  1. SSN office remains closed. I still have not apply for my minor child. I called them and was told I need to send original copies of her birth certificate, the 797 and green card. Only originals, through mail and they can process and then mail me back with her SSN. I do not feel safe in case the originals get lost somewhere.

Anyone managed to apply other way through AOS for minors recently?

I was advised by my lawyer that minor can’t go I765, I now know I actually can, but it’s too late now. If I have done so, the application is SSN would be automatically sent. Too late now. Any other way?

For 25 I would put yes, then in 26 explain exactly what happened in full detail.  You could include a copy of the case as proof.  Be honest, you were cited and charged if you went to court.

Agree with that. We did yes for 25 and wrote all our tickets and court documents on that. The one that went to court was also a traffic violation that also ending up in an accident. Husband was judged and fined.

  3. Can you ask your lawyer about it? The way I interpret it - if it is dismissed, it is not a crime. The best bet is to talk to you lawyer. It can be quite tricky the uscis officer may interpret your case. Ask and be sure of your right before you fill that in. I remember our lawyer told us before, anything $500 fine and below with no sentence is not a big deal. I had a traffic ticket and my husband has 2 or 3 (one went to court) tickets. We did not have any issue or RFE due to that.

    • You'll want to got to the SSA office and get new cards once your AOS is approved (as a permanent resident, your card won't have any restricting language), but there's no major urgency about it. The number will remain the same.
    • You probably could have filed for an EAD for your kids (yes, it's weird) to get an SSN for them; in normal times, I'd think you were probably close enough to AOS approval to not bother, but that might not be the case right now. Otherwise, go to an SSA office once their AOS is complete (and SSA offices are open) to apply for an SSN (and get cards) for them.

Thanks! We are heading over to SSA office soon. As for EAD for minors, i was advised by the lawyer minors need to be over certain age to apply. Ours is young.

    Congrats!!

how much time did it take for your card to get printed and mailed to you after having "card is being produced" status?

I can’t tell for the GC yet. We are still waiting. Our previous experience with cards, they came within 2 weeks most time. Once, husband’s EAD got lost in the Usps mail. Tracking said delivered but it was never in our mailbox. We reapplied first it.

  6. So, we just have our (AOS)permanent residency approved. The adults have our SSNs when we have I765 approved, but they were indicated 'for work use' only. The minors do not have SSN. Do we, adults have to update our SSNs and apply new ones for the minors? Or will this be an automatic process to just wait for them in the mail.

  7. I updated our AR-11 and 2 days later, our status were updated to "Cards are being produced" and "Your case is approved". We just received our 797 in our new address, the USCIS updated the new address the same day we applied. I also informed the new residents of the old address to help us receive any mails from USCIs so we would not worry about losing any important document.

Our interview was scheduled for March 27th and it was cancelled March 19th. Still our status shows 'waiting to schedule interview'. I'm hoping that soon something will move and we'll be able to move on.

    Congrats on your case :)

Wish you get through soon. It came as a surprised. My husband moved to CA for a new job just 2 weeks and we remain here in GA. I was still getting nervous about where the interview would be. For one who hardly win any lucky draw, guess we do get lucky sometimes.

What kind of supporting documents did you send? just curious because i wasn't able to send much. other than  what i found on VJ that was necessary.  Congratulations tho!!

    Thanks for the congrats.

For I-485, check out this checklist here https://www.uscis.gov/i-485Checklist

I can't tell you for sure. Every individual is difference. I know it was A TON for us. From the children's home country school records (to prove we fulfill our previous obligation of J-visa), to traffic tickets, to our immigration records etc. We have a lawyer who helped us though every step and provided our complete checklist of items.

  11. We were consulting with a lawyer (without company sponsorship) between filing an EB-1 or EB-2 NIW. Our lawyer suggested EB-2 NIW. Reason being that it is easier to get through than EB-1. My husband has a PhD (from a US University) and won some prizes but his amount of publications was not impressive (<15). The lawyer said we could go for it but it is a safer bet for EB-2 NIW. We took 3-5 months to prepare all the documents with the help of the lawyer and got all references. Started in late Oct 2018 and filed I-140 on Feb 2019. I-140 was approved in Sept 2019 and we proceed to file I-485 in Oct 2019. We just got our I-485 approved. No RFE and no interview for us.

There are some lawyers who give you free consultations to tell you what they prefer. No obligation at all. We spoke to 2 before we decided on EB-2 NIW and who to use. I suggest you contact them for some ideas. If you need contact/recommendations, let me know. Our lawyer package for I-140 was "Approved or refund".

  12. Received an update on our I485s this morning. Our interview was cancelled in Mar 2020 and thought it will be awhile to wait for the interview to be scheduled again. With this new update, does it mean out GCs are approved without interview?

That said, I don't foresee any issue in the OP's case. Nothing implies fraud based on the (limited) information available in their post history. The marriage was also reviewed previously to qualify for the H-4 visa.

I would not expect the temporary living situation to be a big concern, other than possibly in travel arrangements.

I'm just pointing out that just because it's not an LPR or USC petitioning for a spouse does not mean that the bona fide of the marriage don't matter. They do.

Sure Bona Fide. No fraud here. Crazy household schedule with busy teens and kids. Trying to juggle everyone's priorities.

  14. Update : I asked our lawyer and received reply. She said it could be one way or the other now. Husband will update his CA address and we will continue to use GA address. According to lawyer, we may be interviewed separately, in CA & GA separately. Or, we may have to fly over or him to fly back. The change of state will result in a slight delay for the interview plan but will not 'reset'. Lawyer does not think it will affect adversely since it is because of a new job and we have other family needs. GA and CA are in both ends of US, frequent travel can take quite a toll on our pockets. Driving to and fro (40hr)is not an option for frequent travelling.

Thank you also for all well-intended suggestions. Moving to CA within such short notice is not feasible for one or 2 of our family members right now.

Is the whole family adjusting status or just you and kids? I imagine you are moving with your husband next month? If so you need to update your address otherwise your interview will of course be scheduled in GA.

Almost entire family, except kids who were born here. I am planning on staying here with the kids till they finish up school. He moves alone for job.

  16. We are living in metro Atlanta area, married for 22 years, with kids (2 teenagers). Husband has a job offer in California but kids want to finish up high school here. We were suppose to have our interview scheduled in Feb but Covid hit. And husband needs to move next month for new job. So, will that affect our AOS? If we are called for interview, will it be here or there?

Edit to add : Husband on H1-B and we are his dependents.

Good to hear. I have my EAD/AP card in hand now. No SSN, however call USCIS and they told there was a slight delay due to the SSN details needing to be verified. SSN has been approved and should be issued today.

My AOS has my two children linked and one of them needed a second biometrics appointment as the fingerprints could not be processed. I think this is keeping my packet at NBC so not yet scheduled.

I already SSN because of my EAD yons ago. I also have 2 kids linked to me. One of them is 18, she also has her EAD approved, all of us have 131 approved. Just waiting on the interview. Guess that is delayed with the craziness everywhere.
