We had the similar issue, my wife's income the year before we filed was lower than what was required but her current income was well above it. I was told my a immigration officer they use the previous year tax returns as if you also have student loans etc then your adjusted income will be considered less then the one on your paystubs.
In the end we just got a cosponsor.

Yep, just got to go over some small things with our tax person about the form 2555 and it should be done as the wording seems to be aimed at an American citizen

We had a look at it both ways and if we do file jointly we get an exfra return just a lot more complicated but nothing we can't handle

First we will be getting this all looked over by a tax preparer but wanted to see how other people have gone about it as I see a lot of people who moved to California on here from the UK
I moved to America in July using the K1 visa got married and applied for the AOS and EAD which I got January 24th and my AOS interview is in a month
I worked in the UK jan-June 2018 but have not worked in USA due to not having my EAD until last week
Do we have to file a joint claim and then write off my UK income using the form 2555
How have everyone else done this

I called them and they told me they do go off your previous years tax return not your current year

OK we got the notice and says my wife doesn't meet the poverty deadline
Last year she didn't but this year she will
Do they base it off of last year or the current year as she is already over the 125% of $20600
Also they say they want the w2s 1099 and the 2555 forms
We already sent in the w2s so are confused

I checked the uscis website and it now says form I-485 Request for Initial Evidence Was Mailed
What does this actually mean as we thought we included everything in our packet so this is confusing to us

we managed to get the bank account all sorted we just provided proof of identity my UK passport my ss card and a noa1 letter with my USA address for proof of address
i will call the dmv hotline and see what they have to say about everything as you all make valid points and I currently don’t need to drive here but will when I get my ead most likely so would like to get it all sorted sooner than later

On my wife’s policy we only had like three weeks and it took us longer to get our marriage certificate and my ssn so will look into my own policy and is this a legal requirement for the AOS
That’s what we are going to do today go to other banks and see what we can do
i spoke to the dmv and they said I need my green card and how do you drive here with the international permit as you need insurance and again they needed a state id

I’ve recently moved to California from England on a k1 visa we got got married it was amazing and perfect now it’s time to set everything up but I keep hitting hurdles
ive applied for AOS and my EAD and I have my SSN
we tried to get my driving license but can’t until I get my AOS even though I’ve held my UK one for 12 years
tried to get added to my wife’s bank and can’t without USA government id
the health insurance was the same and out of season or something like that
what have other people done or any advice would be grateful

@Chrisunknown don't mean to lecture you, but would be a good idea to be on top of the amount of paperwork you need to be already informed of and the process of. It can be challenging to be doing stuff for immigration last minute. I am going from the idea your wife (asuming she is USC) knows more than you about the process. If anything, VJ is a good nightcap read and be informed of what can, will or might go wrong in the whole immigration process.
It’s not that I don’t know a lot the issue is so many things on here give you contradicting information so isn’t it best to ask to see what others did more recently to help with my case rather then make mistakes.

No we haven’t applied for the ssn I thought you do that with these forms as one of the boxes asks if you want too

No we haven’t do you have to do that one or is it just if you plan to travel abroad

We are going throuhh the process of adjusting my status and going to be sending the forms off for me to work along with it.
We got married July 20th and got all the paperwork we needed today so be sending everything off.
I just want to double check something if we file for the adjustment of status along with the permission to work do we just pay the one fee along with the biometrics fee.
The total is $1225 is that correct

Flight all booked for next week.
The original parcel contained this plus my passport with the visa page in it.
my police certificate was in it too.
honestly it all happened pretty quick, I had my medical 12th June I called every day and got a cancellation then had my interview 21st and a week later I’ve got my visa in hand. I wish the rest of the process would have been this quick.

I was you literally a week ago. My fiance's interview was June 12th, changed to AP the next day then on the 18th it changed to "issued" and he got his passport with visa inside on the 22nd.
Ours got issued today, hopefully next week I will get it so In total since we started this it took us ten months

I got approved today♥️😀 i arrived on a k1 originally and now living happily ever after with my beautiful wife in California
December 7th 2020 they received it
April 30th 2021 fingerprints was waived
June 11th 2021 approved and new card ordered
