    So he does his 2014 tax return as MFS, lists you as wife and writes NRA(Non Resident Alien) for your SSN. And you do nothing. If he has already filed his return as Single, then he needs to file a 1040X amended return as MFS. Should not be any red flags either way.

    I would recommend you get a SSN, Then use the MFJ status, as you would be an exemption and your husband would pay less in taxes.

    I'm one of those "hardly anyone gets an RFE from CSC" that DID get one. And it was for two things. A stupid typing error (fiancee's birthday not matching on two different pages) and they wanted a complete divorce decree, not just the final judgement page. So, it does happen. I mailed back the required info within 3 days, got my NOA2 less than 2 weeks later. So, it's good because someone is actually working on your paperwork and things could be done shortly.

    When did you get married? If last year then should have or still can(over two weeks left till the April 15th deadline) file as married. If this year then no need to worry about it until filing next year.

    +1 for this. Trying to apply the word "logic" in any form to dealing with the U.S. government is an exercise in futility. If it's any consolation, be thankful you're not tangling with the IRS. Now that's something that will make you go ballistic.

    Sounds like they noticed the "discrepancy". Which would explain why they're asking for "supporting tax documentation". You need to resolve the difference in income between your 2013 return and AOS affidavit.

    My advice would be for YOU to file the divorce petition. This would give you some measure of control in the upcoming custody fight. In California, you and your spouse will be required to attend mediation, hopefully to work out custody details fairly. If no custody agreement is reached, it will be left up to the judge to decide. Don't want that. Recommend you immediately draw up an MSA(Marriage Settlement Agreement) giving you primary custody of your child with fair visitation rights for your spouse. Present it in mediation and try to get the mediator on your side, so that your spouse will agree to it. Worked for me in my divorce.

    Walking back across the San Ysidro border crossing is usually a short wait. About an hour or less. Of course, that assumes you don't get pulled into secondary inspection for some reason. Driving back is a whole different story. They don't call it the busiest border crossing in the world for no reason, Traffic is a nightmare. I've sat in line upwards of 4 hours when driving back. Not recommended, to say the least.
    Have fun shopping on Avenida Revolucion.

    I couldn't agree more with the other posters statement about Cherry Blossoms. I was burned there, too. It's certainly a dangerous place to look for a wife. You sound like a great guy. I hope things work out for you.

    Philippines Customs wants you to declare jewelry, even if they are gifts. So they can collect their ridiculous tax. Having said that, I didn't when I flew there in February. Had no problem at the airport in Manila. Simply handed the form with nothing on it to the lady customs official and walked through.

I can only add that having gone through a similar experience many years ago the bottom line is ultimately you can't help someone who won't help themselves. Sad to say, but I tried for 10 years and finally ended up in divorce. Not saying it will happen in your situation. Best to prepare for any and all possibilities. Best of luck.

    It's okay to show a business loss on the Schedule C form. What matters is line 22, total income, on the 1040 form. Since they filed their tax return jointly then their income is together.

    A lot of good advice so far. I will just add that if the divorce is imminent I would strongly recommend that YOU file the divorce petition. This will give you some measure of control during the proceedings. Trust me, you may need it. Not saying they will, but things can get ugly in a hurry. Even in a no-fault State, like California. They certainly did in my divorce. And my condolences.

    This is bad, bad news. Do a VJ search for DACA from two years ago when it started. Caused huge delays, especially at CSC. There's a post where one guy did some major in-depth research on this at the time. Created several spread sheets of timelines to show the delays being caused by DACA. I'm getting a serious headache just thinking about it.

    If u can handle the price, UPS International Express Critical can deliver in less than two days from California to the Philippines. It's not cheap, close to $600. I checked their website and if you shipped your documents now it would arrive in Manila about 11:30am Friday morning there.

    Good luck with getting the IRS to answer a phone call. Best bet is to visit your local IRS office. Be prepared for a terrible DMV-like experience. Take a number and wait. And wait. Hours, with no restrooms. And when you finally get to talk with someone it will not get any better. Wish I could be more encouraging, but from my experience you should be prepared for the worst. It will be up to you to prove the IRS is wrong, with interest and penalties accruing monthly.
