Thanks Colleen- and to the rest of ya for the advice, We are gonna ring the embassy and ask if we might need a waiver. If we do we will have one ready for them. I am just so nervous and excited all at the same time. Colleen I seen in another thread that your hubby has an interview! Hope all goes well!
I find it hard to believe that a USCIS Agent would tell you to go ahead and Lie on your application...They didnt say to lie they said not to mention it unless it was brought up during the interview process. I still dont feel comfortable about ommitting this and thats why I asked for advice here. But yes that is what we were directed to do by a USCIS rep.

His waiver expired 7/3/05 and he left 12/31/05. I am just worried this may hold us back. Thanks!

My husband overstayed his VW, we applied for CR1 and K-3 both were approved. When I spoke to someone at USCIS they said that he shouldnt need a waiver and not to mention the overstay unless asked. To me that seems a bit fraudulent and we dont want to get into trouble.
To explain more in depth, we got married and USCIS told us he could stay and adjust his status from the US, so we were going thru all this when we were in a car accident that required medical treatment and therapy for both of us, this ultimately led to financial difficulties. Then we had a medical interview but were having trouble getting documents from his country sent to us. When I rang USCIS (we hadnt found VJ yet) they told us my husband should leave the country of his own accord before he is deported as we werent able to file the proper documents in a timely fashion and the illegal immigrant ban was exploding. Very crazy I know so hubby booked a ticket home and we managed to save and get ourselves squared away.
Now I am worried when he goes for his interview that we maybe turned down for the overstay. A USCIS agent told us that we shouldnt mention it but have any documnets proving what we were trying to do beofre he left just incase and explain our case. Oh and when I rang them after hubby went home another agent was helping me to get forms ready(telling me what ones we will need) she told me the other agent had no business telling hubby to go home.
Sorry about all the long drama, any help is greatly appreciated.

Laura as I was awaiting my approval I was looking at the timelines of those that were rolling in, there is a bit of a trend with the RFE emails. Those that recieved a confirmation email stating that the RFE was recieved it seemed like within about 2 weeks the approval was to follow. Good luck and I hope yours is on its way as we "type". Lots of prayers for you all!

Maybe you can call the USCIS number and ask them if they can email you another one or ask if there is somewhere you can download another one. Also ask them if they will accept the photo copy of the original. Good luck!

(((((hugs))))) Tracy! I seen our timelines and was like whoaaa! Yours is on its way and I am so praying for you girl! I am so happy, yet there is a part of me that feels guilty as I know there are so many recalled petitions and ppl who have been waiting far longer than me. I will pray for eveyone as Jersey girl said in a previous thread, it has to work! So many prayers going out to you Tracy! Hope your email comes soon!

Did you file Cr1-IR1? If you filed the I-130 (CR1-IR1) then it will take a few weeks to recieve an I-797 which is a NOA-1 otherwise known as Notice of Action. Once you recive that you can file the K-3 visa, this visa once apporved allows your spouse entry into the US to wait out the first petiton. It can be a long and tedious journey and you will need alot of paitence. Take a look at the guides and FAQs at the top of the page, you can get loads of help and answers. Good luck

sometimes it takes more than a few weeks, look at some of the timelines for your particular service center and petition.

I know what you mean. Well at least they lady was nice and is trying to help speed this up, as far as the medical exam, you may need to ask her if the one he had was acceptable. I thought that they had to be doctors approved by the embassy. Wouldnt hurt to ask.

I would ring the USCIS and ask what route you should take, In my opinion i would say that anytime you do something , name change etc, notify them so that your not bogged down with RFE's or the like. They may have a simple form to fill out and or can do this over the phone for you. It woldnt hurt to check. Good luck and let us know what they say in case someone else may have this question.

Our case was approved on the 8/1. I am just waiting on it to be forwarded to the NVC. Just took a look at my case online and it was touched yesterday. I wasnt aware that they worked on sundays. I hope this means they forwarded our case to NVC. Good luck everyone!!!
