@dandk wow 😂 8 to 10 years for a petty disorderly person offense ? Are you sure ? Show me where did you read this very interesting info lol please go read about USCIS laws before giving false informations.

@Alabamak1 can you please go read more about USCIS laws before you give any advice? My charge is not a CIMT which means it does not affect naturalization, in the worst case scenario I will have to wait 3 years before applying because i am married to US citizen.

@Amadia it was a silly mistake that will never ever happen again. Everybody does mistakes we are not perfect, the good is that I learned my lesson. Thanks anyway.

@turkishdelight Thank you so much. Yes I am here to get other opinions but some people try to judge and some of them try to scare me even if they don’t know anything about the law.

Yes my attorney is also saying this charge should not affect me as long as it’s the only one and I shouldn’t do any silly mistake again (which I will never do again). So let’s see I will definitely come back here and give an update

@Going through So if I go ahead and apply citizenship and if they deny it for this reason they are not going to deny I-751 as well, if so then I don’t mind losing the money for citizenship application I can go ahead and file once I am eligible and take the chance..

@Going through Yes you are right, and specially that I just applied to remove conditions from my conditional GC last week and the process is gonna take up to 18 months. My attorney said she can apply for my citizenship next may but I am worried because if they deny my citizenship application and if I still don’t have 10 years green card in hand they may deny that also and deport me that’s what I heard but not show how true this information is.

so maybe I should wait at least till I get 10 years green card so that even if n-400 get denied I will be having a valid GC in hand.

@Jaquelly I know what you are saying that’s why we reduced the charges to petty disorderly person offense which is not a crime of moral turpitude, and I saw people in this website getting their citizenship with theft charges, that’s why I posted so that they can help me with this process. Thank you anyway for your time.

Hello please I need your help.

i got arrested 2 months back for shoplifting and last week in court my attorney was able to reduce the charge to petty disorderly person offense which carries a possible jail time of 30 days. I didn’t spend any jail time because it’s my first offense. And no probation I just paid a fine. Now my charge is not a crime of moral turpitude anymore.. and next may I will be eligible for citizenship, do you think I should go ahead and apply or I will be denied because of this petty disorderly person offense on my record. PLEASE HELP !

i applied for I-751 to remove conditions from my conditional green card last week. But I have a problem, I got arrested 2 months back for shoplifting and when I went to the court my attorney was able to reduce charges to petty disorderly person offense which carries a possible jail sentence of 30 days but I didn’t spend any jail time because it’s my first offense. And I am not on probation either. I just paid a fine of around 400$.

me and my husband are happily married and we have 2 little kids. Now my question is, can I still get 10 years green card with this petty disorderly person offense or no?

and next may I will be eligible for citizenship, should I go ahead and apply or I have to show 3 years of good moral character even though my charge is not a crime of moral turpitude.

I am filing next month to remove conditions from my 2 yo green card. But 2 weeks back I did a very stupid thing. I got arrested for shoplifting, it is less than 100$ which is a petty theft in my state. Now my criminal attorney is saying he will get me the conditional dismissal which is like I should be on probation for one year then Case will get dismissed. But I have to file now the I 751 form.

my questions are : is the court gonna give me any paper that says I am on probation and after a year it’s gonna get dismissed if I behave good?

and do you think my green card will get approved even if I am having this petty theft on my record?

please anybody who can advice me because I am so worried. I am happily married to USC and my 2 kids are citizens as well. 

Hello everybody.

Last week I got arrested for shoplifting 79$ worth of items in a retail store. I'm still waiting to go to court and I'm taking the attorney with me. I heard this is a Petty theft as long as it is less than 200$. Even though it is a crime of moral turpitude. Now I have to file the I 751 to remove conditions from my 2 years green card. But I am so scared that they may deny it because of this. I already discussed with an immigration attorney she said not to worry but I want to know did any of you experienced this or know somebody in this situation. I don't want to get deported I know I did a huge mistake but I don't want to be away from my husband and my 2 little kids. Please help!!!
