    So how do we make sure we get back the right amount on the tax return? and does it count the whole tax year or from our marriage date or when does the lower tax bracket kick in?

    The resident alien aspect only plays a role when filing federal income taxes. That will apply for the entire tax year if filing jointly.

    Hmm ok but I guess what I am asking could she have submitted the W4 the day after we got married? or is it based off of when I count as a resident alien? in that case she could've only changed it in late June.

    Thank you!  Does the change count from the date we got married or from the date when I am a resident alien? I don't pass the green card test but I have been here for more than 180days in 2019 now. 

  4. So I just moved to the US on dec 30th last year and am currently waiting for my work permit and green card. As I understand it my spouse should be paying a significantly lower percentage in federal income tax since we got married in February. But how do we go about to make that happen? is it best to just let things be as they are and then file together for the whole year and get a large tax refund? or can we somehow change this now during the current tax year so she gets to keep more of every paycheck instead?

    I'm in exactly the same situation as you and my date is March 19th. When I checked earlier today they counted anything before March 9th as out of normal processing times so hopefully we can send in our inquiries in 10 days or so. 

  6. So glad I made this post so half of you could get on your high horses and yet again say what an idiot someone is :) seems to be the thing to do around here. 

     

    I am not in any way saying that the system is unfair or that I couldn't have looked up every processing time and detail beforehand but I still think that it is an incredibly dumb and inefficient system. It isn't good for society as a whole or for the individual but it is what it is I guess.

    We have our whole families coming over for a large wedding in February, we aren't just waiting for no reason.

    Of course it costs, I could be working, creating value and paying taxes and be a productive member of society.

    Instead I have to sit here completely idle, there's a huge loss there for both the individual and society as a whole.

  9. I just came to the US three days ago, December 30th on a K1 visa and I of course wanna be able to start applying to jobs as soon as possible.

    We have set our wedding date to February 16th. 

     

    With my K-1 folder I got a pink piece of paper with info about entering the US and it said that I could file a I-765 form to be able to work right away but now that I look into it a lot of websites are saying that the processing often takes 45-90 days so I wouldn't get it until likely after our marriage in February anyway. 

     

    Are there any benefits to filing the I-765 right now or should I just wait until we're married??
