If the baby was born after the immigrant visa was issued to the parent(s) -- could be either parent or both -- and before the original entry into the US (i.e., the baby traveled with them when they first used the visa), the baby did not need a visa.  They just needed to have a travel document (passport) and the baby's birth certificate.  He/She would have been admitted in the same status as the parents and should have a stamp in the passport the same as they do.

What makes you/them think the baby has no status?

They are worried because their child never received an actual green card after entering the states. Should she have received one since her parents did?

    Sorry--not well-versed in EB3.

  2. Hello all!

I wasn't sure which forum to post this in -- so please move to the correct forum if needed :).

My husband works with other Filipinos here in Indiana (Right across the bridge from our home in Louisville, KY). His co-worker was petitioned by their employer on a EB3 visa. His coworker and family are also Filipino. Their interview was in Oman where they were living at the time. His wife was pregnant during the interview and they were approved. They received their green cards shortly after POE. Their immigration lawyer told them not to worry about their child until they came to the states. Now, they are here in the states and their child has no legal status. I am at a loss trying to figure out what they need to do in order to have legal status for their daughter. Any advice would be super helpful.

    Thanks!

  3. I know it has been a while, but life has been so busy! Just wanted to give a quick update :).

Hubby received his EAD and AP the first week of October and started working full time. This was such a blessing because living on one income is super hard!

He received his interview letter in November. He was scheduled for AoS interview Dec 21 and was approved!

He received his GC on Dec 31.

We are officially done with the government....for now ;).

    Continued best wishes to all!

Has anyone used a service to have their foreign degree translated over to be recognized in America? This is not just a translation, but a company that actually evaluates your degree to make it equivalent to an American degree when applying for jobs.

An attorney we consulted with early on suggested he do this, the company she suggested does not have the best reviews. It is called: http://www.trustfortecorp.com/

I tried googling (EQUIVALENCY EVALUATION VIA CREDENTIAL ASSESSMENT SERVICES) and can't find a company with great reviews.

Wanted to get this done so he can start applying if he finds something and attempt to expedite EAD.

    Anyone?

I’ve worked in higher ed admissions for a while and we always recommend https://www.wes.org/evaluations-and-fees/ for international students.

So I got an email "update" this morning. I have no idea why they sent it because nothing has changed on any of my cases when I look them up - they all still have the original NOA1 notice and nothing more even though we did Biometrics a month ago. Does anyone know what this notice really means? Like maybe they are sending our case to the Atlanta office? Or is it supposed to reassure me that they haven't forgotten us? lol

Also, it says we last took action on June 27th and that is not showing on either of the check status websites. So weird.

I think this is something new they’ve added. I’ve received emails like this almost weekly regarding AoS updates.

You guys are saviours. Thank you.

I don't suppose you know what it means by Travel Documentation Number for Part 1, 16 at all, please? I'm not sure what I should be reading or getting the number from. 😭

I believe you there are two different numbers you can list. I think I put the visa number located in the right hand corner. Control number.

    OH MY LAWD.

Okay, this is more difficult than I anticipated. Is there a thread with all this on? I have no clue about the I-94, there is a K1 passport stamp with Jul 29 2018 on it 🤔 The USCIS account number? Nonimmigrant visa numbers, US embassy abroad... Yep... My tiny brain is crying right now. Can't ask him. He's useless. I did all the i129f and all the K1 stuff 😂

Take a breath! You’ve got this. The I-94 is digital. You can google it, put in the info for  spouse/fiancé, and print out the sheet. It’s super simple. I don’t remember the link or I would post it. I made multiple copies of the visa and entry stamp that’s in my hubby’s passport and sent it with each form for AoS. Focus on one form at a time. Ask questions!
