  1. I wouldn't get my hopes up. Being from India, with a past overstay and previous attempts at getting a GC, their chances are slim to none. You should probably just petition them for green cards if they want to come here.
  2. Sounds like you're planning something potentially dodgy. Planning to do anything other than to marry the petitioner within 90 days violates the terms of the visa, and makes adjusting status not possible.
  3. Yes, if she entered using a B-2 with the intent to stay and adjust status, that is fraud. Her only option would be consular processing after her spouse files a petition for a CR1 visa.

  10. I don't think it is a big deal, but you could try submitting unsolicited evidence in the form of a correction to the Laguna Niguel address. We submitted a much more significant piece of evidence, and it was included with our case. I would just write a letter with "to whom it may concern", and the page in question with the corrected date highlighted. Good luck.

  20. Whether he is required to pay for her attorney is not related whatsoever to immigration. It may be ordered by the court overseeing the divorce, yes. But again, not related to immigration. And I agree that she should just cut her losses and go home. She has no path to a green card other than via that marriage.

  22. No, there is no such requirement. The I-864 he signed is a contract with the United States government to repay them for any means-tested benefits she obtains.
