hari29 got a reaction from Michael2017 in F2A Timelines
Of late its been 1.5 - 2 years from application to visa approval. Things change quite a bit in these visas. Some people who applied in Sep 2013 got their visas in 3 months and some who applied just 5 days later waited for two years. Nothing is certain. We can only guesstimate

Did your relative apply F2A or F2B visa for you? If you haven't gone to USA for 8 years after your visa is issued, you will have to apply again for the visa.

hari29 got a reaction from rutabaga in Petitioning for a voluntary deportee who did time for 2nd degree attempted murder
A deported guy who served time in jail for attempted murder with mental illness is as close as it gets to automatic rejection on any kind of visa. So I am not sure if I will waste my money on applying. They have rejected visas for far less than this. Its just one step above a self declared terrorist applying for visa.

hari29 got a reaction from Dohan in I filed a i-130 for my son, but now i moved
First do a mail forwarding request with USPS. They will forward all your mail for a year. Then fill change of address form AR-11 and file it with USCIS. Also call USCIS to notify them of the change of address.

hari29 got a reaction from dhenz91 in To File I-130 (F2A) for Seafarer Husband, His Employer Wants Him To Get US Visa too (don't know what specific category tho)
Once you file I-130 for your husband with you being a LPR, your husband's non-immigrant visa will be rejected. In the non immigrant visa application, you have declare any other visa you are filing for. You also have to prove your intent of non-immigration. If you file for F2A visa, you already have immigration intent and by that virtue your husband will be disqualified for non-immigration visa. First file the non-immigration visa and then file the I-130.
It takes 2 years approx. to get green card via F2A and in the mean time you will be disqualified for all other non-immigration visa. Even if you have a non-immigration visa, the officer at POE can reject your entry and deport you if he thinks you have immigration intent owing to your pending I-130.
Talk to an experienced attorney before you take any steps

hari29 got a reaction from Tygrys in F2A - Turning 21 in April 2016
The answer is no. After you age out (turn 21), you will move from F2A to F2B category. NVC will not expedite your visa for any reason unless your priority date becomes current even if it is a life threatening emergency. F2B has a much longer waiting time. Sorry about this.

hari29 got a reaction from Brewlin in Wife cheated on me, I'm on a conditional green card.
Please ignore most comments here. People are saying things that they think is common sense. NOT the law. First of all, before you even think of divorce, get the conditions removed from your greencard. All you have to prove is that you guys have been married for 2 years. That you have plenty of evidence of. Get this done ASAP.
As for your divorce is concerned, Its very complicated. Consult a lawyer. If you cant, go to www.avvo.com and post your questions there. Attorneys will answer your questions for free. You can even pick one of them for your divorce consultations further. People's individual comments are not the best way. Get advice from an attorney.

hari29 got a reaction from rhein in Wife has maintained relationship with P.I. boyfriend, what can I do?
As a greencard holder you need to maintain your residence in USA atleast 6 months in a year. If you stay longer outside USA, your greencard may be revoked. Since she cheated you on all aspects, trick her in to going back to her country and leave her there. You can even fly with her to show that this is just a visit and fly back without her knowing about it and preferrably take all her documents back with you. When you come back, file for divorce. There are spy softwares which can record all skype conversation secretly and also spy cams.Install them and record all for your court evidence. Call USCIS and withdraw I864 immediately. Also file a visa fraud claim with them.

hari29 got a reaction from Ivie & Eguagie in NEED GUIDANCE ON US TOURIST VISA FROM PAKISTAN
Its hard to prove that. If your parents are indeed dependent on you, there is more reason for you to overstay your visa in USA and work there to make money and send money home. Most illegal immigrants in USA do the exactly same thing. You are thinking as you. Think like the USA embassy official who interviews you. If you make this statement in the interview ("My parents depend on me, thus I have family ties here), the official will think that you are not well off to afford the journey and going to USA to work illegally to make money. Remember, for tourist visa you have to qualify on your own. NOT on the credentials of your Brother in Law or Sister. USA tourist visa does not have an official sponsor.
Again buddy, I am not trying to discourage you. I am just presenting all the difficulties and facts about this Visa. GOOD LUCK

hari29 got a reaction from Ivie & Eguagie in NEED GUIDANCE ON US TOURIST VISA FROM PAKISTAN
It will help (though only a little....you have none right now. so its an improvement) in establishing your ties to Pakistan. Get married before applying. That will help a great deal. Also if you do get married before, only apply for your visa alone, NOT also for your wife. That will negate everything.
Again everything depends on the USA embassy official who interviews you. They look for certain things in approving the visa (age, sex, family ties, finance, work, previous travel history etc.). Lots of luck you need. I will pray for you.

hari29 got a reaction from Ivie & Eguagie in NEED GUIDANCE ON US TOURIST VISA FROM PAKISTAN
1) Bank statement and letter from bank showing you have substantial amount of money for long period. Depositing huge amount one day before and getting bank statement is an old trick and US embassy doesn't like it if people try to fool them like this.
2) Sponsor letter from your BIL saying that he will sponsor your stay in USA and will take care of your lodging, food and medical expenses and also an invitation letter and marriage reception invitation. Also it will help if he sends you his financial documents (W2, tax returns, bank statements...at least for last three years). Also his passport copy and your sister's passport copy to establish relationship.
3)Any property documents in YOUR name (house, car, business documents etc). NOTE: NOT your father's documents or your relatives' documents. They are not valid. Also you need your tax documents.
4) Any family ties to Pakistan that can convince them that you will return and not overstay illegally. It may help if you are married and have kids. At least if you are engaged. Parents and relatives don't count. This one is tricky. Previous records of Indians and Pakistanis who went on tourist visas and invariably overstayed the visa makes it difficult for all of us. This is the most important thing they look for and the most difficult one to establish especially for a 23 year old single guy.
5) You have to apply online and print the form and schedule an interview appointment. You need to bring all the afore mentioned documents and the printed form along with you to the interview.
GOOD LUCK

hari29 got a reaction from Ivie & Eguagie in NEED GUIDANCE ON US TOURIST VISA FROM PAKISTAN
Hey Buddy....I am not trying to offend you in any way shape or form or trying to discourage you from applying. If I have come across like that I APOLOGIZE. I am just trying to present you the facts (or atleast what experience I had in the past). I have an American friend who works in US embassy in India and I heard all his views on these.
First of all, you have to understand what family means to Americans. After age of 18, family in America means wife and kids unlike where we come from. You are a single guy with no wife or kids. That means you have no family ties with Pakistan. Your parents and relatives don't count in US embassy official's eyes.
We have property is a typical south Asian way of saying. You need to have property in your name in the documents. You need that for your visa interview to prove ties. Your father's name in the documents is not acceptable. Again in America, your father's property is NOT considered yours. Also you need bank statements and letters from banks where you have accounts showing substantial amount of money for a long period of time to make sure you have enough money to cover your trip. A sponsor letter from your brother in law helps but not sufficient.
A verifiable job means a job in a well recognized preferably big national or multinational company. You need letter from your work to prove that you work there and you make substantial salary. Unless your business is a well known company, they wont accept that either. My friend told me that he sees people bring all kinds of documents claiming they own business. Not that I am doubting you, but many people used this for proving work ties and US embassy doesn't accept this anymore.
Also you have a clean passport means you don't have very many visas stamped on your passport showing you travelled to countries like UK, or anywhere else in Europe or Canada. This is a big negative and US embassy looks at this.
Also your reason for travel is marriage reception not marriage itself which is over already. Another red flag. In America, they don't have marriage and reception in two different places in two different dates like what we do in India or Pakistan. US embassy officials will deem this reason bogus.
Again please feel free to apply. If you would like to know what all documents you need, please let me know. I am more than happy to help. GOOD LUCK.

hari29 got a reaction from Ivie & Eguagie in NEED GUIDANCE ON US TOURIST VISA FROM PAKISTAN
Hi Waseem
I am a permenant resident in USA (originally from India) and have been living here for over 15 years. I have seen several visitor visa cases. Here is what it boils down to. 1) Nationality (it is easy for certain country citizens than others...being from Pakistan does not help in your case). 2) Age and Marital status (you are 23 years old, single guy visiting your relative...chances for you to stay in USA illegally is very high). 3) Ties to your native place (you are single, and no verifiable job...have a small printing business doesnt help...so is being the tax payer) Being a tax payer may be a big deal in Pakistan or India, it doesnt matter for US embassy guys.
So in essance, it all comes down to how the US embassy official who interviews you feels like on the day of your interview which is another way of saying you need huge luck. In all you have less than 1% chance. It costs 150 dollars to apply for tourist visa which is 15000 Pakistani rupees. if you are willing to spend that much money (and one full day of your time) for a 1% chance, by all means go ahead. GOOD LUCK
