If he was to do a no show at an interview, the choice at that point would be to request a switch to a waiver (for which an RFE will be sent if final decree not in hand), or receive a denial.
I wasn't sure if it's indeed an option to switch to waiver if you going to joint interview alone, I thought situation like this could as well get a denial if IO decides so.
thank you

Also yes, I have read a lot of answers from @Damara but I don't how to contact him/her...
I saw at least 3 people here who amended petition from joint to waiver without RFE or interview, but they sent a final divorce decree along with amendment.
Before contacting Damara please read this thread and ask her your questions there so other people who is searching for "divorce while I 751 pending" can have a full picture of what to do. She posted A LOT of information there. So as @mindthegap btw.
Here it is:

As your husband has indicated a willingness to continue as a joint filing and support that, you have nothing to lose and everything to gain by doing just that and simply informing them of this change in your circumstances.
If you get called to an interview and say, you have a big argument the night before and he refuses to come with you, then at the interview you could still request a switch to a divorce waiver at that time, and you would have to provide the decree (again, when an RFE is received).
Dont you think if she goes on joint interview alone that may cause the denial rather than RFE for a divorce? Isnt it a risk and a slippery road to take?

Interesting observation, considering recent ROC case en mass transfer to local offices.
Well mass transfer looks like a mass glitch. Reported approved member got approval from different cervice center and NOT local office. And even so, the n 400 line is not going nowhere. If you go to JuLy August 2016 threads youll see a major tendecy of people who filed combo getting delays, which is totally logical.

Why wouldn't it?
because by the time its your turn to adjudicate 751 they see you filed n400 and send your file to local office. At local office you going in line with other ppl who applied to n 400 and if the office is large (like mine where n400 proceeding time is 13 mo) then its a set up for extended wait
I prefer to have my card sooner so i dont have to explain everyone a stamp while travelling and then file n 400 without any headache of when it would be over rather then extend my wait but get closer to citizenship
there is no bad and good choice, its a personal comfort what matters

I wish there was a way we could cancel the N-400 now. Risking deportation because of a failed citizenship test doesn't seem worth it.
i can hardly image how one can fail citizenship test. If you passed a high schcool be sure youll get it right

I agree with the decision to file as some of our fellow members questioned the need to apply when the ROC is pending because its a waste of money. I don't agree with them as even if the ROC is adjudicated / not we will still have to pay for the N400 filing fees. And knowing filing for N400 pushes them to adjudicate the i751 it can only be good.
Who said it pushes them to adjudicate i751? this is SO wrong.

Not everyone is receiving two date changes on their case, but if that ends up happening, it could indicate as one poster said that the cases were sent to the Potomac Service Center before routing to the local offices. That would make sense if PSC needed to sort out the locations or needed to scan or verify documents before sending them. It would be awesome if they did some sort of "light review" such as which cases look stronger, but of course, this is just a pipe dream of USCIS efficiency of mine.
Woudnt be such moves ( or at least one of them) reflected at Tier2 systems? With proceeding speed i HIGHLY DOUBT it got transfered 2 times in 2 days and then another one on 5th March. Who would do all that work for a thousands of cases and no information about it available for Tier2?
Fingers crossed for a system glitch still. After service request to CSC and infopass to local office i hope that become more obvious

Isn't it possible that the 'we received' messages refer to your file being received in different offices?
So they could all be true.
What you mean? Like they send case from CSC who knows where on February 25, then again on 26, then again at 5 March? Like they tranferred it 3 times somewhere but somehow Tier2 is telling me its at CSC? So so confused!

So news from the app... 😄
Since they activate our first WAC numbers I’ve been tracking 500 numbers on the app every day. I’m 9/29/2016 so I guess you can understand my excitement. So, yesterday 3 people got RFE and 6 got approved. Today I see 4 people approved and one got message that his/hers case was transferred again to new office with new jurisdiction. I’ve never heard of update like this one. Oh and a lot of people have name update.
Those are the news from the past two days on the 500 people around mine. 😄😄😄 Stay tuned 😂
WHAT app is that? and how do you track so much cases? Instruction pleease i really woud like to know whats going on in my month ( december 2016)

My lawyer recieved an interview notice yesterday, i asked him about the reason why based on his experience,( and hes a good lawyer). Today he emailed me back saying that he just had a chat with an immigration officer today, i guess at an interview or something, and was told that its a new requirements for all applicants or at least most who file any type of case concerning green cards will have to be interviwed. I guess thats why i recieved my interview notice yesterday, and thats why i and so many others when we check our case status on the other website it does mention that if you dont recieve the notice within a month contact us, that might confirm that lots of interview notices are in the mail. Am csc november fiker
A good lawyer must be used to to hear total bs and take it with a grain of salt.
I heard kind of same thing when i went to get my stamp that all 751 are interviewed. I was like reaally? (thinking to myself how i see cases approved left and right on VJ. that was a few months ago.)
I dont belive they have a capacity to interview all cases, unless proceeding time changes to 5 years.
Meanwhile at December 2016 thread was a member who just like you recived a notice for interview super early down the road, it seemed like a random selection. Its way before that all madness with statuses has started. They got approved.
So i woudnt be quick to relate case status thing to your interview notice, so far its totally looks like a mass glitch. Good luck!
-
This is crazy.
On original case status web site it shows:
1) On MARCH 5 we recieved your case at local office ( Used to be February 26)
2) Fees were waived ( bs)
On second website (apparently new) its:
1) On Febryary 26 we recieved yoiur case
2) On February 25 we recieved your case
3) On December 11 we recived your case ( 3 identical statuses)
4) On december 11 we recived your case and waived fees (bs)
So, NONE OF THESE STATUSES are right. The only correct thing is that they recived my case on December 11. That is all.
I just printed all these pages and straight to the infopass i go next week.
If theyt confirm they DO NOT have my case at local office, then ill just call it quits in checking case status and going to wait my turm at Cervice Center where i belive my application is still at.

Joint filing @ CSC, no biometrics, and approved in under five months?
That is ridiculous enough to be more than slightly suspect....
Is joint filling takes longer than a divorce waiver? Interesting!

No. Someone on that thread said that all approvals come from The National Benefits Center in Missouri. That was the return address on the envelope. I don't know for sure who approved our application, whether it was California or our local office in Pennsylvania. Our attorney in California is a big firm and they said we were their only ROC client approved since 2016, so they are trying to find out an answer as well.
I never heard of approvals coming from Missouri.threads I follow report approvals from cervice center they filed at or local offices. So confusing! Maybe they transferred your case there before approval. One thing for sure - it's NOT coming from local office. Great news regardless!

We are the July 2017 couple just receiving a letter yesterday about being approved. Our attorney also received the same notification and inquired further just to be sure this wasn't a mistake. All of us are guessing that our paperwork was forwarded to our local Pittsburgh office to be reviewed and it was approved before the online system was repaired on Sunday. So, the glitch with the system was more than likely a repair to a system not operating properly. Once repaired, it would populate everyone's notices with March 4, because that was the date the repairs were made. Therefore, we are assuming that anyone with that notice on the online system probably had their files transferred weeks ago and that decisions should be forthcoming for many more of us. Meanwhile, we were not interviewed for AOS or ROC so the transfer of files is just an attempt to spread out the load from the California Service Center. The same may be occurring for the Vermont Service Center.
Hi! Congratulations! However I'm confused, as I saw in July 2017 fillers your approval was not coming from your local office?

possible they applied for N-400? N-400s are running about 8 months
No, you can't get approved for n 400 without interview. And how long it runs depends on local office, for example in mine it's 13 months. A person got approval not from local office, no interview. Just roc

The July 2017 approval said their approval came from Lees Summit, MO
You right I misread it. However it's coming not from a local office..so maybe they started transfer in between service centers which would explain this approval being way out of the order. Time will tell I guess!
-
Yet July 2017 CSC filler is approvedwith the same status update and letter came from CSC. I have 0 idea how long would it take us at this point if they going through cases randomly and not chronologically
-
Same here, the date changed to 5 march. Oh well, even more confident it's a glitch. Will see how service request and info pass turns out.

Yes, this person was due or overdue, so no surprise there. Has nothing to do with most of the rest of us who filed later than Sept 2016.
They are currently on September 2016 at CSC, so it's local September 2016 fillers going to get approval first. Case is clearly not transferred yet reflects same old status. Now sure how much more proofs needed.

I-751 February 2017 Filers [merged threads]
in Removing Conditions on Residency General Discussion
Posted · Edited by Scazy
Based on timeline of July, August fillers, I mean majority of them, you not forcing any ROC interview to happen any sooner, rather than waiting in n400 line and having an interview for both. Its a tricky question. Here and there we see exceptions and ppl who indeed got it faster, but statistics says that's not a case for the most. Also I believe each local offices handles combo diffently.
One thing for sure: I think you should not worry even for a second that you might loose your residency by doing so, this is totally not true. In order to fail citizenship you need to fail proving your marriage is bona ride, and even if so, citizenship will just gets denied. You not loosing residency until a JUDGE said so, even if your 751 is denied.
