  1. Hi, I’m asking on behalf of my co worker who’s going to file I 751 next month. Prior filing for AOS he’s been arrested for a crime involving moral turpitude but case was Nolle Pross (not prosecuted) without any admission of a guilt. He submitted petition for AOS with a lawyer and approved without any issues. Now it’s time to file i751 and lawyer just quoted him 3k. He believes he can easily submit petition and evidences himself, however uncertain if his past record would affect it. He has a certified court disposition with Nolle pros. In my opinion, since all information regarding arrest and outcome was submitted during AOS and approved ( and confirmed by the lawyer that would not cause an issue at that stage), chances are he’s good to file himself I 751 and submitting a disposition with a petition, but I have a very little knowledge on this matter so figured I’ll ask here for other options.

Price is the best indicator of quality, as well as law school attended. Your best bet would be to hang tight, and you'll likely be approved without an interview like 90% of people are, assuming you had a good evidence packet. If you do get an interview, then just inform them of the situation, ask to convert to a waiver, and have a lawyer intercede. Then, present the divorce decree, and they'll adjudicate on the basis of the good faith documents you submitted. You'll be fine. I'd certainly recommend the consultation, however.

    I wonder what are the chances that during the interview adjudicator refuse to convert to waiver and simply deny petiotion for “no show”?  Or that is not likely? Then other way would be to re file with a waiver or present the case in front of the judge? 

    My friend is going through the same exact situation and it’s crazy how often we see such threads here now when ROC is talking up to 20 months...

    by the way on internet there is nothing ...zero! no e mail no updates on uscis page only

    Hi, is there any suggestions of what they would like to see in RFE? Usually they outline something related to your case. I believe it’s starts with a list of what you sent and then suggestion what else you can send to establish a good faith.

    i think you can just send updated versions of documents you already provided and in case if you don’t have something they asking, write an explanation why you not able to provide it. 

     

    Seems like you filed a service request? 

     

    Call and request to talk to Tier 2 officer for explanation

    My question is " Should i add the pictures and text messages when re-filing the case?" or just use the proofs what i have for good faith marriage and file then wait for USCIS to decide.

     

    Any help or advice is highly appreciated.

    It seems like we are the ones left waiting for approvals :mellow:

    I see Feb 26 and March “local office” transfers are waiting, but the ones who’s got approved also had the same statuses prior approval, so I don’t think it’s connected. It’s just might be that December cases are sitting at the desks with no particular order waiting to get reviewed, I can’t find any better explanation than this.. 

  6. I belive approvals are totally random in terms of case numbers. For example, I see tons of approvals on 30 May and it’s all over - some at the begging of the month, some is at the middle and up. I must say I got really anxious seeing approvals / RFEs wrapped around my case yet no movement in mine, then I discovered there is tons of cases from the first week of December are still untouched as well. I kind of wish I never got a case app at the first place as it gives me anxiety. Let’s pray and hope we all get good news soon.

    I received Card Produced Status on regular uscis.gov yesterday but when I check uscisdhs.gov it still says 'Case Received'. I would think uscis dhs gov would update first and I'm using the case number from my bio-metrics. And on the case history, it says they received my case on 5/29..

     

    Has anyone seen this pattern? I really hope this is not another glitch, getting sick of USCIS..

    and  online update says they have sent a letter explaining why they moved but I haven’t received that letter.

     

    Today I check status on automated phone line it is saying my file is moved to Laguna Niguel. Well this is the place I filed it. It could be moved moved from one floor to another.

     

    but around May 14th I went for my infopass for getting I-551 stamp and IO told me after looking at notes that it has been moved to Nebraska.

     

    I am really confused at this point where exactly file is. Initially I was happy learning that it moved to Nebraska. But after not getting any letter yet and automated system telling me it is in laguna Niguel it confuses again.

     

    really fed up with this up and down emotional and bumpy ride. Please help if someone had similar experience or if May 9th update filers got their letter confirming case transferred.

    Hi, I read here situations exactly like yours so you definitely not alone and it’s indeed confusing. I also saw case approved at interview yet still “transferred to Laguna Nigel” after.. I would call and request to talk to Tier 2 officer to see location of your file. Other than that, i guess where is not much options but wait a physical letter in a mail or hopefully approval notice.

    Well, I probably underestimste  life insurance because honestly everyone can get it and cancel next day. While 2 years of joint savings and checking account is a pretty heavy financial commitment and even not all genuine couples have it in place and active. So to me, a significant amount on savings and active checking is much more of a proof rather than insurance that can be cancelled any second. Same goes to heath insurance. It’s a great pieces of evidences, but I would not put it in the first place.

    We do have tax return transcripts from the IRS that we plan on submitting. No car (we live in manhattan) or life insurance. 

     

    My mother in law and I jointly own the condo but the mortgage is in my husband's name so I guess that is some evidence too.

     

    RFE letter says: Children as a result of marriage (birth certificates etc which are not applicable for us),leases showing occupancy (which we already sent),driving license (which we are planning on sending),property, life or health insurance docs (already sent). affidavits (which we already sent but will send some more) and of course joint bank accounts.

     

     

    Well, your lawyer should have advised you to be added on joint account the day you had a consultation. Im not sure if that would make a significant difference to be added now and send just 1 statement because it’s obviously happened due to RFE, but probably won’t hurt neither. 

    You need to write a good cover letter explaining what you have / don’t have. 

    For example that you not planning / or planning later to have a kids, all your living situation since marriage with leases covering all these years, sending insurance cards with the same number and pages where you listed as each other’s beneficiary and indicating ongoing joint coverage, IRS transcripts (!) not just W2 or 1099 but an actual IRS transcripts and account summaries from the IRS (can order online or in person) for past years, and a good explanation why you guys don’t have a joint account and how you guys share financial matters in your family - who pays rent, groceries, where your salary’s deposited, etc etc. 

    it’s ok not to have it, but you need to explain in your cover letter why so and how guys go about it. 

    After you do that and USICS have a full picture, next thing you’ll see is  approval.
