My SSC is restricted. So I am not able to use it for the I-9

My only option is a stamp.

My husband had no problem with his extension letter and expired green card as proof of legality to work in the US. Do you not have your extension letter yet?

You should be able to fill out the I-9 paperwork with your SSN and DL only. They never asked me for my extension letter or Green card. Even now that I'm approved and still don't have a Green card and expired extension letter, I got a new job and I-9 only needed my SSN and DL and A# number. But I guess it depends on the company.

    Yes, moving, new jobs, etc.

and 30 days is the normal wait time but there was a back up at CSC and they have only processed applications up to April 16th as of today.

you will need to let them know of your new address and you can try to make an infopass appointment and attempt to get a passport stamp to give you proof of a green card, but depending on your local office they may just say no.

I sent my package 3 weeks ago today as well, they received it 3 weeks ago tomorrow.

based on current time frames we’re looking at hearing something back on or by June 24th

We were routed to the CSC same as you but there is currently a huge backlog at the CSC. Our's took 16 days but they are currently in the 30-40 day range. Your current Green Card will be valid until its expiry which is why it is suggested to submit your paperwork as close to the 90 days as possible to try and ensure you get the NOA1 in time for your Green Card expiry.

If you have your Drivers License and a Social Security card with no restrictions (No "VALID FOR WORK ONLY WITH DHS AUTHORIZATION") then you can use those to satisfy the requirements for the I-9.

Take a look at the application form for the I-9 if you want to see what is acceptable.

    Good luck!

USCIS does not return package unless there is a huge mistake in application like missing signature, you file early than 90 days for joint etc. Like mine was returned to me since I filed a day earlier than 90 days windows. So if you are not missing those, you should have your checks cleared and might receive NOA1 after that. You can call them just to make sure but not much you can do than to wait.

For RFE or any news on your I-751 might take approximately 18 months unless you get lucky.

CSC has about a 45 day wait until it’s even touched. They are still working on mid-April as of today.

until it’s processed, it just sits in a pile and reps won’t be able to tell you if they have it or not. Some people have been told their package was lost and to resend it, but then the next day get their check cashed.

if you didn’t get your package back within a week then it’s safe to say that you’re going to have to wait.

you may be able to make an infopass appointment and plead to them, but it’s a hit or miss if they will help. It’s never ideal to do any major changes any time you’re doing anything with your green card.

Give them a month before you start worrying about an RFE or package being sent back.

Recently there was a thread about filing late and about 5 people posted that they had zero issues, someone was even a month late.   No RFE.  No immigration court.  Nothing.

An I-551 is a green card.  So an I-551 stamp is a stamp from the USCIS in a valid passport showing you have status.

I personally wouldn't even bother with the explanation since your package is already sent.

Not an issue, there are several stories here on VJ about people filing late and they were accepted and approved just fine, never heard a beep about filing late. Some even months too late, still not an issue.

You could potentionally try to get a i-551 stamp in your passport as proof of your status to show to the employer.

Dang. The issue is you need documentation that you are authorized to work. The green card does this, but it's expired now. Until the extension letter arrives, you have no evidence that it has been extended for 1 year.

    https://www.uscis.gov/i-9-central/acceptable-documents
You need either a document from list A (a non-expired green card works here) OR [1 from list B + 1 from list C]. The driver's license covers B fine, but I don't see anything in C that you could use.

You can still apply for the job fine. You just may have to hold off on the start date until you have the paperwork they will need for the I-9.

The guys over at USCIS are not paid to spend their hours hunting for minute excuses to deport. In fact, even though they sound like some cruel alien robots, they are very human. If your package was stamped 11th on their end, you very likely have nothing to worry about. In any case this is after the fact, and excessive worry and panic won't help the situation.

Watch bank account if you sent a check, and if they draw their money, you are home dry. Otherwise when and if they send an RFE, a simple honest explanation... along the lines of...

We were facing some financial hardship... I lost my job (you can give them your former employer's name and address and phone number if they want to verify... and even mention that,  in fact, Mom is the one who bailed you out... will do.

The thing about RFEs is that you need to pinpoint exactly what they are looking for.  If you get an RFE for being late, then just tell your story.  Don't fall all over yourself.  If you got an RFE, it's because your officer is a stickler for the rules, and emotions aren't going to touch them.

Say exactly what you told us.  You thought your date was xx/xx.  A month before, you lost your job and all your attention was focused on getting employed as quickly as possible.  Money was tight.  Mom came to the rescue.

Just give them the facts, gently apologize for your mistake, and send that letter off!

I still think you will be fine.  Good luck!

Yes...although what evidence of your work authorization do you have on you so you can complete the I-9? Until the extension letter comes in, you are an LPR but you don't have evidence of it yet.

If you went to the SSA previously to get an unrestricted Social Security card, then you can use that plus a valid ID.

Well, my personal opinion is that you're fine. People often file for adjustment of status with some overstay (some people even do it with months of o/s). Most of them make it perfectly fine and I'd argue that those people are in a more precarious situation than yourself as they are not yet LPR's at that point. You have LPR status already. I understand your concern, but I also suggest relaxing. In general, ICE are like the Deputy Marshals; they're going after really serious offenders for the most part.

You aren't getting deported, at least not for this.
It was a couple of days late - not the end of the world. Late filing is permitted with a request for late filing and a valid reason.
So, one of three things will happen:

    1) They accept it.
    2) They return the entire package as you didn't include a late filing request letter.
    3) They RFE you for your request for late filing letter. Once you send this, it should be accepted.
If you get either 2 or 3 , it would be sensible to have the letter ready to go the same day you receive it

All you can do is watch both your bank account for the cheque cashing, and your mailbox for the package being returned/RFE.

Very worst case scenario would be you file again and get a 10 year GC. Begs the question what would be the point in not allowing RoC.

    1. If you can't pay for the fee, apply for a balance transfer credit card which allows you to take some money out in advance from these credit cards while enjoying the 0 % interest rate.

    2. You're not being deported. They're too busy with handling other #######.

Please make sure that you don't go out of your way to bring USCIS's attention to the fact that you filed late. Don't go sending any letters apologizing or explaining your reasons or financial hardship, that is for the RFE if it ever comes.

There is a very good chance that nothing will happen and your case will be processed as per normal but putting a big red marker around the date you filed because you are nervous will not help your case at all.

I don’t know why you worried . I filed mines two weeks late with no tangible reasons . Wife signed one side of the document and didn’t Signed the other coz she didn’t know . Then left for a two weeks vacation. Had to wait till she came back . 2 weeks sent with no explanation why I sent it late . No rfe nothing .

Then applied for n400 and I’m in line for interview. my i-175 been sent to a different office for now . Hoping I get a joint interview this couple of months. Stop with the worry . Stay positive and wait on them . Then you can act upon it. Worrying about what you don’t have any power  just drains you emotionally. We will pray for you . Stay positive. Two days ain’t nothing for some deportation bs. Good luck

My impression is do the letter only if you get an RFE.  I would write what you wrote here.  You had a job situation and it threw you off.  But, it sounds like it will just be processed as is.
