    The guidelines for K-1 said you should apply for SSN shortly after entering country and then change name after marriage. I took my wife to the Social Security Office the day after she arrived. She then went back after we were married. It saved us a lot of problems. Regardless of whether you work or not, you should applied for a SSN.

    You were married. Head of Household was not an option for filing. Married filing Jointly or Separately were your two filing options. The IRS will want you to refile correctly.

    I would tend to agree with you but I have seen stranger things. With such close scrutiny happening with immigration now anything is possible. Some overeager person at USCIS might decide that if you are too close to the poverty line then maybe you're not the right person for the United States and make you jump hoops to prove it. Or, like us, someone lost a couple of documents and decided to blame it on us and give us an RFE. I know they had the documents they wanted and the names on them were accurate because it was part of the package we sent. We had 4 exact sets of the same package and I took pictures of the actual documents sent for backup and proof. Like I said, I tend to agree with you but with USCIS, anything is possible.

    The affidavit of support requirement and proof can be a little tricky. If you file an I-864 in the year of 2016 then the current tax year will be 2015 as the previous poster said. It has to be latest full tax year that you actually filed taxes and can get a transcript for is what I am thinking. That means, a potential failure for proving adequate support without additional assets to make up the difference. Consequently, for 2016, a complete history of pay stubs and an employment verification letter would have to be submitted. Even though an employment verification letter is sent it still might not be enough if your pay stubs include overtime. USCIS might only consider base pay average hours worked and extend that to the rest of the year to figure out if you are going to make enough. Overtime is not guaranteed. This is some guesswork on my part but working in finance related positions for 30+ years and doing my own taxes, you get a feel for what might be allowable or not. In the case of I-864s I would rather have too much evidence then not enough to help them make up their minds. I get worried for people on here that are close to the poverty line. It gives USCIS too many chances to generate an RFE.

    Well, born in wedlock but not blood related is actually pretty clear but your step father isn't on your birth certificate and he didn't formally adopt you. A DNA test will work against you. So, I'm not sure what a private investigator is going to do for you.

    I am curious to what you are going to do if the Border Agent at POE only gives you a month. Just because you say you want to stay 5 months or 2 months. It's not up to you how long you get to stay. They can even deny you entry completely.

    I'm sorry about your situation. It sucks on many levels. First of all, you're not stupid. You were lied to and deceived from the very beginning until she was no longer able to hide the lies. Definitely lesson learned. If she was willing to lie to you on such an important thing and for so long then chances are your long term prospects with this woman are not good. Personally, I would never trust her again. If I couldn't trust her then what's the point of continuing the relationship. Trust is a key element of any relationship. Many people have talked about how difficult and expensive it would be to fix this if it is even possible. Give yourself a 48 hour break from her and the forum and really think hard about what is ahead for you. Make your decision with a calm head. No one can make the decision for you but they can certainly point out what the future may hold for you on multiple paths. Good Luck.

    OP.... I warned you several times about what not to do or take the family's threats seriously. Apparently you chose to ignore everyone's good advice on this thread. I'm sorry but you have put yourself into this mess. I would strongly strongly suggest you start following the good advice on here.

The March K-1 filers know full well what the waiting game is all about and how trying to second guess USCIS processing times and how they apply to individual cases is a waste of time. Wait the required amount of time, send an inquiry after that and cross your fingers. Good Luck!

    Do yourself a big favor. Go out and get drunk, wait 3 days then file for divorce before she does. You can't do anything about her citizenship except possibly by divorcing her. I feel sorry for you but your story is not uncommon and the answer is always the same. Cheating is not fraud and trying to prove actual fraud is almost impossible and USCIS has heard it all. Please research the forums and threads and you will see very quickly what everyone is telling you.

    It shouldn't be a problem. I thought they would want blue ink on originals since that is common practice for legal documents to prove a wet signature but now with high resolution copiers and scanners it doesn't matter. You can't tell the difference. They probably say black only because it might show up better on their scanners.

    No, because your DL would have expired when you I-94 expired. You have to wait until you get the EAD to get a California License now. We're in the same boat.

    I'm going to ask the question too. When is he eligible for parole or his actual release? It might make a big difference. Also, it is also strongly advised you get a lawyer to help you with this. I don't think this is a DIY situation.
