There's two ways you can do the EAD.
apply for it when you have your K-1, PRE-AOS
or apply for it with AOS.
Doing it before AOS only will have it valid for the 90 days
Doing it WITH AOS has it valid until GC shows up or a year, which ever comes first!
Sorry for the confusion, I wasn't sure if you were going to try for the K-1 EAD (Some do, most find out it's a waste of effort) or the AOS EAD!

You just filed in October and are losing your patience? Your ROC will take a minimum of 5 months, but could take a year or more.

It's never a good idea to lie to US immigrations. You've already filed the k-1, it's part of immigration record now so no point to cancel it. He lied in his visa intereview, if it's gonna be a problem, it's gonna be so whether you do a k-1 or a cr-1

On myUSCIS case status, I-485 says: Our National Benefits Center location is working on your case.
The emails all say the cases were routed to the USCIS National Benefits Center for processing.

It is highly unlikely that they will give you a new green card after taking your old one. She will need to file waivers anyway if you are deported and with your criminal offense. You can't stay in country while she does that.

What may help if you scan in the paperwork you got when your passports were return, and post it here. Be sure to hide any personal info such as names, case number and addresses first!
Also, look closely at your passports. Did they write in anything in there? Often, they will but a short string of numbers and letters in which is a code to explain why you were denied.

I think pretty much any petition can be rejected/denied but the difference is that your CR1 wont expire.
You can appeal a CR1 where a K1 you would need to start over.
It gets sticky when they throw that word fraud in the mix from what I've seen here...

OP, Your husband needs to file I-130 for you ASAP. You'll get your immigrant visa towards the end of the year 2018.
Once the baby is born, your husband will have to file an I-130 for the baby.

If you want me to keep my opinion to myself then don't post. I suggest you generate an appropriate amount of bona fide
relationship evidence because what you deem enough clearly wasn't, therefore the comment about phone records from the
CO. If you don't want to hear the truth and learn from your lack of evidence then don't post. Being defensive and talking about
body anatomy never got anyone a visa.

OP, nobody here on VJ has any idea what decision the Embassy is eventually going to decide on. You've got some good advice and tips here which may indicate a positive decision, but the people who are chiding you for not having the phone logs are doing so most likely because they're just seeing it from the CO's perspective. Don't take it personally. Obviously something triggered this "under review" time and you just need to wait it out...but nobody here has any idea what triggered it or what the outcome will be, they're just trying to help out/give advice based on their own experiences or experiences they've heard about on this forum.
A lot of evidence that people end up providing for these visas is "overkill" for normal couples. I seriously never would've saved receipts from our wedding and other such paper ephemera if I hadn't read here and on various sites that it's a good idea to do so. Overkill by relationship standards yes, but pretty standard protocol for this process.

What is obvious is that the CO is not convinced that you have a bona fide relationship and therefore the review.
It is up to you to prove your genuine relationship by any means possible and phone logs are one of many
basic ways to submit such evidence. No skype or phone logs was a bit careless on your part.
Normally a couple wants to see each on skype and not just email.
There are couples who leave skype running for hours, sleeping, eating, cleaning etc....and a once a day short skype
call or phone call would have helped. That is what is obvious.

It's normal procedure to keep it when they plan to issue a visa with it. If they gave it back to her at the interview it would be more likely indicating a denial.
