He can get a Missouri DL after he has applied for AOS ........see the "Applicants for Adjustment of Status" section on this document:  It appears he needs his NOA for AOS and either his passport or his EAD.....

Just want to comment on it. I was there today trying to get a driver's license... They didn't care about the NOA1, only if I would get the NOA2 which is basically being approved for the green card. They told me they can't do anything, the only way according to them is i-94 + Passport which  is basically the K1 status and even if i pass the license would expire when my I-94, so I am back to square one.

can we take class while waiting? If possible I want to attend real estate class and sit for exam to get real estate license

I don't know that... Worth a try to explore your options. In theory you can attend any class you want.. Not completely sure, maybe somebody can tell who is going to attend school from this fall... You just need to meet the criteria to get into an institution and pay for the course if it's not free...

Thank you for the compliment. I love doing paper craft because it is lower cost and in the same time it take time to finish it. So, it is perfect for long waiting like this.

Oh wow, it's sound fun! Did you have driving license? I didn't have one yet, so i can only do something at home. A bit bored actually :clock:

Sorry to hear that you are bored. I have my European driver's license so I am using that for  now.... Will be out of town in August, but after that I will try to get a local drivers license.  Will see if they give one or not :) Theoretically I can get one in Missouri while adjusting status so will see how that will go in real life...

Also I was thinking to sign up for some ESL classes.... It's a longer commitment because you need to stay for like 6 months or so.... and I am not sure what If I will get a work permit and start working and won't be able to attend class?

At least here they offer classes from beginner to advanced....

Btw does anybody has experience with ESL classes?

That's a great suggestion!  i will wait until September/October.  He understands that these things change and while he would love to go it is possible that we can't.  So we will see.  He hates feeling like a prisoner in this country.  I could understand him.  thanks again :)

Try to do some weekend road trips or depending on money/your holiday maybe somewhere else? This country is huuugeeee and a lot of stuff to see and experience. If you have the time and budget I would go and see the country since after he starts to work will be hard to travel. And if you are going to use up all your holidays just to fly back to Spain (as lot of immigrants do in their holiday (not judging, just that's my experience) then he/you will be missing out of a lot.

Woow, that looks great. Nice hobby you got, and talent!

I am trying to just relax, some condo renovation, painting, plastering etc since I have the time.... Actually I was worried that I will be bored and first time in like 10 years not having a daily job, but it's actually nice. I can read, go to the gym when it's not busy,  watch movies, listen to music, go to the cinema for cheap cuz it's in the morning :). Will check this message in like 2-3 months and see how much my opinion has changed lol, but for now I think I am fine. Not really expecting to make new friends or acquaintances before I start to work, I am not that sociable person who makes new friends instantly....

Morning... I know what most of you will say but i figure i would ask.  My husband really wants to go to Spain for Christmas and is very hopeful that he will get his AP before Christmas.  He wants to purchase plane tickets with insurance of course  but I am so scared that he won't get it and then I will just have to deal with a canceled flight and travelers insurance.  What would you do?  If i buy them after AP which will hopefully be before Christmas, they will likely be super expensive.

It is kinda hard to deal with. I don't want to sound judgy, but I assume he is a grown up man (may I ask how old you guys are?), who knew what he is getting into. He needs to understand that his new life is here, and he should be planning for a nice USA Christmas.... Just to be clear I am the beneficiary so I should "relate" or "know" what he is going thru... Won't say that I know.... After I've got the visa and we talked about the timeline of me moving here and filing for AOS and all the processing times I was sure that I won't be able to leave the country for at least 5-6 months.... Also as you mentioned flights are expensive around holidays... I was not expecting to go back for Christmas this year, or at all. Probably will be harder around the holidays, but even if I could (it would be a close call, but I should get my AP at the beginning of December) was not planning to go back for the holidays this year. But it's just me.... Try to push the visit date to 2019, somewhere in the spring or early summer or something, so he would have a time to count down to... I don't have an exact date or plane ticket, but I know/plan that I will be going back to visit sometime in June-July next year.

How is he adjusting?  I think you should sit down and talk with him openly and tell him that it would be a lot of stress to cancel the flight and get your money back, be rational as much as possible...  Maybe it's a cultural thing to spend the holidays in close family or something, try to get the whole picture first....

For which form?  I did not see that on any of the instructions.  I see stuff about a biometrics appointment, but not about needing to pay a fee for that with the form.  Not arguing, just confused.

    If you look here https://www.uscis.gov/i-485

If you scroll down a little, you can find under the section Filing fee a nice table with possible fees for the i-485

    Hello all,

I have a question regarding dual citizenship:

I was born in Italy from a Canadian-born mother, and when I was very young she filed for my Canadian citizenship.

Since then I've always had both the Canadian and the Italian passport. The Canadian one has always been what I used for any travel outside the European Union, including all my past U.S. entries as a Visitor.

Having always been an Italian resident, I filed for the K-1 Visa as an Italian applicant.

Now I am submitting my AOS application and I would like to inform USCIS about my dual citizenship, just for transparency purposes. My I-94 travel history shows all the past entries that I did and I used my Canadian passport for all of them (except for the last one, of course, because my K-1 is on my Italian passport). I want to minimize any risk of confusion that may cause delays in the application, so I included a letter explaining my situation and I enclosed a copy of the Commemoration of my Canadian citizenship that I obtained when I was a child, plus a copy of my passport and a copy of all the pages with the past B2 stamps.

Is this the right way to do it? In the letter I explained that the documents regarding my Canadian citizenship are unrelated to my AOS application and I am enclosing them in a separate folder just for their knowledge.

I'm just wondering if it's necessary at all for me to make this communication.

Has anyone been in a similar situation? Any advice?

    Thank you

On the I129F and now for the I485 where it asked "Country of Citizenship or Nationality" I wrote my two citizenships and in parentheses I put dual citizen. As @Dee elle mentioned it, you should have disclosed that least on the DS-160.

Am not sure about the "what happens" part
But if you have to reschedule, you can. I believe when you get the letter, it walks you through how to do that

Just know it might not be anytime soon with the type of backup we're having with USCIS

Yeah... That's why I was hoping for an earlier NOA date.... I read that you can go to a different place to do the biometrics but if I won't have the letter before we leave then that is not an option :(

  12. Try to go to a different Social Security Administration office. You still need to have a valid unexpired I-94 tho....

I had no problem getting a SSN on a K1. Went an afternoon before the wedding day. They asked for my passport and I-94 No questions about wedding and stuff. The guy said lucky me he managed to verify my info in their system (I was in the country for 5 days) so no manual verification is needed and I had the "card" in a week. They don't give you a number on the spot....

At the Recorder of Deeds office when they asked if I have a SSN i told them I applied yesterday and they stamped a big NO SSN on the license and ask me to put my initials next to it...

If you look on this site it says you don't need to have a SSN to get married.

  13. I see the Chicago Lockbox is super slow?

I sent the package via USPS to

    USCIS
    PO Box 805887
    Chicago, IL 60680-4120

It is there since yesterday morning 6am, nobody picked it up... I used a priority mail envelope from the USPS office.

    So my questions are:

    1. The tracking still shows in transit with "Your item arrived at the Post Office at 6:14 am on July 16, 2018 in CHICAGO, IL 60680." Does will change to arrived or something when somebody picks it up?

    2. I used priority mail, should have use regular mail?

    3. Reading the forum posts in this topic seems like it takes forever to get your case "checked in" and get a NOA1? Or I have the wrong impression?

    Thanks

    errrrr
I legit don't even know what (a)(6) means and what the repercussions are if one were to pick that.
I just asked on VJ before submitting mine and the consensus was (c)(9)

    perhaps @LizM knows?

(a)(6) means that you are filing as a K1 visa holder and not as somebody who is AOS-ing. K1 Visa holders could get EAD if the processing time would be short.... The EAD would be valid for 90 days and not renewable.

"K-1 Nonimmigrant Fiance(e) of U.S. Citizen or K-2 Dependent--(a)(6). File Form I-765 if you are filing
within 90 days from the date of entry. This EAD cannot be renewed. Any EAD application other than for a
replacement must be based on your pending application for adjustment under (c)(9)."

The quote is from the instructions of I-765 form.  (https://www.uscis.gov/system/files_force/files/form/i-765instr.pdf?download=1)

Honestly don't know what will happen. Probably they reject it because of the wrong fee?. If you file under (a)(6) there is no fee wavier afaik.

If that happens you can refile it for free under the (c)(9) and sending a copy of NOA1 of the I-485

While adjusting from a K-1, is the I-130 required? It's not mentioned in the guide. Does one need to attach documents like the marriage certificate, I-94 etc to each form or just one copy in the entire package?

I-130 is not required since you are on a K-1 visa. You had the I-129F instead of I-130.

I made 3 separate "packages" for each form and it's supporting documents and sent them all in together, so yeah there are stuff which are duplicate for each form....

Cheap? Even less than that would be a ridiculous price. Most probably assume all immigrants are naive and try to sell you the "you have to do the full medical again" BS.

    That's good. Good luck!

    Thank you!

    Good luck to you too!

Updated the text. I was not clear about it. Wanted to say  compared to STL, somehow it stayed only I my mind instead of writing it down..  Here they asked between $500-$600 without any vaccination, just the plain medical I did overseas, which was around $200.

It crossed my mind to report those offices to USCIS or something, they are approved by USCIS, you call them and they don't know mostly anything about it. I think I was super lucky to find an office where even the receptionist knew all the process. When I arrived the form was already printed out, I said I bought mine completed :) She laugh, says usually people just show up unprepared, took my completed form and the vaccination worksheet I had and completed there. Go the missing shot, doctor signed it, and that's all.

Thank you for your help, it means a lot.

Unfortunately the blood test results that I have are not accepted because they were performed in Eu and not in the U.S.
I would have to do them again, but at this point I might as well just get the extra shot and have a Civil Surgeon file part of the form for me.

The instructions of Form I-693 specify that:

I called more than 10 Civil Surgeons listed on the USCIS website and none of them is willing to give me a shot without giving me the full medical again. Fees range from 200 to 350 and I'm not willing to have any of that. I really just need the shot and a doctor who can report it as specified on (C)(2)

Now I've just spoken to a Civil Surgeon who asked me to mail him my form DS-3025. He will let me know if he can just give me the shot and file Form I-693 for me.

    Fingers crossed.

That is cheap compared to STL... $350 tops? They asked around $500-$600 here in Saint Louis for a full medical and they also didn't want to do just only the shot(s). After calling around 7 offices, finally found somebody who knew what the process is. I needed to travel a bit further but at least I know I am in good hands....

I had no MMR shot at all, I got one on the day when they completed my I-693. It is marked complete with one MMR shot.
