Would it be possible for a USC to petition to bring a mother in law over? or does it have to be the immediate relative? i am only asking because my husband and I have discussed bringing his mom over. We wouldnt want to wait till he's classified as a citizen, but we will do what we have to I guess. Thanks

OK so I know I will have the I-864 to fill out and send back, heres my question, dilema etc. I am only working part time due to child care arrangements and caring for my grandad, so I know that I wont qualify under the guidelines of sponsoring my husband. My brother said he would sponsor us. So how do we go about this? I know he files joint tax returns with his wife, will they both have to sponsor (it wont be a problem just asking) and if so, do I fill out a form as well as them? Do they fill out seperate forms or will thier form be joint?
Also need to mention, I have been part time for going on my second year, I am under the impression I need last 3 years tax returns.
last year- part time
year before- did not file due to no income
year before (3)- filed jointly with my ex (he was main source of income) and wont give me a copy of tax return.

I can understand why the negative response fom some of the people on here as we all get frustrated at times waitng on the approvals, but I can also see why some of the "newbies" rarely post. I didnt post very much when I first came on either. Not sure about all the drama over the posts tho, especially after the skeptics apologised early in the thread. I am deffinately glad to see the approvals rolling in. Hope to see more, for all of us waiting in limbo.

No bother Tracy, as I said the only reason I was informed that they recieved my first RFE was because I was transfered to an officer, she informed me that it was revieved but not sure why it wasnt updated. According to your timeline you should be getting something soon as it is similar to mine, my I-130 was approved on the 18th and several people have been getting approvals on thier I-129f's. Chin up, we'll get there soon and it will be so sweet when we do!

Wonderful news Desperate!!! Congrats!!! I see our timelines are similar, and with things seeming to progress hopefully we will have our K-3's before too long! Race ya!!!

Hi everyone, I am in the same situation, however when I called the USCIS about recieving the second RFE the officer did tell me that they recieved the first RFE. Still I have yet to see any change in my status and no email confirmations on either. Tracy my dates are very similar to yours as well. I rang again to check on it and the woman told me this time that if I havent been notified after 30 days of sending it in then to call back, but they cant check or anything until it has been 30 days. One good glimmer of hope is that I have noticed some people havent recieved anything then all of a sudden get approved. Hopefully our time will come soon. Fingers crossed and best wishes to all. J&J hope all went well at the interview! Kewl news on the upoming trip as well. Wish I was going over too LOL. When I was over we went to the Ring of Kerry but it would be something you would need a lift for, but deffinately a beautiful site, we also went to Muckross house, its an estate in Kerry. Other than that you have done most of the things I would recommend. Have a safe trip and eat lots of butlers chocolate for me...LOL

Thanks Becca, I took a look at the flow charts last night and it looks sooooo long and drawn out. But I am not gonna let it dampen my spirits, we will get thru this. Good luck to you as well. Maybe we will get done with the NVC at about the same time!!!

Thanks, and your right, that is why we are gonna wait it out, I read from some others that had a longer wait span inbetween thier petitions that they took the I-129f and went back to thier country for thier interview. I dont know if I am correct in this but if that is an option it may be one that we might pursue. Good luck

I was under the impression that when you apply for the K-3 petition or K-1 it was to come to the states to get married, and eventually to adjust status, also considered immigrating, I wasnt talking about just coming for a holiday. I wasnt aware that K-1 and K-3 visas were considered tourist visas. As for my typing and wording , I have said before, that its not perfect, so appologies for that. But i wasnt suggesting it as an alternative.

Now its sent to the NVC where they will process it, there will be more forms and fees and there is a link on here for JAMES SHORTCUTS that aussiewench has posted, I beleive it is in the NVC forum, I plan on following that as best I can. I have no intention of abandoning my I-129f until the very end as there may be hopes of getting my hubby home sooner. If you abandon the I-129f you will have no choice but to wait the I-130 out and some petions dont move as fast as we would all like. That is just my opinion and some advice that I have read from other members. You ultimately have to do what you feel is right for your situation. Good luck.

I think applying for the visas indictes that everyone has an intention to immigrate, however I am not in any was suggesting he do it that route. However I was merely trying to point out the reprecussions of what he would be getting into if thats the route he takes. I myslef dont agree thats the way to do things, as it is a bit unfair for those uf us who have waited this process out.

Thanks Simple! Yes Shanny I was hoping that others with similar timelines would be able to somewhat base an approval or some sort of action by mine. Glad to know things are going smoothly for you. I am also hoping for the I-129f but realisticly I believe the I-130 to be our best bet. We will pursue both until the end and decide which is best. Hopefully the I-130 will come thru quickly.

We got ours on the 18th, No calls from anyone, and I was never touched at all, someone at CSC has been busy working instead of hanging out at the watercooler. Good luck, hopefully yours will be along soon.

You can come over and get married and stay, then file for adjustment of staus, however as others have already stated, you have to be able to prove the intent was not to get married on the basis of immigrating. Sounds confusing I know as that would be the plan to wait out the visa. You would have to prove strong ties to your country and you would not be able to leave the US after your VW expires, until your case is complete else you will not be admitted re-entry. Not a pro at this, but this is they way it was explained to me. Good luck.
