sharpie11 reacted to Redro in First year filing basic question
Yes. You can and should file MFJ.
Question:
Does she have any bank accounts overseas?
If the amount of all her overseas bank accounts is over $10 000 she needs to report it on your taxes AND she needs to file FBARS.
If she has no income and no assets just file as if she was an American housewife with no job/income here... MFJ same rules apply.

sharpie11 reacted to Redro in First year filing basic question
Just file the taxes as if she was In the US for the entire year.
If she had income she needed to exclude she would file form 2555.
Simple explanation: Wife was in the US December 31, 2023 as a green card holder so she needs to file taxes.

Not a problem.
yes .. all together. As petitioner, you must either already be in the US or enter at the same time as the beneficiaries

That is the usual choice yes .. but you can ask for directions .. some POE have specific booths for immigrants .. or lines they prefer immigrants to go through .. rarely signposted

There's nothing that you've mentioned that needs declaration...Quit worrying.
You only mention cash above $10K

It took 3 weeks to receive passports for both my children in India at the U.S Consulate.

Passports - U.S. Embassy & Consulates in India (usembassy.gov)
The processing time for routine passport renewals in India is 4-5 weeks. If you are traveling within the next 2 weeks, please click here for further information.

Of
Plenty of time to renew a US passport. Passport renewals to be started when the passport has just 6 months of validity. Apply Monday to renew.

sharpie11 reacted to Mike E in IR1 travel issue due to expired passport of child
That is for U.S. citizens cannot renew at a U.S. embassy.

Renew passport at US consulate is quicker, usually took 4-5 weeks. 10-13 weeks is the routine for people apply/renew their passport within the USA, so you have more than enough time.

Yep. I suspect the OP was reading about state-side passport renewal times...which are horrendous.

Ok, got it so when we apply at a US consulate in India, it should take only 3-4 weeks as the consulate website says ? I was always under the impression that even if we applied at the consulate passports were renewed in the US by the same process as all other passport renewals applied stateside and mailed to the consulate who then forwarded the passport to us..

I may be wrong, but I think that in Mumbai, you cannot actually be present for the interview. Being nearby shows support, but depending on actual circumstances of your case, may not matter.

It shows you are supporting the process if you go with your spouse and stepchildren but some embassies don’t allow you to enter the building so you might have to wait outside. Personal choice: but I really appreciated my husband attending the interview with me.

sharpie11 reacted to JeanneAdil in Stepchild interview questions
she can refer to u as dad , my stepdad, or by your name
not a big issue
she should have the original documents listed in interview letter
chats and cards not important here
its relationship and income , birth and supporting documents

sharpie11 got a reaction from JeanneAdil in Uploading documents to CEAC before interview
Yes I will make sure she will have it all on time. There have been some major changes since my salary has increased and company name has changed. Also have provided her the latest tax transcripts as well. Thank you !

sharpie11 reacted to JeanneAdil in Uploading documents to CEAC before interview
If there are major changes in the I 864 and the joint sponsor's, then yes, she needs it
hope you can get it to her ontime
she needs current income and most recent tax returns (2022)

sharpie11 reacted to Mike E in Minor changes in DS-260 - request reopen ?
I would do this. I would prepare a new I-864 if the petitioner lives in the U.S. and earns enough money.

sharpie11 reacted to pushbrk in I-864 part 7 using assets if had no income in past years
You "can", but you need not. Frankly though, if you have these assets one or two savings or investment accounts, I would go ahead and state and document them on your I-864. Those things ARE simple.

You will probably receive a message from NVC stating they cannot determine if you are qualified to sponsor and they will suggest a joint sponsor but the CO will make the final decision. This is a message everyone who did not make enough on the previous year's taxes receives. As long as you get a Documentarily Qualified message you are good to go and they will schedule your partner for an interview.
You can then complete an additional I-864 with assets for your partner to take to interview in case they request a joint sponsor. But, you should be fine.

sharpie11 reacted to Mike E in I-864 part 7 using assets if had no income in past years
If this is a w-2 job, I would not.
Your projected gross income for next 365 days is your current income and current income is what matters the most.
NVC and COs want simple I-864s.
They have been known to reject multi millionaire real estate investors with no taxable income (due to all the tax deductions real estate has) despite 6 figure cash flow and instead accept an I-864 with w-2 based 40,000 gross income. There is no logic to these decisions.
Hoard your cash, and when your liquid US based assets reach 3x of 125 pct of poverty threshold, prepare a separate I-864 that includes assets, and keep it handy for the interview if the CO demands a joint sponsor.

I would submit at least a current statement. Bear in mind this is a judgment call. Make it easy for them. It's not about "have to".
