  1. Yes. But, you will have to file a waiver. Is everyone in the family not vaccinated for all vaccines or just the COVID vaccine? ETA Filing a waiver will add about 12 months to the process. Depending on country it will take about 18-24 months if no waiver is required.
  2. And now it is difficult to move back for other reasons. And you cannot even visit the US as a tourist until you file I407…
  3. The entry stamp from Jamaica? Okay. I understand. So, did you know your son’s husband in the 90s or did you meet him later? When did he move to the US? Were you married before he moved to the US? If you are married when did you get divorced? When did he get his LPR status and how long has he been an LPR? can he naturalize soon?
  4. This was for a second trip to the US? Not your first trip? can you give a timeline of what happened? I’ve never received a stamp in my passport when leaving the US. how many years ago did this happen?
  5. File I407. File I130. wait. While you wait decide if you want to a.) Have your husband move back to the US to secure a job. b.) Save money and have it in your bank account in Italy or move it to a bank account in the U.S. (helps with intent to reestablish domicile). Currently your husband will need to make $39,000 for a family of 4 or 3 times that in savings. Your assets do not need to be in the US. You just have to show you are able to access the money in the US.
  6. Generally only parents and spouses can be qualifying relatives IIRC. @Family do I get an A?
  7. I will never reveal my secrets! But, bookmarking interesting cases and also- I searched K3/UK timelines for this one. We have a few on VJ but not all have a story..:
  8. How did you son’s father become an LPR? Through your son? Through a marriage? How did your son become a USC?
  9. What was the misrep and what is your husband’s status in the US?
  10. Here is the Great Britain Case from 2022 You can see their timeline here: https://www.visajourney.com/timeline/profile.php?id=317334
  11. I got married day 4 during my vacation to the U.S. Left 3 weeks later. No issues. Also traveled to the U.S. as a tourist a few more times before I finally moved here.
  12. Do you always give the officer such a detailed reply? including what you plan to do when you return to your home country?
  13. What you’re missing is the I129F is used for K1 AND K3… so you’re talking about what’s happening with K1 speeding up not what is happening to K3s.
  14. Depends on the consulate. Where do you expect to interview?
  15. Countries with Similar Populations: January 2024 Belgium K1: 4 Belgium Spousal: 5 Dominican Republic K1: 228 D.R Spousal 459 Jordan K1: 33 Jordan Spousal:182 Size of population and number of interviews held doesn’t tell us anything about “refusal rate”… Netherlands has a much smaller population. K1 visa: 13 Spousal Visa:26 Tunisia K1: 11 Tunisia: 129 How can you tell which consulate is more successful? Can we say Belgium is more strict because less visas were issued? @curious_creek225 you clearly think you don’t have any issues even though lawyers, people on other forums, and members on VJ are telling you one visit will probably be a problem. I hope you are correct. And wish you all the luck.
  16. Here is a great guide by one of our members @seekingthetruth
  17. Nope! Consulate. They submitted the waiver 1 week before interview and it was approved. Link here:
  18. @curious_creek225 115 visas issued in London in January 2024!
  19. Another member on the forum filed the waiver before interview. And IIRC it was approved a year later. I’ll see if I can find the post.
  20. I believe you have 4 months from date of NOA 2 approval to make an appointment. You can make an appointment AFTER the 4 months. If you can’t find an appointment you should write to the consulate to see about extension… but you might not have to communicate with them depending on the consulate.
  21. @curious_creek225 For January 2024. Tunisia Spousal Visas: 129 Tunisia K1: 11 Nigeria Spousal: 197 Nigeria K1: 67 Philippines Spousal: 90 Philippines K1: 773 Why would you think Tunis has a high approval rate? 36 K visas were issued to Tunisians in 2023. Compare that to the 502 from Nigeria. compare that to the 3402 in Philippines. 19825 total K1 visas were issued in 2023. You can see the K1 is more common in Philippines but the Spousal visa is more common for Nigeria and Tunisia.
  22. You forget the other red flag is you are from a high fraud country. So 2 red flags. Even couples from “low fraud” countries like Philippines have their K1 denied if the CO believes they did. not see each other enough. It won’t be an instant denial. A couple of things might happen: 1. CO asks for additional evidence of relationship- like your text messages or maybe text messages between you and her family or her and your family. Then you go for another interview and you are questioned about the contents of the messages… 2. CO sits on your case and the K1 “expires”. This is a test to see if you will file again or get married or break up… 3. Because CO believes you are both genuine you receive the visa… How many of these red flags do you think your relationship has? https://shorelineimmigration.com/family-immigration/5-reasons-for-k-1-visa-denial/
  23. Don’t do anything until the I130 is approved. You will update everything when it gets to the NVC. Think about it this way: I130s are for various family relationships. It’s about verifying a visa can be issued. People could theoretically move 3 or 4 times while the petition is pending (e.g. siblings of USCs). NVC has instructions on how to change the consulate location if it is the wrong one… None of her paperwork will go to the actual consulate until they accept all her documentation and they have an interview slot for her- this could take 1-6 months depending on various factors. Probably closer to 1-3 months for you because you are in Germany.
  24. You can’t change anything until the I130 is approved. It doesn’t matter which consulate you chose- it will probably be the consulate associated with your wife’s most recent address on I130- after it moves from USCIS (where it is now) to NVC (where the visa process will begin) you can update your wife’s information and where you want to email. you will receive a DIFFERENT case number at NVC the first three letters will indicate the consulate your wife is scheduled to interview.
