London interview.

    E) N/A starts for "not applicable". If you have not read the instructions for filling out the I-134, you need to read and follow this;
"Answer all questions fully and accurately. If a question does not apply to you (for example, if you have never been married and the question asks “Provide the name of your current spouse”), type or print “N/A,” unless otherwise directed. If your answer to a question which requires a numeric response is zero or none (for example, “How many children do you have” or “How many times have you departed the United States”), type or print “None,” unless otherwise directed. "

A few tips I've picked-up to fast track things as I go through this process (K1 visa at Tokyo)...
    1) You can get your police report done with your NOA1 (no need to wait for NOA2)
    2) The Seibo International Catholic Hospital will let you schedule the medical once you get the NVC number over the phone (the other hospital won't let you).
    3) It looks like you can complete your DS-160 and schedule the interview with the Embassy before you get your NVC number.  In retrospect had I known this I would have scheduled the interview ~1.5 months after receiving my NOA2 (you can reschedule twice so you aren't taking much of a risk).

Just to clarify....are you sure they asked for proof of relationship in the RFE? I ask because this is not a requirement of the I-129F (they determine if the relationship is bona fide at the interview). They likely asked for evidence of meeting within the past 2 years and/or letters of intent to marry.

I would send them the copy of the birth certificate and all THE pages of the passport. I had all the pages of now my husband passport. yes, seems like a waste of money, but better give them EVERYTHING instead of getting another ref or rejection.

USCIS misplaces things all the time. The simplest is a copy of the bio pages from your passport, should have just done that to begin with.

often happens (since we are told not to staple, etc)that a document is misplaced by USCIS
they had an original of my marriage certificate and at NVC stage wanted it again
make sure it is labeled with your case number,  both names and both DOB's even though u send in the cover letter from them
