    Lying to a Federal Official is a criminal offense in the USA. Making false statements (18 U.S.C. § 1001) is the common name for the United States federal crime laid out in Section 1001 of Title 18 of the United States Code, which generally prohibits lying to or concealing (information) from a federal official by oral affirmation, written statement or mere denial.
    I doubt a lawyer can straighten that out.

    The Red Cross didn't scale the rule back, the rules are Federally mandated. It was whoever is in charge of blood in the government that did it.
    It is not all people from the UK it is only if you resided there between certain dates. UK blood banks will not use blood sourced direct from the US, since 5000 hemophiliac patients were given HIV contaminated blood from the US some years ago now. You may think the rules are pointless, until a relative gets one of the dodgy pints from somewhere, and pays the price. Until they develop at test which is better than the current 71% detection for cjd in blood, is it worth the risk?

    It isn't quite as simple as a straight time limit. It is if the CBP officer considers you have abandoned your status. However even if they do they cannot refuse you entry only an immigration judge can give a ruling on abandonment. So if they consider that to be the case it will eventually go to a court to be determined.
    The general accepted guideline is up to 6 months out no problem. 6 - 12 months you may or may not have some issue. Over 12 months get reentry permit, or whatever the thing is called before you leave. That will give you up to 24 months.
    If you stayed out longer than 24 months they still have to prove you have abandoned your status. Remember you are a legal permanent resident until an immigration judge says you are not, a CBP officer cannot make that determination.

    You will receive back the originals of any personal documents you submitted as part of the process.
    Copies of those documents plus all the official forms etc that you completed as part of the process will come back to you in a sealed envelope when the visa is delivered. That envelope must not be opened and is carried by you and given to the CBP officer when you enter the country. They keep that envelope and send the contents to the USCIS. You are not given any copies of what is in the envelope.

    Sounds like he fell foul of the change where cautions were not completely deleted from the system. As you said in was theft of a packet of cigarettes and nothing more don't worry it isn't going to effect anything.
    UK has a Rehabilitation of Offenders Act where depending on the offense a certain time after the sentence has been completed the offense becomes "spent" and can no longer be used against the person. The USA does not recognize the idea of "spent" convictions. Hence the no live trace his caution is on file as a "spent" conviction.

    that would ban most Americans then. Very few of them can correctly read or speak English. Only those of us born in England can.

    No way in a month of Sundays is that going to fly, otherwise we would all be knocking out oath letters on our computers.
    InfoPass appointment at the office where she was interviewed is the place to start. See what they have to say and take it from there.

    Welcome to the world of US immigration. When I went for the biometrics for my citizenship application the instructions said "Bring your driving license as identification unless you are applying for citizenship when your Green Card should be used instead." On the day I was required to produce both my driving license and Green Card
    What we in fact know is that those people were not asked for the original documents. If instructions tell you to take them, play safe.

    Please wind your neck in, I was making a general point having been around these forums for quite a few years and visited the Embassy in London for both professional and social reasons for quite a few years before I moved over here. I still count some of the COs in London as friends. I made no reference to any one person but referred to comments I had seen made here which no doubt made in good faith were misleading. If you failed to see that I really don't see how much simpler I can put it.

    I think you miss the point I was making which was in general terms rather that specifics as I've also seen people told that a letter of intent is not needed when the circumstances are the same. Practice and manual sometimes are out of sync and we are not the ones inconvenienced when they suddenly line up unexpectedly.

    It is the other way around, the need is not consulate specific it is the Con Off manual for it to be produced. London at the current time do not ask for it. You cannot say it is not needed, rather that is not the practice to ask for it. Let people decide for themselves if they want to take it or not. Far better to understand the situation and to decide for themselves to take something not asked for than to be asked for something they don't have.
    Use to read similar advice to people doing DCF in London that all that was required for domicile was to say you were moving back to the US. Of course the manual said otherwise and one day someone got asked for their proof of US domicile and denied their visa until they could prove it.
