    Immigration wise, make sure to be honest with USCIS about living arrengements etc. They'd understand if a couple had a rough patch, but won't accept hiding facts or misleading information on forms / during interview.

    I appreciate your concern, it's been hard and sad to see how a person changes when has so much control over you, and being so afraid to lose everything put me on a tough situation now.
     
    I'm in NYC and to be eligible for divorce you need to be separated for a year. I'm struggling to find an immigration lawyer and a family lawyer because I don't want to get scamed or misrepresented and get a denial. If anyone can help me finding a family lawyer and/or immigration lawyer or firm that is legit and good I will very much appreciate

    NY says separated (not living together ) is not the same as legal separation
    which is what u need 
    if u or spouse has not filed for a legal separation ,  do so ASAP
    the year will start when this is filed with the court

    Hi @Fer Schvarztman
    I'm sorry you're going through separation and heading towards divorce.
    You don't want to wait for the ROC interview. You may be approved for 10 year GC without interview.
    If this happens, you could have big problems at later stage, during naturalization. You may be accused of fraud or misrepresentation.
    You need to file for divorce and convert your petition to divorce waiver by notifying USCIS.
    How long a typical divorce would take in your state? Did you consult a family lawyer?

    Thanks!, yes that's the best thing to do, in every instance of this process we have sent a lot of proof, as much as possible, to a point that at the interview the rep told me with a smile, " you're over prepared" and told me to send a lot of the proofs for the ROC so, will add everything I have until the day of Shipping.

    Try to overwhelm them with evidence. The heavier the stack of papers (Evidence relevant to the marriage), higher the chance of no-interview approval.

    I want to make sure I keep this thread alive for the few that will be lagging behind us.

    Here are some things we included in our packet that were unusual because we had unusual things happening:
    We included a letter from my mom stating that we don't have mortgage, lease, utility bills, etc. because there is no mortgage/lease on the house, and utilities are in my dad's name.  She confirmed we live together at the XXX address with my parents because we assist them in their everyday lives because of their age and ailments and she explained that we assist in paying the bills. We had issues with our original bank account and, thus, could not provide them with a lot of bank statements, so we included what we had and then included all of the ones for the new account created earlier in 2022.  We also included a letter explaining the why we were missing statements. Because we knew the abovementioned was "weaker" than the average person, we planned to have wills created and executed. We had very strong evidence regarding health insurance, life insurance, driver's licenses, etc. We also bought a car together so that also helped with financial comingling.

    Sunday, November 13, 2022 
    Is the earliest you could have filed for ROC. Its recommended that you give 2-3 day window just to avoid that rejection notice.
     
    Remember there is a difference b/w Rejection and Denied. 
     
    You can file for it today if you wanted but def do so before your GC expiry date.

    Congrats on the baby!  I think we said so before, but just in case.  Our window opens up in September too, so we will probably be mailing it around the same time as you! 😀

    We actually have some things that will be different because our scenario is a bit different than most people when it comes to bills, etc.  However, I will be sharing that here so others can use us as an example.

    Hello!

    Long time no see!  So, I thought I would start a thread for those that are from Argentina going through the process of the ROC in 2022 based on a green card through marriage.

    To begin, here is the general guide at VJ:

    Now, this is only a preliminary list, but I wanted to start something so we can get the discussion flowing.
     
    Evidence:
    -IDs
    -Bills
    -Statements
    -Insurance
    -Deeds
    -Leases
    -Birth certificate of children (if applicable)
    -Proof of traveling together
    -Photos

    Remember:  The idea is to prove that you have cohabitation (living in the same address) and comingling financially (you have merged your finances both liabilities and assets).
     
    **Please note it gets much more detailed, I am only providing a simple general list so we can get some starting points.**

    I will soon share a typed up letter of what the cover should bee based on some other ones I have seen here.

    We actually need to submit the packet in October 2022, so we will need to get the paperwork together by summer, but I am starting to read upon what is needed so I can get organized. Our rep told us we had lots of evidence, which was good. Like you, we were over-prepared. She did tell us that because we had an interview for the GC there was a high chance of not having one for ROC, especially with the evidence. She did emphasize, though, that it was all about the pictures because it is what shows the “organic” and true side of a relationship, which is why she appreciated we had an album. I think they will look at progress, yes, like how it has developed. But, with COVID, I think they are aware that economic stability might look different for this season than in a pre-covid world, so I will submit all that we have and pray for the best.
     
    I might start the ROC thread this week if someone doesn’t get to it first.

    Congratulations to you too and everyone!! Yes, long time no see. I got my conditional residency last year, I will have the last interview to remove conditions on February 2023. What about you guys?. I took vacations of paperwork last year, so I don't know if there is a thread created already. Now it's time to start organizing pictures, proofs and everything for it.
     
    The USCIS rep told me in the interview I was overprepared in a good way, most of the Affidavit of support of my sponsor and husband was not required last time, but he said that the last interview will be more related to our economic stability and any personal highlight like, moving/buying a house/being promoted/kids/experiences, but most of all, money related. That starting to get things done 3 months prior the interview it's enough, but...I dedicated more time and effort all this long so I'm not gonna leave everything for the last minute right now at almost the end of this process. (I considered it done when we all get our citizenship)
