    For RFE you should submit whatever you have to prove bona fide marriage ..

    I know.. My friend just moved to Dallas and he told me about less consumer protection in TX.

    I'm kind of worried I'll be sent an RFE, but I can't say for certain. It's been so long, that I barely remember everything that was sent. I know we sent a lot - probably more than we needed too. Would I have received one by now though?

     

    I would recommend  once every 2 weeks make a call to USCIS to find out if there is  any RFE issued on the case.

    Sometimes a denial can be a combination of your immigration status, down payment, credit score and LOCATION.  If you are from NY-NY then you actually have a higher degree of scrutiny when it comes to mortgages and purchasing compared to the rest of the country.    Title companies in NYNY are required to dig quite a bit deeper by law compared to the rest of the country before a home purchase goes through, so lenders are way more cautious. 

     

    It is a good idea to have at least one lender provide you with a per-approval before you even start looking. 

    In NY only one or 2 banks offer mortgages to H1B. M&T is one of the lender.  Who was your lender for both purchases ?

    I am also  in the process and received conditional aprpoval with the extension letter (my wife ROC). If they deny try with another bank. 


    If the borrower is USC I think most of the big banks will accept the extension letter.  Also really depends on the loan officer and the processor being able to understand the process and explain it to the underwriter.  I remember 10 yrs back I had a loan officer made a personal call to the underwriter manager in Mineapolis to revive a denied mortgage loan. So its all depends on the loan officer and processor.

    Its a tricky and risky option.. You are in a way trying to fool the consulate. I know many success stories.. but one incident where on of the person married in India and applied for K-1. I dunno how they found out or maybe a random check. consular officers went to check his neighborhood and found out from his neighbors that he was already married. His wife went for the k-1 interview and learned from CO about their investigation. They were denied and told them apply for CR-1. 

     

    If you are marrying there then recommend CR-1..

    You can't change the petitioner. Her mother can file for her. Per visa bulletin can save 7 years... F2B current Nov 15, 2010

    You can do one thing.. her mother has been here for few years. Once she becomes citizen file another I-130... 

     

    If her mother (GC holder) files now she has to live as unmarried until immigration.

    Sorry for going off topic but I feel that in this particular case if I had known more about my rights and legal status it would have saved me a lot of unnecessary stress and paperwork.

    I am also with Wells. I know the loan officer for past 10 years. I was also co-borrower on bro's home loan with Wells for 7 years.  I notified about my wife GC issue before the loan process. He said can't tell how it will workout with underwriters. Anyway we submitted the app and I uploaded the GC and extension letter through loan tracker. After a week they requested to provide proof of extending GC. I don't know if they saw the letter initially.  Few days before the request one of VJ member (@ColGil) posted his experience and the way he explained to the lender. Actually his post was really helpful. I just copied his words and explained by email to the processor with extension letter + copy of processing time from USCIS web site. After a week later I received the commitment. There was no condition related to her GC. So I think they accepted my explanation. Right now my process just slowed down due to some issue with the seller.

    Nowadays India is becoming digital.. Aadhar & Pan card is a must. If your parents have both then they should contact the local authority with a request to register for birth certificate. Few prerequisite docs they will ask to provide. I know most of these govt workers will give a headache but its doable..

    Yes.. from speaking to tier 2 few days back they are able to see requests made on the case, approval/denial etc.. So if she said send you a notice I am assuming it might be an RFE

Because it seems impossible to get an appointment, I wonder if I could go on Nov. 8th and ask for a case update (as I have seen here, the USCIS website doesn't provide more updates since the Receipt Notice 10/11/2016 ) and get a stamp to make sure I have something in the case the my I-751 process takes longer than the 1 year extension.

     

    I don't know if this would help anyone, but St. Louis USCIS field office has LOTS of opening infopass spots in multiple days.

    You can get a stamp from the office. If they suggest that its not expired yet, just tell them you are planning to travel outside.. 

     

    They will not provide you a case update. I spoke to a tier 2 yesterday. He told me that he knows the situation and wants to help but he can't physically see whats happening to the case in Vermont. He can only see whatever the system shows him, like any request made on the case (bio appt, RFE etc, Approval, Denial etc). He can't escalate a request to VSC until the case is out of normal processing time. 

     

    Since your case is under normal processing time, you will hear the same from the local office.

    They will not approve the visa... you need to treat and once is cured should retake the medical and reschedule the interview

Plus your statement was clear if you don’t have joint everything then you will get an rfe and/or an interview, as others have mentioned they also have not done this even when they don’t have a mortgage and live in a family members house. There are other evidences that can be used, hell she could get her husband to write an explanation as to why he didn’t put her on some of the bills. 

    Understood.. but I was just giving her an advice.
