Well, if she can prove the marriage was bonafide like you're saying it was, there is no way you can stop her from removing her conditions if she wants to.
Why do you think that stopping her from getting a 10 year GC will make it easier to avoid a long and costly divorce? I don't see a direct relation between how your divorce will be handled by court and her immigration status. What I mean is, if she wants to make your life hard for divorcing her, it doesn't matter if her GC has been renewed or not. In fact, she could use your reluctance to renew it against you.

Trust me I feel your pain. Please take action now and convince the CO to give you a second interview. This is the stage I am at when I also thought it hopeless there is still a chance. The 221g you received is Vague so tells me one thing. It is not in AP for a legitimate reason he/she can put on paper but for a gut feeling which hopefully you can over come. Good Luck. Email the embassy immediately ask what proof you would need to support the petition. AP is a denial of sorts but if they did not specifically ask for more info on the form which I don't see where they did. They intend to send it back for expiration of petition.

She was not denied. She is in AP and they are checking and waiting to make a decision.
What you,the petitioner, should do now :
Email the consulate immediately and convince them with evidence that she did not try to circumvent the K1 and that you both had no
intention to marry until after the K1 visa is issued. Prove it, how ? The burden is on you both. Contact your senator immediately to request
a second interview and a chance to submit evidence to disprove the 'assumption' of the CO. If your petition gets returned to USCIS, it will without doubt
expire and you have to start over and bump into the same hurdle. You could also marry and file a CR1.
Fly over and try to speak directly with them if possible. If she has a second interview.....be there !

I do not see anything wrong with wanting to study in the USA and be closer to one's fiance. That said, the CO most likely believes that your fiance was most likely using the F1 to circumvent the K-1 process, which is considered misrepresentation. Or, the CO could be believing that your fiance is just marrying you with only the intention to immigrate, and not to live in a bonafide marriage with you.
A 221g decision is considered a denial on record, but on the bright side, many of them can be overcome with evidence. You probably should seek legal advice before you marry her and begin a spousal visa, if you decide to go that route.

Most of us had to make sacrifices, financial or otherwise. Why would you have to leave your job and apartment to get married though? Take an unpaid leave or vacations, don't sabotage your current situation and add drama and complexity to your life willingly :/

My husband and I had a tough time with the K1 as well. We didn't give enough information the first time and by the time I was able to get it to them the petition expired. At that point, if we wanted to be considered again we had to file again and pay the fees. So we did. When he went for interview he was denied because of the previous filing. He had forgotten that I had filed and they put it in AP and then was denied again.
I would disagree with leaving here to go to India and live. I absolutely agree you should go there and get married.I couldn't leave my work either... nor my family. It may not be what you want to do, but in our case it has been the best thing we ever did.
Is it hard to live apart from your spouse? ABSOLUTELY!!! very hard. But we filed the K3 and we are having our interview this coming week.
None of this is easy. It takes patience and hard work and determination. If you really love each other and you know you can make it work It is the best way to get this completed and start your life together.
USCIS and NVC want to be sure of the relationship and I understand that. So many just want to be here. You know in your heart of hearts that this is real. They do not. They aren't in your shoes and have seen many couples who are trying to beat the system. It's just their job.
And BTW... not everyone has a problem with USCIS or NVC.... or any part of this process. If forms are completed correctly, information is given as requested, proof of relationship is given... yada yada... if you have the right information from the beginning and help along the way they do not give you a problem. I have had absolutely no problems with any of this process. I have never been asked to resubmit anything at all with the K3.
Please realize... they are only working with the paperwork. They have guidelines and policies as every other company does.

Question is, do you want to be right, or do you want to be with your spouse? Unfortunately, they won't bend the rules to suit your interpretation of what the process should be...
(As a side note, and something to keep in mind, when your spouse does move to the USA, your preconceived ideas of what immigrants are and do will be applied to him by others...)

Ok great but in the meantime it will behoove u to follow Ebunoluwa's advice to get your case taken care of. Your griping and high horse ride will not magically change immigration laws and processes. Seriously if that worked don't you think we all and the thousands before us would have already done that?
Then you can begin a campaign with congressmen to begin real immigration reform! Maybe start an awareness for change organization.

99% of the time there are no issues as most peoples petitions expire before their interview date, its only an issue when you get an incompetent CBP officer that shouldnt have the job in the first place.

It's so kind of you to answer. I'll try to call, but the embasy doesn't give explanation on things. I've tried in another situation. I've try to read as much posts as I can about this issues, and they say that there is no problem. Only a case from Montreal had difficult at POE because of this.

Focus on your relationship than the age. This is where I don't understand the constant worry about age gap when everyone says age is just a number. I never once thought/asked about if my interracial marriage to my wife will be a concern for immigration purpose, especially when it's uncommon in my wife's country. I just focused on documenting that we are a real couple.
Think of it this way, if you are worried about age then you will give the CO the same vibe at the interview and you don't want that. Work on showing them that you are in a real relationship, and keep it at that.
