    1) if you have not received a physical letter about transfer, chances are it's a glitch. If you go to ROC forum there is a huge thread about "transfer" glitch that all of us got. 

    2) however if you filed n 400 your petition would be transferred to local office and then it's under local office proceeding times

    I personally think applying for n 400 delays i751 and if you'll check monthly fillers threads with statistics you'll see this tendency yourself 

    on a bright side, you are closer to your citizenship then people who decide to deal with 751 first

    Sure thing it's frustrating, but cheer up - you have a green card!!! Unlike many of us waiting and waiting and waiting that's definitely not the worst place to be at! Look at it like this: your 10 year residency is done deal and for me, for example, it's not yet and I'm having a terrible anxiety about my travel plans because my case still pending..You good! You'll sort it out and move past by. Congratulations on your approval ! That's what matters the most.

    I do, it's valid for many months to come. I was just anxious leaving the country during estimated month of processing application (May-June) even though it's just for 2 weeks...like what if it's get denied while I'm gone because I haven't filled it out correctly or something else. It's a gray area if i551 would be sufficient for re enter in that case (well at least to me it as)

    Yes, you can be issued a straight denial without an RFE - I can personally attest to that as I have never received an RFE

    It would also be unusual to be issued a denial without an interview first but it is possible.

    If you receive an interview notice you generally get around a months notice - sign up for USPS informed delivery and have someone able to check your mail if neccessary. You can’t really do anything more at this point.

     

     

    Regardless, as a LPR you are protected by the law and you only cease to be a LPR after a final order of removal by an immigration judge , despite the wording of the denial letters.

    Remember that an immigration judge is the only one who can terminate ones LPR status, and a LPR is entitled to a hearing with one - and also to appeal that decision if unhappy with it .

    If denied and a hearing pending you are also entitled to proof of your status until such a hearing has taken place.

     

    If you have a valid stamp and are presenting as a LPR you would be permitted re-entry to the US, even if denied when overseas.

    You could also file another I-751 immediately if you receive a denial, which puts you back into full I-751 pending status 

     

     

    Mindthegap, thank you so much for your input! Yes, the wording about status termination is scary especially when paired with the CBP statement that entry is not granted to anyone who's not a citizen, LPR includingly. 

    I do have informed delivery and all I see there so far is a mail spam. 

    Was just trying to weight out the risk of leaving now compare to rescheduling a trip for 2 months but then again, who knows when it's gets approved or any action taken.

  6. Hi guys, I'm a December 2016 filler and based on my rough estimate, December fillers would start seeing a movement in May. However I have an urgent travel to do leaving in 2 days and coming back in exactly 2 weeks from now. But here is where paranoia and anxiety of a long wait kicks in, it makes me sick to my stomach thinking about all "what ifs" if I won't be allowed back if my petition gets denied while I'm gone. I haven't seen much reports of straight up denials, only if something is wrong with a petition, and since I filled it out myself without legal advice im worry if I forget a signature at the right spot/or checking the right box, or whatever that could cause a denial. I'm so exhausted from racing my thoughts like this and prolong purchasing plane tickets so I decided to share it with you guys as I'm not 100% sure my concerns are even legit anymore. I would love to hear your optinion if it's indeed a risky adventure to leave when I expect to start seeing a movement for my month fillers or I'm simply loosing it because of anxiety. 

     

    P.s. If there is no issues with my petition itself, I tend to believe it would be approved with all amount of evidences I sent. 

     

    I'm sorry if I'm spreading worrys I usually try to encourage everyone but now it's me who's in feelings.

    In November it switched to majority got approved in 1 year and 5 months and for others it took 1 year and 6 months 

    there is a lot of people in both threads with no update whatsoever - could be that they just don't post on VJ anymore or indeed still waiting. 

    By my rough estimate, CSC speeded up for 1 month comparing past 2 months activity. Hope my calculations is correct

I'm an early December filler and sitting here anxious and probably driving myself crazy at this point as I want to go on urgent travel yet worry if they would start processing December 2016  in May and what if I haven't filled out petition properly and got denied while away and other what ifs... ugh

    I'd take it as a good sign considering somebody just got approved that way. I only not so sure why you haven't got a letter in a mail confirming transfer. I would call tomorrow in AM to talk to Tier2 officer for a better idea where your file at. Please keep us posted and good luck! 

  10. 1) What date the transfer happened? 

    You should recive a physical letter in mail if transfer indeed took a place. 

    2) what's your statuses online says?

    3)have you filled n 400? 

    If not, and transfer did happen and you recive a letter in mail notifying about it, then it's a great news and makes me think that CSC started a workload transfer. December 2016 filler just reported approval after transfer from CSC to NSC

    Hi, mindthegap! Based on an actual experience, how exactly denial works? What comes first: RFE? Interview? Notice of intent do deny? Or maybe straight up a denial letter? In that case, what happens if a person out if the country?  Would love to hear your input.

    Guys, let's not turn an interesting thread into out of topic philosophy, I know it's very draining to stay in limbo but oh well it's going to be our turn one day! Let's just figure out how to make this process less painful and secure for a time being.

    Im from Canada and know wealthy people interested in having their footprint in US business, iam working on getting a large investment to my business here in the US, this will require me months back in Canada. While this requires my 120%  attrntion and focus to pull off, I sit here with half the energy explaining to CBP officers, USCIS officers and forum members what im doing with my life. 

    Actually I'm totally getting your anxiety and where you coming from in this thread. I believe you are a December filler so as myself, and just like you ( this I assume) I'm planning international travel for 2 weeks in a matter of a few days. They working on November now so I believe it's still a month away of wait to do before we even can talk approval/rfe/interviews but this wait sometimes drives me nuts and I start overthinking things. My NOA December 10. You think it's ok time to travel or it's better to cancel it all and sit tight for a reasons like you stated at your original post?

    The reason for this, goes back to being an LRP, and not wanting to automatically make the case go to court, wasting more resources if they can solve issues internally within the agency. 

     

    I think for this reason lawyers say you will not be able to enter since it never happened?

    Notice Date 04/24/2018, Approval Notice, saying my case was approved, expect greencard in 60days. 

     

    No interview.

     

    This literally made my evening! Very happy for you! 

    Super curious, What does your statuses online  says? 

     

    Now I wonder if they started to transfer workload for real or it's just exceptional case. If anyone here getting a physical mail transfer notifications (not an online status glitch we all got recently) , please post!

    Ugh this is crazy! I'd go to post office talk to supervisor and  request investigation ... I did it once for lost package and surprisingly usps found it at different building. At least something.

    The stamp is also fine to get you back in as long as it's in date. It's an I-551 in a different form. I had to send my GC back to USCIS today and intend to use my stamp while I wait for them to correct their misprint.

     

    I don't know how much notice they give you for an interview. Could you have someone pick up your mail and notify you if you need to come back?

    I can possibly ask someone to pick it up, however can't be 100% sure. 

     

    I do worry about possible interview, I think for AOS it was about 2 weeks ahead, so kind of short notice if you outside of the country. 

     

    I think I saw your recent approval in one of the the threads, do you recall seeing in approval letter a note about not leaving the country before your GC arrives?
