    I admit being Canadian we assumed a lot. I thought we could hang out in the US for up to 6 months before we decided to live there. The border actually believed that part. But we had zero ties. No jobs, no housing, no stuff, absolutely nothing tying us to Canada. It never even dawned on us that would be an issue. I got a hard denial so it creates a flag and I report to secondary every time I enter the US.


    The reason I share this is I know as a Canadian we assume things are not as bad as they are. We shrug different stuff off assuming everything is fine. I think when it comes to going on vacation customs in either country is cool. But the minute they get even a whiff of a move all hell breaks loose. 

     

    It really sucks you weren't able to AOS as that flag is going to follow you for life. You will have a limited time ban but the overstay will still show up in your history. Travel to the US in the future will be a question mark.

    Just a friendly suggestion to make sure you look at the immigration laws moving to Canada. My spouse and I really screwed up my green card going to the US. I'd hate for you or anyone else to have to go through what we have.

     

    You may know this already but label all of your boxes and belongings when you enter. Customs will likely ask for a manifest of items.

     

    Your overstay will have no bearing on the Canadian side. I have immigration issues having been denied entry to the US. I find it funny just how easy Canada is willing to take me back when I have to get interviewed extensively when I visit the US. You should have no problem leaving.

    What do you mean by do not come to the attention of the authorities? Do you have any idea what will happen when I cross the border with a truck of my stuff? 

    Will your spouse be with you when you travel? Don't do what we did and cross with a U-Haul worth of belongings everyone in tow. I am not aware of Canadian immigration law but if it's anything like the US they may expect your spouse to have a visa. The worst situation you could find yourself in is you coming back to Canada with an overstay and your spouse being told to go back to the US to wait for his visa. I know this because I've lived this story for over a year but have been fortunate to visit my spouse. I assumed a lot with moving such as being able to hang out in the opposite country for 6 months.

    This is just a suggestion but I would bring everything you can to the interview. If you are driving 2.5 hours each way the last thing you need is being in AP because you didn't bring that "one" thing.

    My case was received by NVC a week after my i130 approval but it didn't show up in their system for 3 weeks. It's common for people to call NVC over and over with no answer and then all of a sudden get a case number. I think there are different variables like which country you're from. The process can vary widely for those who have CEAC, email or paper. It can depend on how busy they are. All a person can do is keep calling.

    Unfortunately nobody can tell you when NVC will receive your case or assign a number. You just have to keep calling them until they give you that information.

  7. Unfortunately I cannot speak to the AOS process as I am at the Canadian consulate abroad. I am sure it's the same sort of interview where they ask how you met, how long have you been together, when did you get married and where, etc. I honestly don't think you have a lot to worry about because you guys live together. I've been together with my husband for 12.5 years and I couldn't tell you what kind of shower soap he uses. I'd like to think most people will be reasonable. 

     

    Wow 2.5 hours each way! Try not to let your hands shake on the steering wheel! Just keep reminding yourself in x hours it will all be over with. You have nothing to be nervous about if you've been totally honest about everything.

     

    Generally I feel more confident the more stuff I have. So if you can I would bring as much material to the interview as possible. That way you won't kick yourself should they ask for anything.

     

    I am trying to have a clear head because of course with nerves you can start to think blanks. I try to remind myself the agents aren't going to go out of their way to screw someone over. As long as you can answer all the questions I am sure everything will be alright. Good luck tomorrow!!

    Long story short...they apparently had processed our case using the "new system" and for some reason it was not being assigned a case number. After constant phone calls they transfer my file to a supervisor and sure enough...that following day we received an email (and so did our attorney) that our case was received and it had a case number.
     

    My best suggestion is to keep calling them. 

    So happy for you!!! Wow that was a long wait. I didn't realize myself the normal NVC agents cannot access people using the CEAC system. Hopefully you can log in and start the process right away. Fortunately at this phase it should only take 2-3 business days to receive payment. Then only 1-2 days after you submit your documentation to have a case complete. I will cross my fingers you will get an interview date by the end of Feb. If not I find in Canada they schedule after the 12th the following month. 52 days is about average after case complete but I've seen many Canadians be able to sneak in sooner depending on scheduling.

    Trust me if anyone understands I DO! The interview is starting to swirl in my head. What if I sleep in? What if they ask for something I don't have? I think the people who usually have the most problems are the type of people who don't worry about anything. I have no doubt you have armed yourself with so much documentation they won't have time to go through it all. Best to be prepared though cause then you can say you presented your best case. Breathe deeply and keep thinking this time tomorrow you will have an answer!

  10. GOOD LUCK!!! I have my interview tomorrow and can 100% share the STRESS!!!! I keep going over everything the same way you are almost picking at anything that might lead to a denial. The truth is we both come from low fraud countries. So the chances they will deny you based on your relationship are extremely low. Everything you have shared looks great. I don't think the interviewer is going to care what details of your relationship you've shared with different people. Some families are strained. It happens. The important thing is you are being truthful and can show supporting evidence.

  11. Your relationship may face scrutiny as the both of you haven't been together very long. Take photos and gather evidence your relationship is real. I find it sad you cannot share your happiness with your family. I understand the perception of gay marriage is not the same everywhere. However, I'd like to believe love from parents and family is not conditional. You deserve to be happy.

    I would start calling NVC in a couple of weeks to see if they received your case. Don't panic if they say it can take up to 6 weeks. Just keep calling until they give you an invoice and case number. Start gathering all of your documents for NVC so when you do get your number you just need to submit them. Good luck :)

  13. 1. It's really up to each couple as to when the USC moves to the US. Generally the sooner she can move the stronger her ties will be. Most USC's are established in the US by the time they have the interview. Individual timelines can vary so it's hard to predict which month you will have your interview.

    2. Your i130 will take anywhere from 5-8 months to get approved. Then you will move onto the NVC stage where you submit documents and fill out the DS 260 and i864. The NVC process is done online and can be done within a month if you have all your documents ready. From the time your i130 is approved the average case takes 3 more months for the interview. The visa takes anywhere from 1-3 weeks to be issued once you are approved.

    3. Emails generally do not show proof of domicile. Domicile is very strict in Montreal and they want to see things like a lease or house purchase. Some people move in with family but that can be risky as it does not show a solid tie. Proof of domicile are things like a job, drivers license, proof the USC is or intends to live in the US. You have to provide as much evidence your spouse will live there. Promises are not as strong as actual steps taken.

    4. If you have confirmed employment you could mention it at the time of the interview. As the petition is based on the USC it may not influence the outcome all that much.

    I told her I am in accord with that type of Intimacy , yet I don't want to be in a sexless marriage, she replied with: My mother and father have not had sex in over a decade ( dad 57 / mom 63) , and, that her Aunt 79 yrs age and Uncle 81 have not made love in a long time. I told her that is their choice , but, at some point they made love because her parents have 3 kids , the aunt and uncle have 4. 

    The reason I brought up whether her folks have a healthy sex life is we are often influenced by what we observe. I am not implying it's a one size fits all theory but perhaps her parents have more of a friendship than a relationship and she thinks its normal. 

     

    Did you guys have a healthy sex life before marriage? It sounds like you guys need to go back to the basics. Evaluate whether you are still attracted to each other. See if there are common interests. Do you guys cuddle? hug? kiss? an innocent butt pat? check each other out when they come out of the shower? these are all subtle forms of intimacy. 

     

    I understand sex feels awkward the longer you go without it. As they say though it's like riding a bike lol. Is there a chance she feels the same way? We are all throwing out theories. What do you think is going on?

  15. If your wife is still legally married to another man you are so far down a hole. How could you register your marriage knowing she is still married? That's bigamy in the Philippines. Your wife filed for a K-1 while being married to TWO PEOPLE. Even attended an interview claiming she was still single! How do you plan on explaining that at the CR1 interview? Oops I didn't know I was married to all these guys??? 

     

    If any of this is true you have given the middle finger to US immigration. I could see both of you being lead out of the Consulate in handcuffs.

    That's a good point. They should sit down and discuss their expectations as she can't afford to live on her own. Hopefully his wife can be honest as to why they are more like roommates than a married couple.

     

    It sounds like the wife is having all of her needs met with being able to send money home and not invest much into her marriage. It will be difficult for her to find another spouse who would accept the same arrangement.
