    Why you want to create problems in somebodys life when he/she is not harming you. I dont understand why people interfere in others life. Live your own life and let others live. I smell jelousy here.

    Yep,  Do not ever be alone with her anymore, in case of any false domestic violence claim.
    As you should know by now, she is probably staging a VAWA case against you by calling the cops on you (Oh she is so scared of you, might served you with restraining order as well).
     
    Not sure if you can prevent her from coming back to your house since it is considered marital home. You should consult your divorce attorney for further advice.
     
    Another thing, once she figures out she can't get her green card without you (K1 holder has to AOS with the original USC petitioner), she might have a 'change of heart' trying to reconcile with you.

    It's not abusing if he lawfully leaves the country before the 6-month period expires and spend the same time or more (most likely more) overseas. Of course B2 visa is not for living. You shouldn't make assumptions...

    She can stay and you can file. Once i130/i485 is filed she will not be deportable. I don't know why ppl are telling you she needs to go back. You are married.
    As far as the i864 affidavit - you have to show compliance with filing taxes before you file. Between the time of Sept 29th and when that is completed and you can file - your wife would be deportable - probably not a priority for ICE, but at risk.
    A US citizen or resident for tax purposes is required to file global income.

    There is no harm in just revising the whole documents and going over thru possible questions. I did my interview last week and a night before, I sat down with my husband and went over possible questions and how we will answer it. Our marriage is 100% genuine but I think it was still important for us to do that and it really helped 'cos my husband (USC) was very nervous to the extent that the CO had to ask him to relax😂. Thank God we went over the questions, it made it easier for both of us.

    Your period of unlawful stay itself is not an issue for traveling with advance parole. But there is always a general risk when reentering the country without having a finalized status. The single-way tickets don't affect anything.  The risk is small, but it is a decision you will have to make.
     
    But Note:
    1) A Marriage case is not "K-3".
    2) If you are in California, your interview may be coming up pretty soon. It may be best to just wait until you have the Green Card before traveling. You don't want to have to rush back in case you get your interview appointment.

    Hey ndifonman,
     
    Thanks for reminding me to update you guys. It went well. We got there 30 mins before appoint which was at 2.15pm and waited until about 3-3.15pm. Was not terribly busy. Went to the room and we were sworn in and biometrics done first. The officer then proceeded to ask my husband questions about when we met, how long we had been dating, who proposed to who etc. I was not asked any questions about the nature of our relationship. He then asked if there was anything we wanted to add to our file we gave him copies of extra documents for bills, insurance documents, lease agreements etc. He asked for pictures which we didn't have as we had packed everything for recently moved. And then we did the questions like ever committed murder etc. I asked for the stamp in the passport to be able to leave the country, he said he will only give that if it was an emergency but i should get my green card soon. all in all interview lasted about 15-20 mins which was way quicker total time than i anticipated. Thought i would be there all afternoon. I got updated that card was being mailed next day,  even though it said day of interview as day of approval.
     
    If you have any other more questions, will happily provide more detail.

    Just divorce him and let him be. It's not your business if he stays or leaves. He has built his life here too and to start over again might be hard but why do I tell you this. Just let him be.

    Congrats! It usually takes less than 2weeks for you to receive your green card after the approval is updated to produced/mailed.

    Hey everyone, I had my interview yesterday and had a very positive experience. We are waiting for the green card in the mail. Does anyone know how long it will take to receive it from the moment they updated the status "card produced/mailed" ???

    Thanks for the support, everything went well! The wait was long even though our appointment was at 8:15am. The IO was very calm and polite, and he asked only very basic questions about how we met and when we decided to get married. We had plenty of evidence and many pictures of our travels. The IO told us they do not approve on the spot but that they are "planning to approve" our case and we should hear back within 3-4 weeks. 
     
    Update: Just received a text and email notification from USCIS "Your Case Status: Card/ Document Production On August 22, 2017, we ordered your new card..... and will mail it to the address you gave us....."

    All opinions offered here are wrong. At every consulate I've worked at I've never seen an officer review proof of relationship before calling the applicant up to the window and starting the interview. It's true that I might take a look at the petition and see that the petitioner has been divorced three times or that there is a 40 year age difference, but I never make a decision before the interview. 
     
    As to tourist visas, there is no review prior to the interview. We know absolutely nothing about the applicant until they start talking.

    Finally, got my interview notice. However not from USCIS from Senator Booker's office as i had put in a request months ago.
    They remembered me i guess.

    Well, you can actually come on a B2 and AOS, as long as you were inspected by CBP you can, in most cases AOS if you marry a USC and your original intentions were not to AOS.

    I would say probably not much really can be done. It wasn't a quick 3 year marriage based citizenship, and like you said, there is no real evidence other than word of mouth about her making a comment....

    Is anybody else worried that the new USCIS Ombudsman - the person who is tasked with assisting immigrants having difficulties with USCIS (petitions that are taking too long or have been improperly rejected) - was previously the executive director for the Foundation for American Immigration Reform (FAIR), which is a non-profit whose aim seems to be to ban all immigration to the US except for spouses and minor children of US Citizens? 
     
    I understand that this administration has already been seen to be very anti-immigrant, but to put someone who ran an anti-immigration non-profit in charge of helping immigrants negotiate their way through USCIS? Really?

    That's clearly not my concern. As mentioned above, I do not wish to stay in the US or continue with my process for residency. Question is: what must I do before leaving the US to withdraw myself from this process?

    We had our interview yesterday at the JFK building in Boston. Our interview went well and the officer approved our case. Within an hour after our interview I received an email from USCIS saying that my case has been approved and a new card in ordered/produced :-)
