    Do you want to be with a person who takes your life not seriously at all? I mean you are together for three years, you both went through the trouble of filing for K1, you quit your job, bought a ticket already for crying out loud! And she gets a cold feet now?? I am sorry, but she sounds very immature.
    Probably the best bet for you is to start looking for a job in your country again and forget the whole thing.
    I am not sure about "love" when her action speaks a very different tune than her words. May be she is not the marrying kind.

    I am going to help you out here, because I have been through this myself two months ago. What you can do right now is DO NOT SEND ANYTHING TO NVC ANYMORE. sorry for all caps, but it's important. The file is out of their hand, it's with the consulate now. All paperwork should be sent to your WIFE from now on, she has to carry them by hand to her interview.
    My case was also expedited in May and within three days it had arrived at the consulate in India from NVC. The consulate did not contact me, I contacted them after I checked my case status on CEAC and then they sent me link on ustraveldocs to schedule my own biometrics and interview online.
    Here is what you can do, go to ceac.state.gov and under immigrant visa category check your case status. You can put your case number and it will tell you if it is "At NVC" or " In Transit" or " Ready for interview". If its " ready for interview" it's already in Taiwan, you can contact the US embassy customer service by sending them email at <support- taiwan@ustraveldocs.com>, then they will guide you from there.
    You spouse can go for her interview within a matter of days now, depending upon the available interview slots at the embassy and her readiness with required documents. I would advise you to not be too hasty and do your AOS paper work first and send them to your wife before scheduling anything with the embassy.
    The IV fee can be paid at the embassy at the time of interview. To the embassy, your spouse should carry the exact amount in CASH, they do not take credit cards. You can still check online on ceac.state.gov if IV fee payment option is available to you now or not,
    your wife should fill out DS-260 online if she has not already. I am assuming it should be available to her even if IV fees are not paid, since this is an expedited case. If its not available yet, she should contact the embassy and they will assist her in accessing it online.She needs couple of printouts of the DS-260 submission confirmation page.
    Since you were in the stage of paying fees, I am assuming the civil and AOS documents have not been sent to NVC. If you have not done that, the best thing you can do is DHL the following to your wife ASAP
    1. Filled and signed I-864. If she is the only person immigrating and you are the only sponsor and sponsoring from your income which can be entirely accounted for by W2, it is advisable to use I-864 EZ instead. Much less headache.
    2. About six or seven recent pay stubs of yours, originals not necessary, xerox will do. If you are using other means as proof of income, then documented proof of that, including bank statements. Please note, bank statements are not necessary if the income stated on your W2 are above required minimum amount, which is around $22k/yr.
    3. Your 2013 tax return transcript or copy of your 2013 form 1040 which you submitted to IRS. This is mandatory.
    4. Optional is previous two years tax return transcripts, you can add them if you have them, or download them from IRS.gov
    5. Your job letter, if any, which states you salary, length of employment etc.
    Your spouse should not schedule the interview in haste before all the documents are received by her and are ready.
    For civil documents, she should carry her original birth certificate, original marriage certificate, any record of previous marriage(s), divorce record(if any), original police clearance certificate from her local passport office, two 2by2 passport photographs, her DS-260 confirmation page and of course her passport with at least six months left on it.
    AFTER she receives all the AOS documents from you, after she has successfully submitted DS-260 online and prints out the confirmation page, when she is confident she has all the AOS and IV docs ready to go, she should call the embassy again to schedule her biometrics and interview. She can do it herself online on ustraveldocs.com/tw or schedule it over the phone. She should print out the IV interview schedule confirmation page which will have her name, the time of biometrics appointment and time of interview on two different days, her passport number, her visa category etc.
    Next thing she has to do is call the US embassy approved doctor nearest to her and schedule her physical. They will need the interview confirmation page, which is nothing like the interview letter people generally receive from NVC and they will need the DS-260 confirmation page which has her case number along with 2by2 photographs, and her original passport for verification. Most people, starting from the doctors assistants to the embassy officials, do not know how to go about an expedited case, so they might keep on asking for the NVC interview letter, but she needs to explain that hers is an expedited case and take a copy of the expedite request approval letter with her if available.
    She needs to have enough time in between her medical and biometrics appointment so that the doctors report is ready before she goes to the embassy.
    Doctors reports come in two sealed envelops, one is her medical checkup report and the other is the Chest x-ray. She needs to bring only the smaller medical report with her to the embassy on the day of the actual interview. She is not allowed to open those envelops.
    To the biometrics appointment, she needs to take the DS-260 confirmation page, her biometrics and interview schedule confirmation page and her passport. The process takes couple of minutes. they will stamp the interview confirmation page after the fingerprints are taken.
    To her actual interview, she needs to take that stamped page from the biometrics along with all her docs, which will include, but not limited to
    1. Her valid passport and all her previous, old, expired passports if she has any, including passport of any other country if she has dual citizenship.
    2. All her AOS docs from you
    3. All her original civil documents plus photocopies of the said documents
    4. Proof of bona vide marriage. You know this can include a lot of things, but lots of photographs of the two of you is a must.
    5. Her sealed medical report.
    6. Again, the DS-260 confirmation page and the stamped interview confirmation page from the OFC appointment. The biometrics appointment is called the OFC appointment.

    If you are not given 221(g), then it's probably some minor stuff, I heard the state department has recently experienced some major IT problem which has made approving and printing visa come to a standstill worldwide. Hopefully they have fixed it now and will print out your visa and send you back your passport.

    Also, the moment you exit the U.S., you are going to face a ban of at least TEN YEARS, because you have over stayed so much. And because you have over stayed, no consulate is going to grant your family any visitors visa either, because surely they will over stay as well. Finally, go home to your family, watch your kids grow up, that's more valuable than struggling in America without rights.

    Go home. You have no path to legal status here. Why would you leave your kids and wife for seven long years, good lord! Is the American Dream that real and alive for you? Are you really having a life so great here that you left your family for SEVEN years?
    Here is the best thing you can do, gather your money which you have saved, get back home and build a life for yourself in the country where you have legal rights. I am sure you can get your wife and kids to any city in India and give them a better life. India has a lot of jobs nowadays, people make good money there, western amenities which you are probably used to by now are available there as well. So, go home. That's the only way.
    No one here can work miracle to show you any path that can make you legal.

    I am perhaps late to join this thread, but I think deep inside you know what's the right thing to do. That's why you have not used your K1 yet. If you do travel to the States, please make sure you can keep your job in France, so that you don't end up turning your entire life upside down if you do need to go back to France. Take care.

    OP, it's a risk when it comes to marrying an usc and then entering US on non-immigrant visa. The chances of getting denied entry at border increases many fold, as you will be viewed as someone with very strong ties to the U.S. and hence strong internet to immigrate. it might mess up your PhD and research etc if you can't get back. So think carefully what you would like to do. You have been made aware the potential risk associated, it's upto you what you want to do.

    OP, so far, you are okay. However, when you travel and get back and file AOS after that, you will be judged based on your latest entry and you do have intent to seek permanent residence now. You know it already and posting on a public forum. So, travel might not be the best idea.
    How about you travel after you get married, file AOS, receive your advance parole? You will be fine then. I strongly advise maintaining your student status while all these going on.

    OP, I will give an example from my personal experience. I never faced any problem with CBP when I was on student visa and every time when I traveled back home and came back, the questions were about my studies. But once it was about my personal life. The cbp officer asked me if I had any USC boyfriend, fiancé etc in US? Since I didnot have any USC relationship and my then BF( now husband) was still an international student like me, my answer was no.
    What if you are asked about your gf/fiancé ? Lying is not an option, at all. You must tell the truth and then it's upto the officer if he/she will let you in or not.
    He is still in status, third year into a 5 year PhD program, probably second level and no one leaves the program at this stage.

    If NVC has not received even after a month, it's time to call USCIS and ask a Tier 2 officer, where is your approved petition. nVC can't help you until they receive your file. You need to check with USCIS why they have not sent the file yet. A tier 2 officer will have all the information you need.

    The reason why people keep bringing up your PTSD and getting a job to support your family is because your father's chances of not being deported are slim to none and we just think it's time to pull it together and do what is needed to be done. I totally get that you feel awful about what is happening, but you gotta stay focused and help your mother too. Especially if there will be more legal fees.

    I had my interview yesterday in Atlanta and passed. Now finally a citizen! woohoo.
    We drove up from Alabama the day before and stayed at a hotel down the street from USCIS to be sure there were no delays and we got there on time. They don't let you check-in earlier than 30 minutes from your appointment, but you can go inside and clear security and wait if you like., They have vending area and restrooms etc.
    Interview took less than 10 minutes. Aced the test, didn't have to provide any evidence (I filed based on 5 year residency) and he marked my case as approved. I was booked in for the same day oath ceremony later that day. The ceremony was quite brief, they were expediting it as there was 100 people taking the oath! We swore allegiance, watched a video from the president and accepted our naturalization certificates. Glad it's all over, what a ride. Now to update SSN, driver's license, get a passport, register to vote...

    No government forced either of us to do anything, but it's just how the system works which makes it frustrating. You would think being married to a US citizen, you can travel together with less trouble, but it's not. She was also frustrated that I can easily apply for residency here in her country, (currently pending) but yet, my country won't let her in without all the red tape. That's the most frustrating thing, actually.

    I think its a very personal decision of OP to bring her parents or not. If she is not ready financially etc, what's the point of bringing the parents over? Its not cheap maintaining a household in the US with elderly parents who will need constant healthcare. The OP also mentioned her father gets great pension, so its not like they are scraping by in PI. OP do not feel guilt over things which you can not handle right now. Your parents should understand that they need to give you time and space to grow first, if thats how you feel.
    I would never dream of bringing my parents to the US, neither would they want to come live here anyway. They have no ties to this country. I can not imagine my parents would ever enjoy living here, uprooting their entire lives back home, leaving all their friends etc. Every time they visited here, they could not wait to go back, because US is just not their scene.
    Leaving your country and immigrating to the US is not abandoning your relatives, its just a natural progression of things in your life. Don't feel bad about it.

    P.s, do not tell him you gonna expose him, or sue him or something like that while you are still under the same roof. Do not show your hands before you make the move. Who knows what this guys is capable of when he will be in a desperate situation to save his green card! Be safe first, then do what is right. Seems like this person has no morals whatsoever and is horrible all around. Take care of yourself.
