    The K-1 was rendered invalid because she was already married, and she's divorced the guy she came in on the K-1 visa. I'd assume it'd be akin to marrying when you're on a tourist visa, or even out of status. Married, in the US, do a I-130+1-485 combo. Normally she'd have to adjust with the person she K-1'd with, but since her K-1 is invalid, and she's already divorced that person, she shouldn't be bound to the having to adjust with the spouse you did K-1 with rule.
    ^This is all assuming though that they don't hold up the bargain of coming in on a K-1 marry the person who petitioned for you. They could totally render it invalid and then tell her she would still be bound to AOS with the petitioner, but it seems like she got off easy with the please leave.
    Again though, I think the whole things incredibly fishy and she should just go back. I can't see them approving her based on new marriage, that would blow my mind.
    Also, I took the OP's question of "What if she gets married" as in What if she gets married while IN the US. I don't think she's going to leave and get married, the whole thread seems to be finding a way to keep her here.

    Either way, not knowing the language does not excuse breaking the law / not knowing the law. Educate yourself when you're moving to the different country....

    as long as your a genuine couple , its no reason to worry =) , only reason to wry would be if you have criminal records, a ridiculous age gap , different religions , other red flags etc but thats any embassy really

    Just reading this got my PTSD acting up. He is "hugging and kissing" you as a way to control you but if the police are called that is exactly what he will tell them. You hit him and bit him for hugging and kissing you. Who do you think the police are going to arrest. My ex would throw me on the floor and bang my head on the floor but tell the police he was just restraining me for my own safety. I was carrying my 1 week old daughter when he shoved me and I fell, almost landing on her. He immediately began yelling "go ahead throw the baby" as a way to cover for his act of violence. If I didn't want to participate in whatever type of sex he wanted he would call me a prude, tell me the light came on when I spread my legs, and just humiliate me.
    If you still love him obtain counseling. Otherwise it is time to divorce.

    Also, if you do the CR-1 route, remember that the I-864 is not sent in until you're at NVC. Please correct me if I'm wrong, but that should mean that you can start preparing the I-130 petition and send it in soon. That part alone takes about six months. Once you're at NVC, you can do what you can there like choose agent, pay fees etc, and then once your wife turns 18, she signs and sends in the I-864.

    True, the full amount may be charged within 1-2 business days.
    If not, OP, don't worrry, the petition will be returned and you just add a new payment in and resend it.

    *sassy mode* Why would you honestly believe you could WORK on a TOURIST visa? Aka making money on a tourist visa is not done and certainly illegal to do.
    Changes are extremely small for you to get another tourist visa since you had the wrong intentions on your last tourist visa.

    hm i think it should of been obvious that if your " how we met" is facebook you would make sure it was not on private , and since that mutual friend is based on what you a factor why yall met in the first place, the mutual friend not having a facebook anymore all of a sudden could look odd to a CO. Also the trip was a bit too short , if you had a second trip that would of def antly helped you , although some ppl do get approved with just one trip , one trip with just 3-7 days is nothing, if the trip was a week and some days or 2 - 3 weeks , you would of been better off
    CR1 and a few more trips and putting your facebook on public seems to be the solution

    I know you feel that the FB issue is the only reason for denial. However, that was just a factor in them not believing the relationship is real. No IO can list "no mutual FB friends" as a reason for denial to USCIS. The true reason will be listed as not enough bonafide relationship evidence.
    So...before refiling please take steps to strengthen your evidence. As one poster suggested...more visits or marry, and file CR1. No, simply just refiling will not guarantee success. Please be proactive.

    Never ever buy a ticket before visa is in hand. That's the golden rule of VJ and there have been so many previous posts about it.
    My husband's visa took 7 business days to get into his hands, that's with the embassy working fast. The Christmas holiday could cause it to take even longer. You basically gave them 2 days to prepare the visa and POE packet. Not going to work.
    Anything could happen...AP, errors on the visa, DHL hold up.

    My fiancé is Jamaican. It just really surprised me how little Melanie knew about Jamaican culture before bringing him here. I'm willing to bet she never stayed with him when she visited. She didn't strike me as a person willing to compromise much. It seemed like she was expecting him to come here and just live her life. Similar to this young girl with the Moroccan Fiance on this season.
    Definitely makes the first year of marriage more difficult.

    I totally understand trust me especially about heartbreak but just keep an open mind and continue to take it slow. Its actually good you are taking trips to see him because you will have more quality time with him and get to know him better, likewise him getting to know you.

    Based on what you have mentioned so far he does not sound like a bad guy. Most Jamaican men that use women want you to pay for everything, they would not offer to pay for anything!! So i would look at that as a green flag! Let's be frank in all cultures you have good and bad its for us to take our time and learn these individuals as for who they are. He may have been through a lot of bad relationships in Jamaica that is why he may not want another Jamaican woman. There are plenty of other foreign countries with woman he could decide to be with if he wanted to but finds you very special. But take your time as everyone has stated and let everything work out its self.
